Items of b usiness included: 1. A group, representing the Suburban Mayors, visited the Commission to present their ideas for reorganization of the I.C.R.P.C. to provide more representation for municipalities. A fire member executive committee, representing the I.C.R.P.C. was appointed to meet with the Mayor's group to propose a reorganization. 2. The resignation of I.C.R.P.C. Director, Mr. Eurman, was accepted. 3. The master plan No. 4, THE GROWTH GUIDE FOR THE DENVER REGION was adopted and a critique of the report by George Nez was received. 4. No further word has been received on Denver's participation financially in the metropolitan transportation study. There being no further business to come before the City Planning and Zoning Commission, the meeting was adjourned at 11:15 P. M. John D. Curtice Recording Secretary MEMORANDUM TO THE ENGLEWOOD CITY COUNCIL REGARDING ACTION OR RECOMMENDATION OF THE CITY PLANNING AND ZONING COMMISSION Date: December 4, 1958 Subject: Plat -Whitaker Subdivision, 3rd Filing Recommendation: That the plat of Whitaker Subdivision, 3rd Filing, be approved, sub- ject to the widening of the utility easements to comply with the Un i [orm Subdivision Regulations. Curtice Recording Secretary * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * CITY PLANNING AND ZONING COMMISSION MEETING DECEMBER 18, 1958 The meeting was called to order by Chairman Jones at 8:05 P. M. Members Present: Braun, Hill, Jones, Lacy, Romans, Rudd Members Absent: Kelley (Mr. John Schmitt, who will become an official member of the Commission on January 8, 1959, was present during the session as an observer.) Floyd and Edna Winslow Winslow Construction Company 3002 South Huron Street Rezoning Portion of West Side -3000 Block South Galapago Street, Presently Zoned R-2-B. (Lots 31-49, Inclusive, Block 1, Taylor's Addition.) Hearing No. 112-57-D October 17, 1957 October 31, 1957 November 6, 1958 December 4, 1958 Mr. Floyd Winslow appeared and presented an artists' sketch of the office building proposed for the northern 50 feet(Lots 48 and 49) of the subject area. Upon being questioned by Planning and Zoning Commission members, Mr. Winslow stated that he wished to use the presently vacant 50 feet (Lots 46 and 47) of the subject area for automobile parking only and that this area would be surfaced and fenced on the south side abutting the residential area to the south. The Planning Director reported that records in the County Assessor's Office revealed that the Winslow industry is assessed at $63,023 .00, while all of the residential area on the west side of the 3000 block South Galapago is assessed at $8,270.00. After some further discussion, Page 344 Lacy moved: Rudd seconded: WHEREAS, the subject area was properly posted, public notice was given and a hearing was held on December 4, 1958, relative to rezoning of the subject area from R-2-B Zone District to M-1 Zone District, and; WHEREAS, the proposed building and parking lot with a proper fence between the lot and the existing residential property to the south would be a definite improvement to the neighborhood, and; WHEREAS, The proposed development is in accord with the indicated need for growth in the industrial zone since the subject area is surrounded on three sides by existing industry, and; WHEREAS, owners of residential property in the subject area do not wish to have their residential zone changed at this time, and; WHEREAS, The City i s striving to retain and foster existing industry as well as attract new industry, NOW THEREFORE , Be it resolved that the Planning and Zoning Commission recommend to the City Council that Lots 48 and 49, Block 1, Taylor's Addition, be rezoned from R-2-B (Residential) classification to M-1 (Li g ht Industrial) c lassification and that Lots 46 and 47, Block 1, Taylo r 's Addition b e rezoned from R-2-B (residential classification) to P Zone, such recommendation being forwarded to City Council only after a contact win Mr. C. Charles Buchler, as Counsel, for the opponents, by the Planning and Zoning Commission Chairman and the Planning Director. Ayes: Braun, Hill, Jones, Lacy, Romans, Hill Nays: None Absent: Kelley (The opponents to the rezoning have presented a petition signed by more than 20% of the owners of property within 100 feet of the proposed rezoning. A three-fourths majority of the entire City Council is necessary to pass the rezoning as recommended by the Planning and Zoning Commission, i.e., seven affirmative votes must be cast for passage of the recommended rezoning.) Richard E. Catron 3 South Downing Amendment to Zoning Ordinance For Bui;J..ding Height Hearing No. 43-58 Mr. Richard Catron appeared and presented an artist's drawing of a proposed six story medical and professional b uilding to be built in the C-1 Zone just north of Flood Junior High School on the site presently occupied by Catron's Clinic. Mr. Rudd reported on a conference held during the morning of December 18th, between Mr. Catron, Mr. Harvey Meyers, of the Chamber of Commerce, the Building Inspector, the Fire Chief, the Planning Director and himself, which conference was for the purpose of discussing the possibility of increasing the maximum height allowable for commercial buildings in Englewood. The conference determined that, since the building would be of Fire Type I construction, with special apparatus built in, the Englewood Fire Department could handle fire protection properly with present equipment. It was also determined, in the conference, that the building would comply in all other respects with the City Building Code. Mr. Catron further described, for the benefit of the Commission members, the proposed $575,000 building and pointed out that it would serve mainly as a medical center with some space devoted to office occupancy. After some further discussion, Rudd moved: Braun seconded: That the Planning and Zoning Commission recommend to City Council that the Zoning Ordinance be amended by additions as follows: Article IV, Section 9, Subsection 3 (C-1 Zone District), and, "One additional story to a total not greater than 75 feet may be permitted by directive of the City Council, if recommended by the City Planning and Zoning Com- mission, and all normal safety requirements are satisfied." Article IV, Section 10, Sub-section 2 (C-2 Zone District), and, "One additional story to a total not greater than 65 feet may be permitted by directive of the City Council, if recommended by the City Planning and Zoning Commission, and all normal safety requirements are satisfied." AYES: