Public Hearing 2016-05 Ground Floor Commercial Requirements in the MU-B-1 and MU-
B-2 Zone Districts

To open the public hearing for case 2015-05 Ground Floor Commercial Requirements in
the MU-B-1 and MU-B-2 Zone Districts

Staff Testimony
Brook Bell , Planner II , was sworn in . Mr . Bell reviewed the information gathered at the
study sessions and the conclusions of the Commissioners . He named the recent
developments that did not choose to place commercial space on the ground floor of the
buildings. He stated that the Board of Adjustments and Appeals has heard five variance
cases requesting that the requirement be waived and approved all five requests for
variance from the code . Ms. Townley asked if any of the cases were for buildings in the
3300 , 3400 or 3500 blocks of South Broadway ; Mr . Bell responded that they were not.

To recommend the amendment to the Unified Development Code case 2016-05 Ground
Floor Commercial Requirement in the MU-B-1 and MU-B-2 zone districts and forward to
City Council with a favorable recommendation.:
Residential Use in Properties fronting the 3300, 3400, and 3500 Blocks of South
Broadway
a. Dwelling units may be incorporated into the same building as the commercial use
(not as a stand-alone use)
b. The commercial use occupies the majority of the ground floor of the building,
and is directly accessible from an adjacent public street or sidewalk.
Mr . Madrid moved for a friendly amendment to include the 3100 and 3200 blocks of South
Broadway to the original motion to approve the amendment and forward to City Council. Mr .
Fish accepted the amendment.
Vote: To amend the recommendation to include the 3100 and 3200 blocks of South
Broadway

5. Study Session 2014-01 Accessory Dwelling Units
Mr. Voboril reviewed information from previous study sessions . Discussion of the purpose of
allowing accessory dwelling units , appropriate zone districts and City Council's preferences fo r
allowed zone districts and occupancy requirements ensued. The remaining topics for
discussion are maximum size , owner occupancy enforcement and site placement.
