Members Present: Braun, Hill, Jones, Lacy, Romans, Rudd Members Absent: Guilford PAGE 247 A communication was read from Mr. L. R. Rudd, City Manager, to Mr. J. M. Lacy, Planning and Traffic Director, appointing Mr. Lacy as an administrative staff member of the Planning Commission, effective immediately, to fill the vacancy created by the recent withdrawal of Mr. Neil W. Barde, City Engineer. Chairman Jones stated that the next order of business was the reorganization of the Planning Commission. Rudd moved: Hill seconded: That Mr. Lee Jones be nominated as Chairman of the Commission, Mrs. Dorothy Romans as Secretary of the Commission and that the position of Vice-Chairman of the Commission remain vacant pending the final appointment of the seventh member of the Commission, and that the nominations be closed, electing Mr. Jones and Mrs. Romans by unanimous ballot. Ayes: Braun, Hill, Jones, Lacy, Romans, Rudd Nays: None Absent: Guilford George Garfield 4475 South Downing Rezoning Approximately the north 1 /3 of the west side of the 3600 block facing South Sherman Street. Hearing No. 120-A-57 December 12, 1957 The property having been properly posted and public notice given, a hearing was held re- garding the proposed rezoning of the subject area from R-3 to C-1 Zone District. The hearing was opened by showing of photographic slides of the area. Mr. Garfield spoke, stating that he would take full responsibility for providing a retaining wall along the south line of the proposed boundary of the area for rezoning to facilitate maximum use of ·the land. Mr. Roy Rundtren of 3633 South Sherman Street, appeared to determine what usage would be allowed under the rezoning li the propos~d office building was not constructeQ, He was informed that no drive-in operations of any type would be allowed under the new zoning. There being no further comments or questions, Lacy moved: Braun seconded: That the hearing be closed. Ayes: Braun , Hill, Jones, Lacy, Romans, Rudd Nays: None Absent: Guilford In further discussion, Mr. Garfield agreed to provide, in writing, that he would be respon- sible for construction of the retaining wall mentioned above. Rudd moved: ~ Hill seconded: That the Planning Commission recommend to City Council that the above re- zoning be approved, subject to the applicant providing the City with written assurance that he will construct a retaining wall along the south boundary. Ayes: Braun, Hill, Jones, Lacy, Romans, Rudd Nays: None Absent: Guilford Carrol C. Shinn, M.D. 40 West Alameda Rezoning One half Block on the west side of the 3500 Block South Lafayette Street between Hampden Avenue and Highway No. 70. Hearing No. 124-A-57 December 13, 1957 The property having been properly posted and public notice given, a hearing was held re- garding the proposed rezoning of the subject area from R-1-D to C-2 Zone District. The Planning Director, Mr. Lacy, showed photographic slides of the area and reported on a telephone conversation with Mr. Ralph Bullock of Bullock Mortuary, 1375 East Hampden Avenue, on December 24, 1957, in which Mr. Bullock stated that he was much in favor of the proposed rezoning for the specific purpose of construction of a garden level medical clinic as intended. Mr. Lacy reported that in another telephone conversation with Mr. "Deke" Parsons, Planning Commission Chairman for Cherry Hills Village, on January 2, 1958, Mr. Parsons revealed 'th~t Cherry Hills Village has no objections to the proposed rezoning for the intended use. PAGE 248 Dr. Shinn was recognized and presented a petition signed by owners of all occupied property abutting the area proposed for rezoning, which petition favored the rezoning . He also presented architect's sketches of the proposed clinic building. There b~ing no further comments or questions, Braun moved, Lacy seconded, That the Hearing be closed. Ayes: Braun, Hill, Jones, Lacy, Romans, Rudd Nays: None Absent: Guilford In the following discussion, the Planning Commission considered rezoning the small triangular tract, which is included in the subject area, owned by the State Highway Department and abutting Highway No. 70, to P-Zone or leaving it as presently zoned (R-1-D). Braun moved: Hill seconded: That the Planning Commission recommend to City Council that the subject area, with the exception of the triangular piece abutting Highway No. 