S. Census Block Statistics Program as announced by the I.C.R.P.C. It was agreed that the remarks on the subject, included in a memorandum dated August 20, 1958, from the Planning Director to the Planning and Zoning Commission, concerning the subject, be transmitted, through the City Manager, to the Mayor, as the Planning and Zoning Commission's thoughts on the program, previous consideration and approval of said memorandum having been given by the Planning and Zoning Commission on that date. That evidence is available of purchase of land by the subdivider from Mr. and Mrs. Arthur Sanger and Mr. and Mrs. R. E. Sunderlin along with a six inch reservation strip along the east side of the subdivision from the Wilson Investment Company. 2. That the most logical layout of Lots 14-15-16-17 be made with the approval of the City Engineer after consideration of drainage requirements, as well as lot area and frontage requirements, has been given. 3. That the City Attorney has determined whether or not the letter indicating agreement on the type bf housing constructed (see letter reproduced in Planning and Zoning Commission Minutes this date.) should be recorded with the plat or rexist only in the Planning and Zoning Commission Minutes. M. Members present: Hill, Kelley, Lacy, Romans, Rudd Members absent: Braun, Jones Page 320 M. O. Shivers,· Jr., Attorney George H. Allen, Owner Rezoning Northwest Corner (two lots) of East Dartmouth Avenue and South Lincoln Street. Hearing No. 30-58-B August 7, 1958 September 4, 1958 The Planning Commission again considered the subject rezoning application as stated in the previous meeting of September 4, 1958. Mr. Rudd reviewed the previous actions of the former Planning Commission and City Council (See minutes of September 4, 1958) in rezoning subject area originally for a specific pur- pose and pointed out that the purpose had been served and is still in use though in a non- conforming status. Mr. Shivers stated that it was his contention that his client had suffered a pecuniary loss by virtue of Council's action in zoning the subject area so as to make his clients use non- conforming. In further discussion, other Planning Commission members stated that they had investigated the site and the background of the movement during the past two weeks. It was also pointed out that the rezoning request, if granted, would violate Council's policy on required area for rezoning. Lacy moved: Romans seconded: That, inasmuch as the land use study of the area indicates no need for the requested Zone District on the basis of existing use or demand, and since favorable consideration of the request would be in direct violation of City Council's rezoning policy as to area requirements, the request be denied. Ayes: Hill, Kelley, Lacy, Romans, Rudd Nays: None Absent: Braun, Jones Mr. Shivers requested that the matter be scheduled for reconsideration before the Planning and Zoning Board with the full membership present. It was agreed that the matter would be scheduled as the first item of business for the October 9, 1958 meeting. City Council City Master Plan Aid He.a:ring No. 16-58-G April 24, 1958 May 22, 1958 June 5, 1958 June 19, 1958 July 24, 1958 August 10, 1958 September 4, 1958 The request by the Master Plan Consultant, Trafton Bean & Associates, for withdrawal from the City's Master Plan program was discussed (See attached memorandum for explanation). The Planning Director stated that negotiations for Federal Aid had given the planning office a taste of "red tape" that would be involved if Federal Aid grant woulq be pursued. In further discussion, it was agreed by Planning Commission members that the $5,000 budget appropriation for the Master Plan might best be used to secure qualified part time field researchers and draftsmen from the University of Denver to work under the City's Planning Director in building the Master Plan. It was also agreed that before any action be taken to begin research for the plan, that a determination on the need for housing inventory be made by the City Council after oral presentation of the Master Plan movements to date. Rudd moved: Romans seconded: That the Planning Director be asked to present the status of the Master Plan and housing inventory research to the City Council when a map, indicating rental units in single family zones, has been completed. Ayes: Hill, Kelley, Lacy, Romans, Rudd Nays: None Absent: Braun, Jones Mr. Braun entered and was seated with the Commission. City Council City Housing Code Hearing No. 34-58-B August 20, 1958 September 4, 1958 The Planning Director presented a map, partially completed, showing the location of apparent rental units in single family zones. The map is being prepared to provide an indication of the scope of the illegal rental problem. It was agreed that upon completion of the map that a presentation to the City Council of the merits of the housing code and the problems of enforcing same be also presented to City Council in order that a determination of further Planning Commission action can be made. This presentation should be a part of the Master Plan-Housing Code contact as requested in connection with the Master Plan. I I I I I I Page 321 Building Inspection