Members Present: Braun, Hill, Jones, Kelley, Lacy, Rudd Members Absent: Romans Robert Cummings PAGE 253 Property Service Company 1500 West Tufts Avenue Rezoning Hearing No. 5-58 Area bounded by Little Dry Creek on the South, South Logan Street on the West, East Jefferson Avenue on the North and South Pennsylvania Street on the East. Mr. Cummings appeared and presented an application for rezoning of the subject area from R-2-A (East portion) and R-2-B (West portion) to C-2 Zone District. In discussion following, the Planning Commission's policy of not allowing C-2 usage on West Jefferson Avenue (Highway No. 70) was pointed out. The applicant stated that he had a wrong impression of what type of use could be made in a C-1 Zone District. Upon learning that a super market is a legal use in a C-1 Zone District, he requested permission to alter the application so as to apply for a C-1 Zoning instead of C-2. The Planning Director, Mr. Lacy, discussed the possibility of restudying the subject area as well as additional area to the South and East now zoned for R-2 use. Rudd moved: Braun seconded: That the application for rezoning be received with action to be deferred pending study of the subject area and adjacent zoning. Robinson Bear Frame and Axle 2946 South Broadway Rezoning Six 25 foot lots on Southwest corner of South Lincoln Street and East Bates Avenue. Hearing No. 3-58-A January 16 , 1958 Mr. Raymond Benton appeared to represent the applicant for the requested rezoning of the subject area from R-2-B to a P Zone submitted on January 16, 1958. Photographic slides of the area were shown and a report by the Planning Director on a con- versatbn with the applicant and Mr. Ralph Schomp of Arapahoe Motors was presented. In the conversation, the applicant and Mr. Schomp agreed to gravel the surface of the lot and erect a fence as required. They further agreed that no parking use except for employees and repaired vehicles awaiting delivery would be mrle on the site. Mr. Jones, Planning Commission Chairman, clarified th e intent of the surfacing provision of the Zoning Ordinance by pointing out that an asphaltic-type binder in the surfacing material is required rather than gravel alone. Mr. Benton stated that the applicant is considering changing the request to a proposed C-2 Zone extension rather than a Parking Zone in order that he might build on the site in years to come. It was pointed out to Mr. Benton that the proposed 6 lot area is too small to be rezoned 'under present rezoning policies and that Planning Commission would require that at least the balance of the block in which the 6 lots lie should be included in the proposed rezoning. Rudd moved: Hill seconded: That action on the request be deferred until reconsideration is requested by the applicant. Ayes: Braun, Hill, Jones, Kelley, Lacy, Rudd Nays: None Absent: Romans George Garfield 4475 South Downing Rezoning An area 65~ x 125' fronting on the East side of South Lincoln Street and abutting a plot which is approximately the north 1 /3 of the west side of the 3600 block facing South Sherman Street. (So. 15' of lot 12, all of lots 13 and 14, Block 2, Higgins Broadway Addition). Hearing No. 120-B-57 December 12, 1957 January 2, 1958 An application, accompanied by the necessary check, was received, submitted by Mr. Garfield. In the application, Mr. Garfield proposed to rezone the subject area from R-3 Zone District to a C-1 or p Zone to be used as off-street parking for a proposed extension to the present Tucker Building. In the discussion, it was pointed out that the C-1 Zone would be more desirable in this case than a p zone partic~larly in light of the rezoning of the adjacent area now in process. PAGE 254 Lacy moved: Rudd seconded: That the Planning Commission proceed to legally advertise, post the premises and hold a public hearing on February 27, 1958, relative to the rezoning of the subject area from R-3 Zone District to C-1 Zone District. Ayes: Braun, Hill, Jones, Kelley, Lacy, Rudd Nays: None Absent: Romans At the suggestion o f the City Manager, he was requested to cause to be prepared the legal description for alley vacation and rede di cation on the north end of the 3600 block between South Lincoln and South Sherman Streets as tendered by Mr. Garfield in his appl±ation for rezoning dated December 4, 1957. (Hearing No. 120, December 12, 1957) Planning Commission City Planning Office Rezoning "Scenic View" Area Hearing No. 4-58 -A January 16, 1958 The Planning Director presented a proposed rezoning map of the "Scenic View" area suitable for legal publication. He reported that the City Attorney had agreed that legal publication similar to that made for the Zoning Ordinance in 1955 would be acceptable. Braun moved: Hill seconded: That the Planning Commission proceed to legally advertise, post the area and hold a public hearing on February 27, 1958, relative to re- zoning of "Scenic View" area as proposed in above referred to map. Hower and the undersigned no longer represent Fredricka Broadhurst of 4332-4330 South Lincoln Street, Englewood, Colorado, in the matter of the zoning and nonconforming use problem affecting the property located at that address. This will constitute our withdrawal of appearances before your respective administrative bodies in the said