Mrs. Dorothy Romans , representing the Englewood School Board, stated that the School Board
has decided to enlarge Clayton and Maddox elementary schools and discontinue use of Hawthorne
school.
In the discussion which followed, the Plannin g Commission saw no objections to this movement.
There being no further business to come before the Planning Commission, the meeting was
adjourned at 11:00 P . M.

MEMORANDUM TO THE ENGLEWOOD CITY COUNCIL REGARDING ACTION OR RECOMMENDATION OF THE
ENGLEWOOD PLANNING COMMISSION.

Vacation and Dedication -Within 3600 Block between South Lincoln Street
and South Sherman Street.
Recommendation: That the alley in Block 2, Higgins Broadway Addition from the south line
of Lots 7 and 44 northward to present East Jefferson Avente be vacated except
for easement rights, and that the south four feet of Lot 48 and an e~tension
of such strip westward to the west line of the present alley also be vacated
or granted in return for dedication of the south 16 feet of Lot 44 and an
extension of such strip to the west line of the present alley, for alley
purposes, plus an additional parcel for increasing the turning radius at the
point where the newly-dedicated portion of the alley j oins the present alley,
said parcel to be in a form acceptable to the City En g ineer. The above action
is conditioned by the requirement that Mr. George Garfield, owner of ad j acent
properties, provide proper notification to the City of his intent to pave
that portion of the newly-dedicated alley and that part of the present alley
from the south line of Lots 14 and 36, in said block, northward to the newly-
dedicated alley. The above recommendation is made because the total proposal
adheres to sound planning and allows the subject area to be developed in a
manner most beneficial to the City as we ll as the owner.

The meeting was called to order by Chairman Jones at 8:00 P . M.
Members Present : Braun, Hill, Jones, Kelley, Lacy, Romans, Rudd

The property having been properly posted and public notice given, a hearing was held regarding
the proposed rezoning of the subject area, the map showing the various proposed Zone Districts
having been included in the publication for hearing.
Chariman Jones declared the hearing open and called upon Mr. J. M. Lacy, Planning Direotor,
to speak on the studies made in the preparation of the proposed zoning, and to explain
the various points of reasoning in arriving at the certain zone districts for certain areas.
After clarification of the Map by Mr. Lacy, the following property owners ·were recognized
and made statements or ask questions as follows:

Mr. B. J. Dade,1890 West Evans:
Mr. Dade stated that he represented a group of property owners along the South side
of West Evans Avenue and wished to commend the Commission for their forethought in
zoning the 125 foot strip along the south side of W. Evans as a commercial district.
Mr. Walter A. Jessee , 1930 West Baltic:
Mr . Jessee asked what effect the pro p osed M-2 zoning would have on the existing
school.
Mrs. Romans, Planning Commission and School Board member answered , stating that the
school would be well protected, relocating if necessary, in years to come .
Mr. DeWayne E . Fox , 1985 West Iliff:
Mr. Fox asked about the effect of M-2 zoning on his dwelling and whether he would be
able to sell or lease his property as a dwelling if located in an M-2 Zone District.
The non-conforming regulations of the Ordinance wer e cited to Mr. Fox which assured
him of his ability to continue the residential use for twenty years.
Mr. and Mrs. Butler, Box 131, Littleton:
Mr. Butler stated that he owned property with 300 feet frontage on Tejon Street and
120 feet in depth and that the east line of the proposed P-Zone and the west line of
the proposed M-2 District would split his ownership. The legal description of his
property is Lots 1 md 2, Block 7, Alta Vista. Mr. Butler felt the location of the
zoning line in this manner would be undesirable to him.
Mr. Butler was advised that further consideration would be given his particular case ,
but, it was pointed out that a P-Zone is primarily an additional setbac k requirement ,
along with being a buffer zone , and as such should not necessarily follow lot lines.
Mr. Dean Richen , 1910 West Baltic:
Mr. Richen inquired as to who would eventually pay for the P-Zone property.
It was explained that industry moving into the area would be interested in purchasing
the property in P-Zone to facilitate the required parking space thus leaving more of
the property zoned M-2 for the structures cf the industry.
Mrs . E. Reaksecker , 1831 West Harvard:
Mrs. Reaksecker inquired as to how much a residential dwelling can be expanded if
located in an M-2 Zone District.
Mrs. Reaksecker was advised that the dwelling could be expanded 25%.
Mr. Fred Haverkate , 3150 South Platte River Drive:
Mr. Haverkate inquired as to why M-1 zoning is proposed on either side of West
Dartmouth Avenue just west of South Santa Fe Drive.
It was explained to Mr. Haverkate that the anticipated development of West Dartmouth
Avenue will tend to increase greatly the truck traffic which is very important to
an M-1 Zone District and would render the area very undesirable for commercial or
residential type zoning.
Mr. George Johnson , 2401 South Pecos:
Mr. Johnson stated that he owned an automotive garage business in the proposed M-2
Zone District and that it was his understanding that he could not expand this business
or retain it after twenty years.
Mr. Johnson was informed that an automotive g arage business is a permitted use in
M-2 District.
Mrs. Leroy Hinton, 2280 West Harvard Avenue:
Mrs. Hinton expressed concern about the loc ation of the school in the M-2 Zone District.
Mrs. Romans of the Commission , assured Mrs. Hinton that the S chool Board would be
very watchful , as to the welfare of the school , in the development of the M-2 Zone
District.
Mr. Dennis Kelley, 2393 West Warren:
Mr. Kelley inquired as to why the C-2 Zone District , along the south side of West
Evans Avenue , is proposed for only 125 feet depth. He stated that his ownership
extended from West Evans Avenue 300 feet south.
It was pointed out to Mr . Kelley that with a resubdivision of the tract, with the
proper east-west street provided, full residential development of the remaining
portion of the tract would be permitted in the proposed R-1-D Zone District.
After it was determined that there was no one else to be heard.