70, (See corrected legal description below.) from R-1-D to C-2 Zone District, with the triangular tract to remain in R-1-D Zone District. Ayes: Braun, Hill, Jones, Lacy , Romans, Rudd Nays: None Absent: Guilford Corrected legal description of area recommended for rezoning in above motion: Beginning at a point 100 feet south of the NE corner of Block 3, Verona Place, thence West 157.85 feet , thence south 213.4 feet, thence east 157.85 feet, thence north 213.4 feet to point of beginning, all within the City of Englewood, County of Arapahoe. John Holberg 3660 South Huron Rezoning 3700 Block South Inca Street. West side from R-1-D to M-1. East side from R-1-D to P-Zone. Hearing No. 119-A-57 December 12, 1957 The property having been properly posted and public notice given, a hearing was held re- garding the proposed rezoning of the subject area. The hearing was opened by showing of photographic slides of the entire area. The following property owners in the proposed rezoning and spoke in opposition to the rezoning as proposed: area and adjacent thereto appeared Charles Heltman 3897 South Inca Street E. A. Stewart 3740 South Inca Street Wayne C. Glanzer 3847 South Inca Street Mrs. W. E. Fleck 3700 South Inca Street Tom Jiron, Sr. 3760 South Inca Street W. H. Bashor, Representing Englewood Savings & Loan Assn. 3501 South Broadway. In the general discussion following, it was brought out that the U. S. Post Office Department has an option on the south one half of the property on the west side of the 3700 bloc~ South Inca Street. It was further mentioned that public buildings of any type are allowed in any zone in the city and that the Post Office Department could proceed to build their proposed annex with or without rezoning of the area. The various property owners, who live in the area proposed for rezoning and who spoke in opposition, indicated that their primary objection was not to the proposed M-1 rezoning but to the proposed P-Zone on the one half block on the west side of the 3700 block South Inca. Braun moved: Rudd seconded: That the hearing be closed. Ayes: Braun, Hill, Jones, Lacy, Romans, Rudd Nays: None Absent: Guilford Braun moved: Romans seconded: That the matter be tabled for further consideration and that the property owners in the proposed rezoning area and those living within 100 feet of the area be notified, in writing, when further action is taken. Bannock Rezoning Tract approximately 125 feet deep fronting on West Hampden Avenue between South Cherokee Street and South Bannock Street Hearing No. 49-B-56 November 15, 1956 December 13, 1956 Mr. Carl Moss appeared to informally request Planning Commission consideration for rezoning cf the subject area from C-1 to C-2 Zone District to allow construction of a service station. I I I I I I PAGE 249 The following discussion revealed that the intersection of South Bannock Street, Highway No. 70 and West Hampden Avenue has a higher accident count that any other intersection within the City. If a service station was constructed on the proposed site which lies within the radius of this critical intersection, the increased traffic flow, particularly across Highway No. 70, would seriously worsen the situation. Lacy moved: Hill seconded: That the informal request be denied and that no further action be considered. Ayes: Braun, Hill, Jones, Lacy, Romans, Rudd Nays: None Absent: Guilford Herman Ausink Rezoning 4979-85 South Broadway Hearing No. 106-C-57 September 12, 1957 October 3, 1957 October 17, 1957 Mr. Ausink appeared to determine the possibility of locating a proposed apartment building in the 4900 block between South Broadway and South Acoma Street in relation to the proposed P-Zone. After some discussion , Braun moved: Hill seconded: That the problem be received by the Commission and referred to the Planning Director for study. Ayes: Braun, Hill, Jones, Lacy, Romans, Rudd Nays: None Absent: Guilford John Holberg 3660 South Huron Lacy moved: Rezoning (See previous action taken earlier in this session on this hearing.) Hearing No. 119-A-57 December 12, 1957 Hill seconded: That the matter of the proposed rezoning of both sides of the 3700 block South Inca Street be raised from the table. Ayes: Braun, Hill, Jones, Lacy, Romans, Rudd Nays: None Absent: Guilford In the discussion following, it was agreed, that the P-Zone, as originally proposed, was