Further consideration should be deferred until requested information is received. Planning Office City Area Policy For Rezoning Hearing No. 41-58 (Also see Hearing No. 112-57-B, November 6, 1958) The Planning Director reported that City Council has accepted the recommendation of the Planning and Zoning Commission for a less-than-a-block area for rezonirg when a "P" Zone is involved. He mentioned that the present wording for area in rezoning policies is am- biguous and possibly should be clarified. Planning and Zoning Commission members agreed to study the matter and discuss it at a future meeting. Mr. Braun asked if administrative action has been undertaken to curtail the use of illegal rental units within the city. Mr. Jones stated that he knew of no action and the Planning Director stated that no order had been forthcoming from the City Council to indicate a full scale "crackdown". The problem of a uniform policy and practical means of enforcement such as a house to house inventory still remains. There being no further business to come before the City Planning and Zoning Commission, the meeting was adjourned at 11:20 P. M. Approved John D. Date: November 20, 1958 Subject: Amendment to Zoning Ordinance -Restrictions on Parking in Residential Setback. Recommendation: That the Zoning Ordinance be amended by adding to Article VI, "Supplementary Regulations", an additional paragraph to paragraph 4, Off-Street Parking Requirements," as follows: "(h) Required Off-Street Parking Space in Residential District~ Required off-street parking spaces in residential districts shall not be provided in areas required as minimum front yard or in areas required as minimum side yard on the street side of corner lots." M. Members present: Hill, Jones, Kelley, Lacy, Romans Members absent: Braun, Rudd (In recent reconstitution of the City Planning and Zoning Commission, Mr. John Schmitt of 2495 South Raritan Street was appointed to the Commission by the City Council, to be effective at the proper time. Mr. Schmitt was present during the session as an observer.) (Lots 31-40, Inclusive, Block 1, Taylor's Addition) Page 341 Hearing No. 112-57-C October 17, 1957 October 31, 1957 November 6, 1958 The subject area, having been properly posted and public notice given, a hearing was held relative to the proposed rezoning of the subject area (Lots 31-49, Inclusive, Block 1, Taylor's Addition) from R-2-B Zone District to M-1 Zone District. The hearing was opened with the presentation of a land use survey and showing of photographic slides of the area by the Planning Director. Mr. Jones, Planning and Zoning Commission Chairman, stated that citizens present and interested in the proposed rezoning would be heard at this time, and asked that Mr. and Mrs. Winslow , applicants and/or any other proponents of the rezoning to speak first and that any objectors or their representatives would be allowed to speak secondly. Mr. Winslow, the applicant, was first recognized and spoke for the rezoning stating that he favored the rezoning of the area for the reason that he desired to use his 100 feet frontage at the north end of the subject area for construction of a small office building with off- street parking for some thirty employees' vehicles or to use all for off-street parking under the terms of the P Zone. Mr. Winslow indicated that he did not desire to do anything to which his neighbors would object but that he felt that his landwas ~useless for residential zoning since he nor anyone else would be interested in constructing any type of a residential building on the site. Mr. C. Charles Buchler, Attorney, 3580 South Broadway, representing all of the objectors to the rezoning, was next recognized and presented a petition signed by nineteen owners of property in the immediate vicinity of the subject area, most of whom were in the audience. The petition requested that the subject area be not rezoned. Mr. Buchler stated that the applicant had not proven that his intended use was something which was important enough to rezone the entire half block for and that it was felt by the objectors that it would be very dangerous to rezone the entire area to an M-1 Zone when the demand for such zoning does not exist t hroughout , and in fact, does not exi t except on the 100 feet owned by Mr. Winslow, and thus render all existing reaidential uses as non-conforming. Mr. William Coffin of 3057 South Galapago was asked to speak, by Mr. Buchler, and stated that he had owned his residence in the subject area for many years and that he did not desire to see the proposed zoning change made since the area was almost entirely used as residential and further that he had no interest in developing hisproperty as any type of industrial use. Upon being asked by Mr. Buchler, all of the objectors in the audience, indicated that Mr. Coffin's statement was representative of their feelings. Planning and Zoning Commissioner Hill asked of the objectors in the audience if they would object to the land owned by Mr. Winslow being used for off-street parking as provided for in the P Zone. Chairman Jones, at this time, read the provisions of the P Zone from the Zoning Ordinance. The objectors all indicated that they would object to the P Zone use. Mr. Buchler further stated that in viewing the block personally earlier in the day had not been able to detect a great need for off-street parking in the block. There apparently being no further citizens to be heard, Hill moved: Romans seconded: That the hearing be closed. Ayes: Hill, Jones, Kelley, Lacy, Romans Nays: None Absent: Braun, Rudd In the discussion that followed, Mr. Kelley stated that he felt that the applicant would be making a mistake to construct any new residential use in the area which is already surrounded on three sides by actual existing industrial use. Mr. Buchler was asked by Chairman Jones if he felt that there might be some compromise possibly reached to allow parking on the north 100 feet of the block only. When Mr. BuchJer posed the question to the attending objectors, approximately one-half of them emphatically stated that they were not willing to compromise. The Planning and Zoning Chairman stated that the matter would need much further considera- tion and the Planning and Zoning Commission would consult further with Mr. Buchler as representative of the opponents and Mr. Winslow, the applicant, before rendering their decision. Mr. Rex T. Garrett 3484 South Downing Rezoning .Proposal Portion of East Side 3400 Block So. Downing Mr. Rex T. Garrett appeared to discuss the possibility of changing the use of the single family use in R-1-D Zone District on the East side of South Downing Street in the 3400 Block just north of the existing C-2 Zone District to a two family or multiple family use. The site is now known as 3484 South Downing Street. Mr. Jones, Chairman , explained that such a more would require that the area -be rezoned. He explained that much additional study has b een given to the subject area since the origi :n.i:tl current zoning map was drawn in 1955, none of which had indicated conclusively that the zoning s hould b e changed. He explained further that City Council's policy for rezoning, in such cases, requtres a full b lock of area for consideration and he suggested that the !."'