Department City Metal Buildings (Residential Zones) Hearing No. 33-58-A May 22, 1958 August 20 , 1958 The Planning Director presented a letter from the City Attorney stating that, in his opinion, the City had clear cut authority to prohibit the erection of metal buildings in residential zones. After discussion, Romans moved: Hill seconded: That the Planning Office be directed to consult with the Building Inspector and the City Attorney to prepare a preliminary amendment to the appropriate ordinance to prohibit construction of metal buildings in residential zones, with admonition to draw the amendment in such a way so as not to prevlude proper modern building materials from use . Ayes: Braun, Hill, Kelley, Lacy, Romans, Rudd Nays: None Absent: Jones Planning and · Zoning Commission City ::i Rezoning Possible rezoning of Five Areas Along East Hampden Avenue and East Jefferson Avenue and Addition of Another R-3 Type Zone District to Zoning Ordinance. Hearing No. 14-58-C February 13, 1958 April 17, 1958 April 24, 1958 Aµgust 20, 1958 The Planning Director summarized the sixth and final phase of the 1958 ·zoning study as presented t o the Planning and Zoning Commission on August 20, 1958. He stated that the Federal program available to facilitate construction of apartment-type housing for elderly citizens requires that a non-profit organization undertake sponsorship of the project. Two such projects are under construction at present in the Denver area .. During discussion, it was agreed that no official advisory action was in · order on this matter. However, the findings should be made public in order that Englewood non-profit organizations might be aware of the .program. Lacy moved: Hill seconded: That the local press be contacted and given a summary of the report for publication in an effort to publicize the availability of Federal assistance for senior citizens projects, and that such publicity, in no way, infer that the City is in the position t0 sponsor such a project. Ayes: Braun, Hill, Kelley , Lacy, Romans, Rudd Nays: None Absent: Jones Planning and Zoning Commission City I. C. R. P. C. Regional Park Reservation Plan and Transportation Plan Hearing No. 114-57 October 17, 1957 The I.C.R.P.C. Park and Recreation and Transportation plans for the metropolitan area were discussed. It was brought out that implementation recommendations for the Park Plan included the possibility for a regional park authority. The Transportation Plan did not include any specific provisions for an area transportation authority. The Planning Director explained that both plans had been studied in preliminary form and that recommendations made by the City of Englewood on both plans had been accepted by the I.C.R.P.C. planners and built into the plans. Further discussion centered about the impact of the City's adoption of the Park Plan as to endorsement of a Regional Park Authority. It was felt by some members that the City's local park needs should be served before the Englewood taxpayer is taxed for regional "natural state" park areas; however, the members agreed that if and when the metropolitan area is financially able to undertake a regional park system, the I.C.R.P.C. plan is most desirable. Rudd moved: Romans seconded: That the Planning and Zoning Board recommend to City Councilihat the general concept of the I.C.R.P.C. Parks and Recreational Plan and the I.C.R.P.C. Transportation Plan for metropolitan development be approved. Ayes: Nays: Braun, Hill, Kelley, Lacy, Romans, Rudd None Absent: Jones City Council City Trailer Court Regulations (Mobile Home Parks) Hearing No. 8-58-H March 20, 1958 April 17, 1958 April 24, 1958 fylay 22, 1958 June 5, 1958 June 25, 1958 July 10, 1958 July 24, 1958 Page 322 The Planning Director reported that the City Council had requested the Planningand Zoning Board to meet, at a special meeting, with owners and representatives of Englewood trailer courts and that Councilmen be notified of the date, time and place of the meeting. The purpose of the meeting is to reconsider the proposed trailer court regulations ordinance and give those affected an additional opportunity to be heard on all provisions. Braun moved: Romans seconded: That the ~special meeting for reconsideration of the proposed trailer court regulations ordinance be scheduled for 8:00 P. M., in C±ty :Hall, October 2, 1958, and that the trailer court owners and representatives be notified by letter and provided with a copy of the proposed ordinance and that all City Councilmen also be advised of the time and place of the meeting. Ayes: Braun, Hill, Kelley, Lacy, Romans, Rudd Nays: None Absent: Jones Planning Office City I. C. R. P. C. Report The Planning Director reported on the proceedings of the I.C.R.P.C. meeting held on September 16, 1958. Even though a quorum was not present in the meeting, it was agreed by commission members that a committee of I.C.R.P.C. Commissioners, including County Commissioners and Municipal officials should meet with Axel Neilson and Mayor Nicholson to urge Denver's participation in the forthcoming metropolitan transportatbn survey to be undertaken by the State Highway Department with $500,000 in federal funds. It had been reported thatif Denver will