designed to protect the existing property owners on the east side of the 3700 ~lock South Inca Street; but , inasmuch as the property owners in that area are opposed to the P-Zone buffer, as such, and not necessarily opposed to the proposed light industry zone on the west side of the street, the M-1 rezoning should be allowed to proceed. Romans moved: Braun seconded: That the Planning Commission recommend to City Council that the we st side of the 3700 block South Inca, from South Inca Street to the Inca- Jason alley, be rezoned from R-1-D to M-1 Zone District and that the area originally proposed for rezoning to P-Zone remain zoned as R-1-D Zone District. Ayes: Braun, Hill, Jones, Lacy, Romans, Rudd Nays: None Absent: Guilford Planning Commission City Planning Office Sub-division Franzman-Folkerts Subdivision Hearing No. 109-E-57 October 3, 1957 October 17, 1957 November 14, 1957 December 12, 1957 The Planning Director reported that the Franzman-Folkerts Subdivision will be ready for acceptance by the City Council° as soon as the required quit claim deed for 1 /4 of the inter- section of West Floyd Avenue and South Huron Street has been executed. It is hoped that this will be completed prior to January 6, 1958 in order that the City Council may act on the Subdivision on that date. College View Annexation Area bounded by West Harvard Avenue, South Zuni Street, West Vassar Avenue and South Cla~ Street. Hearing No. 1-58 A communication was received from City Council referring a petition for annexation of the subject area to the Planning Commission for study. Photographic slides were shown and a sheet of statistics on the petition itself and the subject area was studied. Some discussion was held, the results of which indicated that more data on the area is desirable and that considerable further study is necessary before any decision can be reached. M. Members Pres ent: Braun, Hill, Jones, Kelley, Lacy, Rudd Me mbers Absai t: Romans A copy of a letter was read from Mr. L. R. Rudd , City Manager to Mr. Robert F . Kelley, 3020 South Delaware , which verified Mr. Kelley's appointment as a member of the Englewood Planning Commission for a six year term. Chairman Jones stated that it was now in order to elect a Vice-Chairman of the Commission, such action having been deferred from the meeting of January 2, 1958 pending the final appointment of the seventh member of the Commission. Braun moved: Rudd seconded: That Mr. Robert F. Kelley be nominated as Vice-Chairman of the Planning Commission and that the nominations be closed, electing Mr. Kelley by unanimous ballot. Ayes: Brau n, Hill, Jones, Lacy, Rudd Nays: None Dissent: Kelley Absent: Romans Mr. Braun led a discussion on the possibility of purchasing a triangular tract of land, abutting Highway No. 70 between the Lafayette-Marion alley and South Lafayette Street, from the State Highway Department. He stated that perhaps the State Hi ghway Department would sell the tract for a nominal fee to the City and that the City would then have absolute control of the property. Subsequent discussion revealed that the City has equally effective control at present through it 's zoning powers and the the likelihood of the Highway Department selling the tract for an adverse use is very small. W. K. Robinson , Attorney Alden Brown, Real Estate Representative Equitable Building -Denver Rezoning Along North side of Highway No. 70 from S. ~eerman to S. Logan. Hearing No. 13-56 February 2, 1956 February 16, 1956 Mr. W. K. Robinson, Attorney, and Mr. Alden Brown, representing Garrett-Bromfield & Company and the major owners of subject area appeared to discuss informally the possibility of building a subsistence type shopping center, including a service station in the area. The service station would require no additional curb cuts but would require rezoning of a part or all of the tract. After considerable discussion , during which it was clearly stated that the City's present stand is to discoura ge construction of any new service stations abutting Highway No. 70, this proposal was likewise discoura ge d. The primary· reasons for the Commission's ·stand was that several over-all commercial area development plans are now being drawn and that any "nibbling away" of the larger area would be unwise at this time. Mrs. Romans entered and was seated with the Commission.