·, Page 342 applicant wait for the full impact of the new highway constructi on east of the City limits before requesting any rezoning. Mr. Braun entered and was seated with the Commission during the above discussion. Robert L. Gillpatrick 3890 South Galapago Subil.vision Approximately One-half Block on West Side of 3900 Block South Galapago. Hearing No. 42-58 (Also see minutes March 19, 1955 and March 31, 1955) Mr. Gillpatrick appeared to present a drawing for a proposed subdivision of the subject area. The Planning Director read Plannin g Commission action taken on the subject area in 1955 in which the applicant had been instructed. to proceed with the subdivision of the land into five irregular building sites and was grated tentative permission for the capping of an existing sewer main in one of the sites in order that a structure could be built over it. Braun moved: Romans seconded: That the drawing of the proposed subdivision plan be tentatively approved and that Mr. Gillpatrick be hereby advised to have an engineer's drawing prepared according to the City's Uniform S u bdivision Regulations to serve as the preliminary plan. Whitaker 4960 South Lipan Drive Subdivision (Whitaker Subdivision, 3rd Filing (A resubdivision of Lots 31 and 32, Whitaker Subdivision, 2nd Filing) He aring No. 40-58-A November 20, 1958 The Planning Director presented a final plat of the Whitaker Su bdivisi on , 3rd Filing. After study, by the Commission, of the proposal, it was determined that the proposed utility easements must be widened in order to comply with the Subdivision Regulations. All other phases o f the proposed plat apparently being in order , Hill moved: Romans seconded: That the Planning and Zoning Commission recommend to City Council that the plat of Whitaker Su bd ivision, 3rd Filing, be approved, sub- ject to the widening of the utility easements to comply with the Uniform Subdivision Regulations. Ayes: Braun, Hill, Jones, Kelley , Lacy, Romans Nays: None Absent: Rudd Plannin g Office City Conference on Metropolitan Growth U. S. Chamber of Commerce -Washington D. C. Mr. Lacy, Planning and Traffic Director and Mr. Braun, City Councilman, reported on the subject conference, which they recently attended, as follows: 1. Colored slides of the conference exhibits and meetings were shown. 2. The program and note b ooklet distributed to all conferees was an excellent way of indexing and highlighting the copies of all of the talks presented at the conference. All material and statistics on these talks are -available to City officials. 3. Metropolitan gr owth has been 70% greater than other city growth and suburbs have gr own seven times faster than core cities since 1950. This is the "why" relatively new problems o f urban living have developed. 4. Industrial development is one solution to the tax base problem. Cities must be sure t o retain existing industries as well as at t ract new industries. 5. Traffic and pedestrian movement in the down-town area is one of the most pressing phases of the urban problem. One-way streets was mentioned as the most practical, economical, ways of solving much of the problem to the benefit of b oth business and consumer. 6. Many Chamber of Commerce manuals on urban problems were acquired and are available in the Planning Of fice. 7. Regional plans for Metropolitan areas throughout the nation were acquired and when com- pared with I .C.R .P.C. plans indicate that the I.C.RP.C. has done excellent work with regional plans in the Denver area. 8. Histories of metropolitan cooperation indicate that such is an evolution beginning with interjurisdictional cooperation between planners, then top elected officials, and then a combination of the two with such regional cooperation then given official status. It is encouraging to note that this national trend is developing in the Denver area through the I.C.R.P.C. and the Urban Mayor's or ganizati on and the pending reorganization of the I .C.R.P .C. to bring the two groups t o gether. 9. The only conferees fr om Colorado were the two from Englewood and Mr. Cal Snyder of the Denver Chamber of Commerce who had a program role. I I I I I Planning Office City I.C.R.P.C. Report Page 343 The Planning Director reported on the official I.C.R,P.C. meeting of No v ember 25, 1958. Items of b usiness included: 1. A group, representing the Suburban Mayors, visited the Commission to present their ideas for reorganization of the I.C.R.P.C. to provide more representation for municipalities. A fire member executive committee, representing the I.C.R.P.C. was appointed to meet with the Mayor's group to propose a reorganization. 2. The resignation of I.C.R.P.C. Director, Mr. Eurman, was accepted. 3. The master plan No. 4, THE GROWTH GUIDE FOR THE DENVER REGION was adopted and a critique of the report by George Nez was received. 4. No further word has been received on Denver's participation financially in the metropolitan transportation study. Members Present: Braun, Hill, Jones, Lacy, Romans, Rudd Members Absent: Kelley (Mr. John Schmitt, who will become an official member of the Commission on January 8, 1959, was present during the session as an observer.) Hearing No. 112-57-D October 17, 1957 October 31, 1957 November 6, 1958 December 4, 1958 Mr. Floyd Winslow appeared and presented an artists' sketch of the office building proposed for the northern 50 feet(Lots 48 and 49) of the subject area. Upon being questioned by Planning and Zoning Commission members, Mr. Winslow stated that he wished to use the presently vacant 50 feet (Lots 46 and 47) of the subject area for automobile parking only and that this area would be surfaced and fenced on the south side abutting the residential area to the south. The Planning Director reported that records in the County Assessor's Office revealed that the Winslow industry is assessed at $63,023 .00, while all of the residential area on the west side of the 3000 block South Galapago is assessed at $8,270.00.