Braun, Hill, Jones, Lacy, Romans, Rudd NAYS: None ABSENT: Kelley Planning Office City Amendments to Zoning and Traffic Ordinances Hearing No. 35-58-B August 20, 1958 November 6, 1958 November 20, 1958 The Planning Director reported methods used by the City of Denver and the City of Aurora to I I I I I I Page 345 correct existing traffic visibility hazards at intersections and prevent the growth of future situations. Both Denver and Aurora use procedure similar to Englewood's present tree trimming policy for eliminating shrubbery hazards in dedicated right-of-way. Neither Denver or Aurora have had to pay for removal of hazards on private property, to date. However, the Denver Forester, Mr. George Stadler, stated that an ordinance providing that the City could pay for removal on private property would be most desirable. During further discussion, the Planning Director suggested that the Zoning Ordinance be amended to prevent future traffic hazards and that the Traffic Ordinance be amended to provide for removal of existing hazards with administrative procedures for possible remuneration where justified. It was agreed that the Planning Director would proceed with preparation of such tentative ordinance amendments for further study. Planning Office City Amendment to Uniform System Of Subdivision Regulations. Land To Be Subdivided Hearing No. 44-58 (Also See Hearing No. 40-58, Nov. 20, 1958.) The Planning Director reported Denver and Aurora handling of building permits in unsub- divided land. Denver requires a subdivision as a prerequisite to a building permit when the dedication of a street or alley is involved, as does Englewood. Denver also provides for a "Zone Lot Declaration" when building sites comply with zoning, leaving a remaining area which also complies with zoning and does not involve easements or rights-of-way. Such declaration is posted on the City map but does not change a legal description. Aurora's provisions require all land to be platted in the same way that Englewood's Sub- division Regulations Ordinance requires. Aurora does not require resubdivision to determine lot lines even though easements and rights-of-way are already dedicated. In discussion that followed, It was felt that the remaining number of undeveloped lots in blocks which already have streets, alleys and easements dedicated would · not justify the institution .of a "Zone Lot Declaration" system similar to Denver's. It was further agreed that a possible amendment to the Subdivision Regulations, more clearly explaining the purpose of such regulations, be considered which would contain the following provisions: A building permit may be issued on a tract of land without further formal resubdivision when the tract, 1. Is proper in area, frontage and all other respects as required by it's Zone District. 2. Leaves the remainder of the adjacent land in such a manner that it too complies with all Zone District restrictions. 3. Has no streets, alleys, or easements to be dedicated. 4. Is such that no special agreements such as water well usage or construction over a sewer line are necessary. The matter was then left, to be considered further at · a future meeting. Planning Office City Master Plan Hearing No. 45-58 The Planning Director presented and discussed an outline for the Master Plan, as previously transmitted to Commission Members. (See attached copy as a part of these minutes.) Sections I and II of the outline were discussed in detail and the Planning Director asked for authorization by Planning and Zoning Commissionto proceed with initial work as outlined in Section. II. Rudd moved: Braun seconded: City Council City That the Planning Office proceed with initial work on the Master Plan, as outli:i;red in Section II of the OUTI...INE FOR MASTER PLAN, and that said OUTLINE FOR MASTER PLAN and all other procedure material on the Master Plan be transmitted to the City Council for liaison. Zone Commitment For County The Planning Director presented the following letter, addressed to City Council, from the Arapahoe County Commissioners: City of Englewood City Hall Englewood, Colorado Gentlemen: "BOARD OF COUNTY COMMISSIONERS Arapahoe County Littleton, Colorado December 8, 1958 Reference is made to the Petition for Annexation of the area South of Stanford Avenue and South to Littleton City Limits, and from the present Englewood City Limits on the east to Federal Bo ulevard on the west. Page 346 Said area includes the land purchased by the Board ofCounty Commissioners for the extraction of dirt, rock, sand and gravel from George Adams. The petition for annexation is signed by the County with the understanding that if said area is annexed by the City of Englewood, theCity will not, so long as the County owns said land rezone or otherwise restrict or attempt to restrict the use of said area to prevent the use of said land for the purposes for which it was acquired. It was agreed that, although the specific zone could not be deter- mined at this time, that it probably would be of an industrial nature. It was also agreed that, even if it were not industrially zoned, the County's use prior to annexation could be continued indefinitely as a legal non-conforming use by right. Lacy moved: Rudd seconded: That the Planning and Zoning Commission recommend to City Council that the zoning commitment, as requested in the letter just read from the Board of County Commissioners, Arapahoe County, be authorized. Ayes: Braun, Hill, Jones, Lacy, Romans, Rudd Nays: None Absent: Kelley There being no further business to come before the City Planning and Zoning Commission , the meeting was adjourned at 10:30 P. M. (After the meeting was adjourned, Mrs. Romans, Planning and Zoning Commission Secretary, surprised the Commission members by serving a superb, maple pecan chiffon cake with brown sugar icing, topped with English walnuts, and coffee (Sanka). One excuse used for the pleasant surprise was -celebration of thePlanning Director's birthday.) Charles Buchler, the Planning Commission Chairman and the Planning Director was held December 22, 1958, at 10:30 A. M. in Mr. Buchler's office. Mr. Winslow was also present. Reasons for the Planning Commission's action were reviewed and Mr. Winslow assured Mr. Buchler that he definitely planned to build a small office building similar to one illustrated in an Architect's drawing presented at the December 18, 1958 Planning meeting. Mr. Buchler said he would meet with his clients, present the drawing and plot plan to them, in order to help them understand Planning Commission's action.) John D.