contribute the equivalent of twelve men over a two year period, that the I.C.R.P.C. would be considered as the suburb's contribution to the survey. This would mean that Denver would contribute nothing in direct cash but the other four counties would be expected to pay 6e or Se per capita to finance continuation of the I.C.R.P.C. technical staff simply for the purpose of assisting in the transportation survey. Technical progress reports on the utilities services study and a compilation of zoning ordinance provisions in the metropolitan area were presented. The present outlook for completion of these reports and termination of I.C.R.P.C. staff is mid December, 1958. Planning Tasks Ahead A discussion of planning tasks ahead revealed that certain zoning ordinance amendments, including, (a) Clarify Zoning Board of Adjustment role, (b) Change title of Board of Adjustment to Board of Appeals, and (c) Clerk for Zoning Board of Adjustment other than City Clerk or Deputy, no longer require Planning and Zoning Board action since the City Charter clarifies points (b) and (c) and that a codefication of city ordinances to be undertaken in 1960 will clarify point (a). It was also pointed out that the matter of sleeping rooms in various zones is a logical part of housing code consideration and should be considered along with the housing inventory and the housing code. There being no further business to come before the City Planning and Zoning Commission, the meeting was adjourned at 10:20 P. M. INTER-OFFICE MEMORANDUM TO: Members of the Englewood Planning Commission FROM: Mr. Joe M. Lacy -Planning Director John D. Curtice Recording Secretary DATE: September 15, 1958 SUBJECT: A SECOND MODIFICATION OF MASTER PLAN PROPOSAL The State Planning Director, Mr. J. K. Smith, the City's Planning Consultant, Trafton Bean, and the City Planning Director met for a further negotiation conference during the first week of September. At this meeting Mr. Smith introduced some new and rather discouraging elements into the Master Plan picture. Smith stated that only two cities in Colorado had attempted a Master Plan in the manner in which Englewood seeks to accomplish its plan, this manner being the contribution of City Planning and Engineering services to provide one-half of the City's contribution to the planning work. Aurora and Durango had attempted this system and neither had been able to contribute enough actual services and production to ful- fill their commitment. In both cases the consultant was the party holding the bag, according to Smith. I I I I I I Page 323 After further discussion, I suggested that possibly the City may do as Littleton, Golden and other communities have done successfully, that is pay the City's entire half of the program in cash rather than attempting to credit City services. Smith indicated that this indeed would be more satisfactory since it would eliminate time consuming record keeping to justify City participation. It was thought that even with the restrictive Master Plan budget that perhaps the City forces could do the drainage parkway phase of the study and the Capital Improvements phase entirely, and contribute the money thereby released as the other half of the cash for the City's contribution. Bean, however , stated that he was frankly concerned about the enthusiasm and backing that seemed to be missing behind the Master Plan movement as evidenced by the watered down pro- grams and apparent shortage of funds. Smith's commentary on consultant difficulties in Aurora and Denver also contributed to Bean's uneasiness. The attached letter from Trafton Bean speaks for itself as to his now official stand on the Englewood Ma s ter Plan.· So we are now back where we started without a consultant . However , we do now have some idea of the relative expense involved in a comprehensive Master Plan accomplished with consultant aid. Moreover, we have had fair warning of the complexity of bringing Federal Aid into the Master Plan picture. It seems that the possibility of undertaking the Master Plan within the City's own Planning Department by using Master Plan funds to provide field workers and technicians available on a part time b asis f rom the University of Denver might be well in order. Moreover, the decision which the Planning Commission seeks from the City Council concerning the possibility of a housing inventory as a part of the research', for a Master Plan and/or a housing code will have a substantial bearing on the recommendation for Master Plan research. At the direction of the City Council, the Englewood Planning Commission has scheduled a public hearing on the tentative Mobile Homes Regulatory ordinance for Thursday evening, October 2, 1958. The meeting will be held in the Council Chambers of the City Hall , 3345 South Bannock Street at 8:00 P. M. Purpose of the meeting is to study the proposed ordinance in detail in order to clarify and discuss reasons for and the practicality of its provisions. The proposed ordinance has been printed as a legal advertisement in two issues of the Englewood Herald and Enterprise. It appears on Pages 12 and 13 in Section II of the August 21st edition and on pages 12 and 13 in Section II of the August 28th edition.
