A proposed plat to subdivide the subject area was presented by the Planning Director. The
matter was given a place at the closed planning meeting because it involved an interpretation
of ordinances and policy. After a thorough study o f the Zoning Ordinance and Subdivision
Re gulations, it was unanimously agreed that any division o f a parcel of land into two or
more building sites must be accomplished by a forma l subdivision, the primary reason being
to insure that such subdivision will be noted on the official maps of the city for proper
control and planning and as an additional safeguard to the property owners.
It was agreed that the wording in the Subdivision Regulations could be more explicit to
indicate the intent o f the Subdivision Regulations as to land that must be subdivided.
The Planning Director was instructed to consult with the City Attorney on this matter.
Hill moved:
Braun seconded: That Mr. Whitaker be notified that the subdivision of lots, as he
desires, complies with requirements of the Subdivision Regulations
and that the surveyor's drawing presented at this meeting will be
considered as the preliminary plat.
Ayes: Braun, Hill, Jones, Kelley, Lacy, Romans

In order to standardize subdivision procedures and bring the Subdivision Regula ti ons into
full force, it was suggested that the Board of Adjustment and Appeals be notified of the
Plannin g and Zoning Commission's interpretation of procedures for dividing parcels of land
into more than two building sites. However, it was agreed that any communication with the
Board of Adjustment and Appeals should be worded to show that it is informative in nature
and not instructive.
Hill moved:
Braun seconded: That the Board of Adjustment and Appeals be referred to Ordinan ce
No. 14, Series of 1957 , "Subdivision Re gulations", particularly
Article I, Sections 5 and 6 and Paragraph U of Section 7, and
Article II, Section 1, Paragraph B. Under the provisions of the
entire ordinance and particularly the above cited provisions, it
is the interpretation of the Planning and Zoning Commission that·
the division of land parcels into more than one building site can
only be accompl ished by a bona fide subdivision.

A tentative amendment to the Zoning Ordinance , as previously instructed by the Planning
and Zoning Commission, was presented by the Planning Director and discussed.
All members, except Mr. Braun, agreed that the maintenance o f open space and greenery in
residential neighborhoods was desirable and that such is accomplished by required setbacks.
They further agreed that such setback requirements helped control the population density of
the city.
Mr. Braun stated that he felt such a restriction is an undue imposition on builders and
land developers since it means a lesser return for the dollar in view of the fact that
fewer living units could be built on a tract of land.
Kelley moved:
Romans seconded: That the Planning _and Zoning Commission recommend to City Council that
the Zoning Ordinance be amended by adding to Article VI, "Supplementary
Re gu lations", an additional paragraph to paragraph 4, "Off-Street Parking
Requirements," as follows:
"'h) Required Off-Street Parking Space in Residential District
Required off-street parking spaces in residential districts
shall not be provided in areas required as minimum front yard
or in areas required as minimum side yard on the street side of
corner lots."

The Planning Director, having been instructed to contact the City Attorney regarding the
matter, reported that the City Attorney has written for additional legal opinions on methods
of requiring existing shrubbery and fences at hazardous intersections to be removed.
Further consideration should be deferred until requested information is received.

The Planning Director reported that City Council has accepted the recommendation of the
Planning and Zoning Commission for a less-than-a-block area for rezonirg when a "P" Zone
is involved. He mentioned that the present wording for area in rezoning policies is am-
biguous and possibly should be clarified. Planning and Zoning Commission members agreed
to study the matter and discuss it at a future meeting.
Mr. Braun asked if administrative action has been undertaken to curtail the use of illegal
rental units within the city.
Mr. Jones stated that he knew of no action and the Planning Director stated that no order
had been forthcoming from the City Council to indicate a full scale "crackdown".
The problem of a uniform policy and practical means of enforcement such as a house to house
inventory still remains.
There being no further business to come before the City Planning and Zoning Commission,
the meeting was adjourned at 11:20 P. M.

PLANNING AND ZONING COMMISSION.
Date: November 20, 1958
Subject: Amendment to Zoning Ordinance -Restrictions on Parking in Residential Setback.
Recommendation: That the Zoning Ordinance be amended by adding to Article VI, "Supplementary
Regulations", an additional paragraph to paragraph 4, Off-Street Parking
Requirements," as follows:
"(h) Required Off-Street Parking Space in Residential District~
Required off-street parking spaces in residential districts
shall not be provided in areas required as minimum front
yard or in areas required as minimum side yard on the street
side of corner lots."
