The relation of the existing City zoning to the prop9sed R-1-D zoning in the tentative annexation was discussed briefly. It was apparent that there was considerable difference of opinion among Planning Corrunission members as to whether the subject area should be allowed to be a residential area or light industrial area. It was agreed that the matter would need considerably more study and discussion before even a pre- liminary recorrunendation could be made to the City Council. The Planning Director was instructed to notify Mr. Garrett of the decision. There being no further business to come before the Planning Corrunission, the meeting was adjourned at 9:00 A. M. John D. M. Members Present: Hill, Kelley, Lacy, Rudd Members Absent: Braun, Jones, Romans C. L. Schillinger 4295 South Delaware Dwight John 523 So. Windermere Rezonin~ The E. Side of 4 00 Block South Acoma Street (Extended) Hearing No. 20-58-A June 5, 1958 The subject area having been properly posted and public notice given, a hearing was held relative to rezoning of the area from R-1-B Zone to C-2 and a 70 foot wide P Zone District, all as described below: Beginning at a point on the north line of West Chenango Ave., 133 Feet West of the west line of South Broadway; thence north parallel to the said West line of South Broadway to the south line of West Layton Ave.; thence west along said south line of .West Layton Ave. a distance of 63 feet; thence south parallel .to said west line of South Broadway to the north line of West Chenango; thence east along said north line of West Chenango a distance of 63 feet to point of b eg inning, the area included to be rezoned from R-1-B (Residential) classification to C-2 (Corrunercial) classification. Beginning at a point on the north line of West Chenango Ave., 196 feet west of the West line of South Broadway; thence north parallel to the said west line of South Broadway to the south line of West Layton Ave.; thence west along said south line of West Layton Ave. a distance of 70 feet; thence south parallel to said west line of South Broadway to the north line of West Chenango; thence east along said north line of West Chenango a distance of 70 feet to point of beginning, the area included to be rezoned from R-1-B (Residential) classification to P Zone (Parking) classification. The hearing was opened .by the Planning Director showing photographic slides along with a land use survey of the area. The following gentlemen were recognized and spoke in favor of the zoning c hange: C. L. Schillinger -4295 So. Delaware (Part owner of approximately the south one-half of the subject area.) The following persons were recognized and spoke in opposition to the zoning change only in the north one-half of the subject area. Stephen Dreher, Jr. -4809 So. Broadway (Part owner of approximately the north-onehalf of the subject area.) Mrs. Stephen Dreher, Dr. -815 So. Broadway (Part owner of approximately the north one- half of the subject area.) Hill moved: Lacy seconded: That the hearing be closed. Ayes: Hill, Kelley, Lacy, Rudd Nays: None Absent: Braun, Jnnes, Romans I I I I I I Page 291 Later in the meeting and after short additional discussion, Hill moved: Braun seconded: That the Planning Commission recommend to City Council that the south one- half of the subject area, owned by the applicants, be rezoned, as requested and that the north one-half be left as is. Ayes: Braun, Hill Nays: Kelley, Lacy, Romans, Rudd Absent: Jones The motion did not carry. Reopened discussion brought out that the breaking of zoning on property lines is not a common practice but rather that the overall area needs should be considered. Also, that rezoning such a small area, as proposed in the preceding motion, would be a serious violation of City Council's area rezoning policy. Mr. Braun explained to the protesting property owners that the rezoning does not, in any way, mean that the City intends putting a street through on the extended route of South Acoma Street unless the property owners wish the street to be opened and dedicate the land for same. Rudd moved: Lacy seconded: That the Planning Commission recommend to City Council that the subject area, in it's entirety, be rezoned as proposed. Ayes: Braun, Hill, Lacy, Rudd Nays: Kelley, Romans Absent: Jones (Sec. Note -Both Mrs. Romans and Mr. Braun entered the meeting after the hearing but prior to final discussion and action.) And West One-half of 3500 Block South Clarkson Hearing No. 21-58-A February 13, 1958 June 5, 1958 Hearing No. 23-58-A June .J, 1958 June 19, 1958 Both of the above described areas having been properly posted and legal notices given, a joint hearing was held relative to rezoning as follows: Bogner & Shockley Area: Lots 5-25, Inclusive, Block 1, Higgins Englewood Gardens and Lots 26-46, Inclusive, Block 2, Higgins Englewood Gardens, from R-2-A (Residential) classification to R-3-A (Multiple Residential) classification. Lots 1-4, Inclusive, Block 1, Higgins Englewood Gardens and Lots 47-50, Inclusive, Block 2, Higgins Englewood Gardens and the south 100 feet of the Swedish National Sanatorium property, between South Pennsylvania Street and South Clarkson Street, From C-2 (Commercial) classification to R-3-A (Multiple Residential) classification. Photographic slides and land use maps were presented by the Planning Director. Those present and speaking in favor of the Bogner-Shockley proposal were: Claud Shockley Robert Lynch - -5275 South Pennsylvania (Applicant) 1525 South Franklin, Contractor, who stated that there is proposed, for both areas being considered, four apartment houses, one Doctor's clinic, and one rest home. Those speaking in opposition to the Bo gner-Shockley proposal, stating that they felt a re- zoning of this nature would lower property values and create certain non-conforming uses on East Hampden Avenue which to them would not be desirable, were: Hugo Olson -3810 South Elati, owner of three lots at 690 East Hampden Avenue. Mrs. E. Draper -3523 South Washington Street Virgie E. Gallagher Area: Lots 47-50, Inclusive, Block 1, Higgins Englewood Gardens, from C-2 (Commercial) classification to R-3-A (Multiple Residential) classification. Lots 26-46-Inclusive, Block 1, Higgins Englewood Gardens, from R-1-D (Single Residential) classification to R-3-A {Multiple Residential) classification. Those present and speaking in favor of the Virgie E. Gallagher proposal were: Mr. Richard Simon, Attorney, representing Mrs. Gallagher Mr. Albert J. Kurtz -3547 South Clarkson Those present and speaking in opposition to the rezoning proposal were: Mr. L. C. Bassett -3501 South Clarkson Mr. J. B. Chambers -3545 Soufh Clarkson Mr. J. A. Brady -3529 South Clarkson Mr. F. C. Eckert of 3523 South Pearl Street was recognized and asked various questions relative to the type of construction and landscaping proposed for the contemplated rest home. His questions were answered by Mr. Shockley. Page 292 Mrs. Dorothy Romans entered and was seated with the Commission during the above hearing. Hill moved: Lacy seconded: That the joint hearing be closed. Ayes: Hill, Kelley, Lacy, Romans, Rudd Nays: None Absent: Braun, Jones Later in the meeting and after some further discussion, Lacy moved: Romans seconded: That the Planning Commission recommend to City Council that the Bogner- Shockley area be rezoned as proposed. Ayes: Braun, Hill, Kelley Lacy, Romans Rudd Absent: Jones Nays: None In further discussion in the Gallagher proposal, it was brought out that the only area that would be truly affected would be the vacant lots at the northwest corner of the intersection of South Clarkson Street and Highway No. 70. The Planning Director stated that unless a specific proposal for construction in this area existed that the rezoning should not be granted for the reason that it would simply be a means of raising land values for a quick prof it by virtue of the rezoning. Mr. Simon, Attorney, explained that specific plans for an apartment house are being prepared for this area with sale of the land contingent upon the proposed R-3-A rezoning~ Romans moved: Hill seconded: That the Planning Commission recommend to City Council that the Virgie E. Gallagher area be rezoned as proposed. Ayes: Braun, Hill, Kelley, Lacy, Romans, Rudd Nays: None Absent: Jones (Sec. Note -Mr. Braun entered the meeting after the conclusion of the above joint hearing but prior to final discussions and actions.) Herman Ausink 1461 South Ogden Rezoning Approximately 125 Feet North of West Grand Ave. and 100 Feet East of South Acoma Street. Hearing No. 25-58 Mr. Ausink appeared and presented an application for rezoning of the subject area from P Zone to C-2 Zone District. Rudd moved: Romans seconded: That the Blanning Commission proceed to legally advertise, post the premises and hold a public hearing on August 7, 1958, relative to proposed rezoning as follows: (The West 100 feet of Lot 5, Van Meter's Addition, from P Zone (Parking) classification to C-2 (Commercial) classification. Ayes: Braun, Hill, Kelley, Lacy, Romans, Rudd Nays: None Absent: Jones Rex T. The Planning Director presented photographic slides, an aerial photograph and vicinity maps of the subject area and explained adjacent zoning. During the discussion, it was agreed that the subject area might well be zoned R-1-D if annexed because of the present use of City land abutting the area on the East and use of the land in the county abutting the area on the South. Lacy moved: Braun seconded: That the Planning Commission recommend to City Council that in the event that a petition for annexation of the subject: area is presented to Council, that such petition be favorably considered, contingent upon R-1-D Zoning upon annexation. Discussion brought out that both alleys had already dead- ended and the property owned by Mr. Brown's clients and land which said clients have just purchased abut the requested alley dedications. La~y moved: Hill seconded: That the Planning Commission recommend to City Council that the alley vacations be g ranted as requested. Ayes: Braun, Hill, Kelley, Lacy, Romans, Rudd Nays: None Absent: Jones Glen Wilson Wilson Investment Company 950 West Qxf ord Avenue Subdivision Both Sides 4000 Block So. Jason Street. Hearing No. 26-58 Mr. Glen Wilson, along with Mr. Coston of Costin Engineering, appeared to present a preliminary plan for subdivision of the subject area to be known as Oxford Heights, Second Filing. Dis- cussion as to the desirability of dedicating West Nassau Avenue brought out the likelihood that West Nassau would not be a feasible connection to South Huron Street because of grade differences and existing house in the right-of-way extended . It was also mentioned that the lack of Nassau Avenue at this point would insure that industrial traffic in the zone immediately to the West of the proposed subdivision could not enter the residential zone. Mr. Braun maintained that the Massau dedication should be made for easier circulation of fire equipment and residential traffic even if the dedication connected only South Inca Street and South Jason Street and did not g o through to South Huron Street. After some further discussion and s u udy of the plan, Hill moved: Romans seconded: That the preliminary plan of Oxford Heights, Second Filing, be approved and that the applicants be advised to proceed to draw the final plat, subject to all provisions of the Subdivision Regulations. Ayes: Hill, Kelley, Lacy, Romans, Rudd Nays: Braun Absent: Jones Jacob Snowbarger 800 West Oxford Avenue Subdivision Small Tract South of West Oxford Avenue and West of the City Ditch. Hearing No. 27-58 Mr . Snowbarger, owner, and Mr. Costin of Costin Engineering , appeared to present a preliminary plan for subdivision of the subject area. Mr. Snowbarger stated that it is his desire to continue to use indefinitely an existing 800 foot well located in the middle of the proposed street right-of-way. The Planning Commission questioned the legal problem of liability for dama ge if the well is allowed to be maintained in the right-of-way. After further discussion on details of the plan, Rudd moved: Lacy seconded: That the Planning Commission approve the preliminary plan and that the final plat be prepared with final action of the Commission kontingent upon the opinion of the City Attorney relative to lega l consideration for continued use of the existing well. While studies are being undertaken, it is requested that the possibil i ty of temporary water and sewer service during the period annexation proceedings are going forward be explored. The owners of the portion of the Block marked "excepted" have not reached a decision at this time as to whether they desire to join in a petition for annexation or be excluded therefrom. Rudd moved: Romans seconded: That the above letter be answered indicating that serwer service can be obtained for this area subject to the requirements of the South Englewood Sanitation District and the matter of possible water service, prior to completion of annexation, be placed by the applicant, before the City Water and Sewer Board; and, in the event that a petition for annexation of the subject area, including the part marked "excepted" on the plat, is presented to City Council, contingent upon R-1-B zoning, such petition will be favorably considered by the City Planning Commission. It was agreed that copies of the tentative ordinance be transmitted to representatives of trailer park owners and that an afternoon meeting of said representatives and members of the Planning Commission be scheduled prior to July 23, 1958.