matter. This, of course, does not mean that Mrs. Broadhurst will not pursue her administrative remedy further in connection with the said problem. Harrison HHH:vc A communication from the Conference Director of "Conference for Planning Officials" was received and rea d , relative to a scheduled conference. The City Manager stated that budget provisions are adequate for the attendance of the Planning Director at a conference to be held in Boulder, Colorado on February 14th and 15th , 1958. The Planning Director requested that any other Planning Commission members interested also attend the conference inasmuch as he will not be present for the Saturday session. College View Annexation Area bounded by west Harvard Avenue South Zuni Street, West Vassar Avenue and South Clay Street. Hearing No. 1-58-B January 2, 1958 January 16, 1958 The Planning Director reported the results of a conference with the City Attorney in which it was determined that the petition f or annexation of the subject area to Englewood would become invalid on March 16, 1958. I I I I I I Page 255 The Planning Director reported that departmental estimates by every department on the costs of servicing the area as well as the entire College View Section are being prepared. Planning Commission City Planning Office Re gion al Plannin g Value of the ICRPC to the Englewood Planning Commission Hea ring No. 6-58 As the result of a request by City Council, a factual analysis and br~ef history of the ICRPC'S activities was presented by the Plannin g Director. The discussion that followed resulted in the evaluation by the Planning Commission of the ICRPC's activities as are stated in the attached memorandum. Hill moved: Rudd seconded: That the memorandum, above referred to, be transmitted to City Council as the Plannin g Commission's evaluation of the ICRPC's activities. TO: Members of the City Council FROM: Plannin g Commission INTER-OFFICE MEMORANDUM SUBJECT: INTER-COUNTY REGIONAL PLANNING COMMISSION I. BACKGROUND: Respect ful ly submitted, ENGLEWOOD PLANNING COMMISSION By: Lee Jones Chairman DATE: January 31, 1958 The Inter-County Regional Plannin g Commission was formed officially in April, 1955. The Commission opened its offices at 1359 Court Place on October 1, 1955, .and began hiring a planning staff. Actual work on a master plan for the five-county area began during the summer of 1956. One of the first concrete proposals from the ICRPC was a Regional Service District Bill which was presented to the State Legislature during its 1957 session. The subsequent furor created by the proposed bill indicated a reorganization of the Com- mission was in order to give larger incorporated areas a direct voice in the Commission. Such reorganization was made, and Mr. Fred Janssen, already the chairman of the ICRPC , was appointed as Englewood's representative. II. STAFF: The operating staff of the ICRPC is composed of a director , assistant director , one research assistant, one associate planner, two junior planners, one secretary, and one typist. III. BUDGET: When the Commission formed its first budget , the five participating counties were asked and agreed to contribute 4¢ per capita of their population. During 1956 the need for a regional sanitation study became apparent and all five participating counties agreed to an additional assessment of 2¢ per capita specifically for the sanitation study. In order that t h is amount be forthcomin g from the Federal Government, at least part of the proposed 1958 budget as anticipated must be forthcoming. Commission authorities have pro-rated the amount of money necessary from Denver to complete the current pro j ect and determined that a contribution of $11 ,000.00 from Denver would be sufficient to qualify the ICRPC for the balance of the anticipated Federal funds. If Denver will not contribute at least $11 ,000 .00 toward the ICRPC , and the funds cannot be found elsewhere , the Commission will also lose the balance of the Federal mon e y . IV. STUDIES: The Commission has completed a number of planning surveys to date , all of which fall und e r one of three major types of study : A. SPECIAL CONSULTANT STUDIES . B. (1) A report on metropolitan Denver sewerage problems by Black and Veatch. (2) Storm water drainage study for the Denver re g ion by Dale Rea. MASTER (1) (2) (3 ) ( 4) (5) PLAN PRELIMINARY SURVEYS. Population g rowth and movement in the Denver re g ion , 1950 to 1956. Work and people in the Denver region. Transportation in the Denver region. Regional parks and reservations in th e Denver Re g ion. Urban utility services in the Denver Reg ion -Part I. C. MISCELLANEOUS STUDIES. (1) Re g ional Service District Bill. (2) A guide to street naming and numberin g in th e Denver metropolitan region. (3) Consideration involved in th e acquisition of school sites in newly developed areas. (4 ) A comparision of re g ional g overnment reorganization , Seattle and Denver. (5) An investi g ation of g overnment , its structure and function , in the Denver region. The comments hereafter represent the Planning Commission's evaluation of the ICRPC's activities. These remarks are the result of impressions and opinions based on basic data presented above , contact with neighboring City and County officials , contact with lay citizens , stud y of surveys completed by the ICRPC as well as official contact with the ICRPC. Two major re g ional surveys were arrang ed for by the ICRPC and completed by En g ineering consultants. These two studies comprise the most valuable work of the ICRPC. The re g ional sanitation study by Black and Veatch has been responsible for stalling the enlarg ement of the Littleton Sewer Plant , the construction of an Arapahoe Sanitation District Plant on Big Dry Creek and another proposed plant further up the South Platte River . Ne g otiations are now under way between the City of Littleton and the City of Englewood for possible use of Englewood's more adequate facilities by the City of Littleton. The storm drainage study is a sound basis for drawin g the boundaries of a storm drainage restricted building zone into the City's zoning ordinance if such is ever deemed nec e ssary. The study also serves as an excellent basis for drainage system design within the City when such a drainage system is to become a reality. The Planning Commission had the opportunity to study four of the five master plan "pre- liminary surveys" listed in Section IV-B above. The dif f erence in quality of technical fact gathering , analysis and presentation between the two independent studies mentioned above and the preliminary surveys is quite apparent with the ICRPC -conducted studies definitely inferior. There are apparently t wo reasons for this inferiority; (1) the ICRPC bud g et will not allow the hiring of an entire staff of technical experts in every field of plannin g and g overn- ment. As a result the nature of their work must be more g eneral and basic than that of the consultant firm which deals specifically in one area of study. (2) Areas in the r e g ion which have progressed farther than others in the planning field are able to exert a definite in f luence over the ICRPC's work , particularly if the specific area plannin g personnel possess "persuasive personalities". The expression "any9ne can make a mistake" applies to the ICRPC and its personnel no more or less than to an y one else. Therefore , certain errors of judgment leadin g to such tnings as the ICRPC director's testimony concerning a proposed airport site in Arapahoe County , while being "coached" by the Denver Planning Director , have not unduly influenced these remarks . Howeve r, the lon g step out of cha r acter taken by the ICRPC in sponsoring a Re g ional Serv i c e District Bill in the 1957 Colorado legislative session cannot be shrugged off so easily. It is true the out-of-bounds step resulted in a reorganization of the ICRPC to th e ad- vantage of all larger municipalities concern e d , but it is felt that the function of the ICRPC should be to study and recommend , and never to sponsor such l eg islative action under any circumstances. I I I I I I Page 257 It is the impression of persons who have regularly attended the regular ICRPC meetings, not necessarily Englewood personnel, that the meetings are dominated by persons directly concerned with the technical aspects of planning. Lay representatives are often "left in the dust" by the terminology and the direction of the discussion, thus making it difficult for them to fully understand certain aspects of the planners proposals or to clearly state their own community's stand on those plans. In summary, the Planning Commission feels that the ICRPC has declined in its effectiveness as a vehicle to reflect the will of the citizens for the future of the re g ion, but that any official action by the City of Englewood would be premature at this time. Simon, Attorney , representing Mrs. Fredri k a Broadhurst , appeared to present an application for rezoning of the subject area from R-1-D Zone District to R-3 Zone District. The petition for such rezoning had been accepted by the Recording Secretary for the Planning Commission at 4:55 P. M., Monday, February 10 , 1958. After discussion , Rudd moved , Hill seconded , Ayes: Hill , Jones, Nays: None That the petition be accepted and referred to the Planning Office for study and that the Planning Commission proceed to legally advertise, post the premises and hold a public hearing on March 13, 1958. Shockley 1771 South Jackson Mr. Shockley appeared to discuss the possibility of rezoning both sides of the 3500 block South Washington Street from R-2-A to R-3. Mr. Shockley was informed that a study of this and surroundin g areas is now underway and should be completed within sixty days. Mr. Shockley then stated that he would wait for the outcome of the study before making formal application. George Garfield 4475 South Downing Rezoning (Vacation and Dedication) Hearing No. 120-57-C December 12 , 1957 January 2, 1 9 58 January 30 , 1958 Mr. Garfield appeared to request vacation of a portion of the alley between S outh Lincoln and South Sherman Streets in the 3600 block and a small portion of Highway No. 70 right-of- way along the south side of East Jefferson Avenue in exchange for dedication of an alternate alley entering South Sherman Street, an increased turning radius at the intersection of the present and the new proposed alley and paving of the new alley and that port i on of the existing alley from the proposed building site to the present parking area of the Tucker Building .
