Case USE2017-009 Conditional Use, Amusement Establishment in the MU-B-2 Zone District b . c . Moved by Member Ron Fish Seconded by Member Mike Freemire To open the public hearing for case #USE2017-009 Conditional Use , Amusement Establishment in the MU -8-2 Zone District For Against Abstained Cate Townley x Daryl Kinton x John Brick x Mike Freemire (Seconded By) x Ron Fish (Moved By) x Randall Coleman x 6 0 0 Motion CARRIED . Staff Presentation Ms . Audra Kirk , Planner 11 , was sworn in . Ms . Kirk described the application for the use of 4011 South Broadway as an entertainment establishment and the correspond ing regulations regarding the use . The applicant meets the five requirements of a Conditional Use Permit and staff recommends approval. Mr . Fish asked if the parking requirements are being met ; Ms . Kirk replied that they were short one space and staff did not feel that was significant enough to warrant further review . Ms . Townley asked about the registration process for a Conditional Use Permit , Ms. Kirk responded that it is maintained through the annual registration process . If the use changes , the permit is revoked . Chair Kinton asked if the department had received any comment ; Ms. Kirk replied that no public comment had been received . Applicant Presentation George Eck , 1515 Mustang Run , Steamboat Springs , Colorado , representative of the applicant , was sworn in . Mr . Eck reviewed the site p lan of the property and presented photos of the building . He described the operation of the business and the arcade games that will be • • • d . Planning and Zoning Commission June 20 , 2017 available . He reviewed the requirements of the Conditional Use Permit. Mr. Brick asked if the public was notified . The property was posted as required. Mr. Fish asked when the peak hours of operation are anticipated to be ; Mr. Eck replied 8 :00-10:00 p.m. The establishment is for adults 18 and older. Mr. Kinton asked if there are any other businesses open late in the surrounding area . Mr. Kinton asked about the intention of the applicant to stay in the building ; Mr. Eck stated that the applicant has a five year lease. Mr. Kinton asked about the age of the patrons and if they would require proof of age ; Mr. Eck replied that verification will be required. Case USE2017-009 Conditional Use, Amusement Estblishment in the MU-B-2 Zone District Moved by Member John Brick Seconded by Member Mike Freemire To approve case Case USE2017-009 Conditional Use , Amusement Establishment in the MU-B-2 Zone District Brick: This request fits the goals for the general welfare of the City and will aCtivate the section of Broadway where it is located. It meets the conditions of the Conditional Use Permit. • • • Planning and Zoning Commission June 20, 2017 Coleman : Agrees with Mr. Brick, the use is consistent with the Comprehensive Plan goals and would add a business to South Broadway that will add variety to the businesses . Fish : Concurs with other Commissioners that the proposed use meets all the necessary conditions and that this is an appropriate use . Townley: Meets the conditions of Conditional Use and meets the goals for Shop 1. 1 and 1. 2 in the Comprehensive Plan . Kinton : Appropriate use for the area and hopes that it brings people into the area to the benefit of other businesses.