A discussion held by the Planning Commission members later in the meeting centered about
the possibility of redrawing the eastern line of the proposed P-Zone District to follow
various lot lines in blocks affected. It was finally agreed that the purpose of a P-Zone
is primarily an additional setback requirement and as such should not necessarily follow
lot lines or natural features.

This letter is written in connection with an application made for the re-
zoning of the southwest corner o f Sherman and Jefferson , in En g lewood , and more particularly
concerns the matter of a retainin g wall to be built at the southerly side of said corn e r
property running east and west from a point t o be determined somewhere within thirty feet
west of th e easterly boundary of said corner prop e rty on Sherman , (said boundary being th e
dividing line between the parcel sought to be rezoned and the apartment building property
contiguous to the south) and running to some point also to be determined which will however
be very close to the e asterly boundary of a pr e sently existin g alley.
The writer hereby undertakes to cause such a retaining wall , as aforesaid ,
to be c o nstructed if , as & when the rezoning sought is g ranted. As a further term o f such
under $ak idg 1 b e it understood that t he writer undertakes to complete said construction
within 1 8 0 days from the date of the aforesaid g ranting of the rezoning application .

Tn the · event that another application made by the writer for the vacating of the
present alley by theCity of Englewood for a distance of approximately 100 ft., from
Jefferson in a southerly direction, (in exchange for which the writer undertakes to
convey the necessary space, at the southerly portion of the aforesaid corner property,
so that said alley can be continued out to Sherman instead of to Jefferson) is granted,
then the writer agrees that he shall cause all title in aforesaid retaining wall such
as shall vest in the writer to be conveyed to the City.
The writer further undertakes to pave that part of the alley which will consist of
the southerly portion of aforesaid corner property which the City will aceept in exchange
as aforementioned, if as and when the City does so. Said blacktopping, or paving, will
also be effectuated within 210 days from the date of the granting by the City of the
"exchange" aforementioned.
If desired the writer will furnish the City with any appropriate guarantees as to
performance which it may see fit to request.

I hereby undertake, and warrant performance of such undertaking, to pave with black-
top surfacing to be applied upon gravel base in a manner consistent with your specifications,
that portion of the alley running between Sherman and Lincoln, extending from the southerly
line of Lot 14 northward to the southerly line of Lots 7 and 14, of Block 2, Higgins
Broadway Addition, City of Englewood.
The commitment contained in the preceding paragraph shall be, however, conditioned
upon (1) the granting of a certain application for the rezoning of the plot approximately
95' x 125' at the southwest corner of Jefferson & Sherman which is now pending; (2) the
granting of a certain application for the vacation of the northerly portion of the alley
debouching into Jefferson between Sherman & Lincoln being approximately 100'; (3) the
granting of a certain application for the rezoning of Lots 13·, 14 & 15' of Lot 12, in
Block 2 , Higgins Broadway Addition, also now pending.
It is understood that all of the above are parts of an integral plan involving the
creation of a building and parking areas to be known as the Englewood Officenter, and
that said parts are all essential to the coordinated realization of the ultimate objective.
It is further understood that the above commitment is in addition to and not in lieu of a
prior commitment to convey a strip of land as hitherto described at the souther l y part of
aforesaid 95' x 125' lots, which commitment similarly provided for paving of said strip
and a certain retaining wall, also hitherto described.
I should like to mention, merely so that the record be clear upon the point, that
once granted to the City the obligation to maintain said paved areas shall devolve upon
the City, and that there shall be no recourse to the undersigned in connection with any
problems of any nature whatsoever which may derive from said pavings. It is for this
reason that I undertake said pavings according to City specifications and will welcome
any supervision which the City may wish to extend so that the installation will be made
in such a manner as to obviate recourse.
Trusting that this is clear and satisfactory, and assuring you of cooperation in
clarifying any aspect of this which is not clear,

It was felt that apparent inconsistencies in some departmental estimates minimized the
effectiveness of the report. It was suggested that the Planning Office revise the report
after consultation with certain department heads and add some additional tabulations in
order that further consideration of the area might proceed on a completely realistic basis.
Further discussion revolved around the effect of Englewood's action on the proposed annexa-
tion as to:
1. The impact on County tax base.
2. School District boundaries and finances.
3. Shbpp l:ng habits of College view consumers.
4. Likely future development in the area.
5. Cost of prividing City services.
6. Effect on legality of Denver's proposed annexation,
and others

for annexation of the sub j ect area be accepted.
