Th e regular meeting of the City Plannin g and Zonin g Commission was ca ll ed to order at
7:00 p.m. in the Community Development Conference Room of the En g lewood Civic

The Commission took a short recess to en joy refreshments and a short prese ntation 1n
honor of Carl Welker's m a ny years of se rv ice to th e city.
111. Zoning Text Amendme nt: Site Plan Review Pro cess

• Ch ri s Neubecker, Senior Planner, reviewed the current process for site plan review . Site
plan rev iew involves more than just zon in g; major c hanges to landscaping, setbacks , and
additions shou ld a l so be reviewed to ens ure th ey are within code requirements.
The current code fai l s to require site plan review on severa l situations, and does not
p ro vide a means for someone to rece ive preliminary approva l of a site plan prior to the
bu il ding perm it review. Th ere is c urrently not a process id entified in the code to gu id e
someone through the process and g ive them some ass urance that their plans are within
code . It wou ld be he lpful to the staff and property owners/deve lopers to make changes
that wou ld o utlin e the process.

o By making this cha nge throughout the document, it clar ifies that not
just zoning is reviewed , and indi cates that al l improveme nts to be
made wou ld be reviewed.
• Require Site Im provement Plan review for site work and lands cap in g over $5,000
in va lu e.
o The review of the entire project wou ld he lp to identify site issues
prior to the building permit application. Minor lands cap ing projects
wou ld not req uire a permit.
• • Provide more deta il on the subm ittal requirements for plans and p l an format.
• Describe the Development Review Tea m (ORT) and encourage Applicants to use
this free service.
o By including ORT in the code, Applicants would .be aware of the
serv i ce and more likely to take advantage of it. The ORT is not
cu rr ent ly mentioned in the code.
• Other syntax changes that improve the readability and enforceability of the code.
Mr. Welker -Would this include fence revi ew? Mr. Neubecker exp l ained that the code
includ es exemptions for "like for like" fence replac e ment of 25 feet or less , and fence
repair. Other fences sti ll require permits. Mr. Welker emphasized the need for
co nsist e ncy between zo nin g and building codes.

Mr. Roth asked if there is a definition of res idential dr iveways . The differenti ation
between residential , multi-family a nd commercial should be defined. Mr. W e lk er
suggested that one way to define the diffe rence wou ld be to set parameters pertaining to
size of the driveway. Because dollar va lu es can change, usin g a dimensional req uirement
wou ld be easier to manage. Mr. Roth suggested the poss ibility of apply in g the restriction
to specific zones (s u ch as R1 and R2). Mr. N e ub ecker said he would look into that

Mr. Knoth question ed th e need for a landscaping plan for res id e nti a l propert i es. Direc tor
White co mmented th at th e req uire m e nt needs to be defined for residential vs . commerc ial
development (which would includ e a land sca pin g plan). Mr. N e ubecke r st ated that the
plans do not hav e to be te c hnical or profess ion a l drawings, but e nou g h detail th at the staff
ca n determine th e feasibility of th e site improve m e nt plan.
Mr. Fish -"Co nsist e n cy with the Comprehe nsive Plan" is a subj ective determination of
whethe r o r not th e plan is acceptable. Directo r White elabo rated on the idea of
co nsi ste ncy vs. co mplian ce; co mplian ce impli es sta ti o na ry sta ndards that are measurable.
Meet in g the goa ls of th e Comprehensive Plan wo uld be flexible based o n the project.
Consistency would be determined by staff durin g rev iew process.

Mr. Welker stated that th e co d e should be written as simply as possible so th e app li ca nt
ca n make determinations prior to rev iew b y staff. Th e Commission should minimize th e
regulation other than th e static code su c h as setbacks, bulk pl a ne etc. The Comp rehensiv e
Plan is vague, and co mpli a nce is m easu rab le w hereas "c onsiste ncy" is not.

Director White stated that whi le some c iti es require site pl an approval prior to a bu il d in g
permit, in En g lewood it is vo luntary . Staff review of site plans provides a leve l of p lan
approva l that m ay assist with financing for th e Applicant.
It was agreed th at th e ne xt step would be a public hea rin g to make the cha nges to the
code. Mr. N e ub ec ke r stated that Staff will co ntinu e to refin e the suggested changes .

Directo r White proposed that the e lec tion of officers tak e place at the February 19th
m ee ting after th e bu sin ess portion of th e meeting 1s over. Mr. Neubecker offe red
ass ist ance to th e new Chairperson in the fo rm of meetin gs w ith staff and supplyin g
information regardin g how to co ndu c t th e m ee tin gs .

tr ansit station areas along th e Light Ra il Corridor and on Fe bruary 19 th we w ill hold Publi c

Director White presented framed aerial photographs of the original Cinderella C ity
deve lop m e nt and the c urre nt City Cente r area as a g ift to Carl Welker to thank him fo r his
se rv i ce to th e c ity.

The Commissioners shared their thoughts on Mr. Welker's service to the Commission .
King -Carl has been inspiration and asset to the team and will be missed.
Knoth -Thanked Carl for being a voice for those who didn 't h ave the knowledge when
they joined th e Commission.
Fish -Spoke of working on the Board of Adjustments with Carl and expressed that h e
appreciated his work over the years as well as his friendship.

Bleile -Express ed appreciation for both their professional and personal relationship.
Roth -Carl's lead e rship will be g reat ly miss ed as he has had an impact on creating th e
code. H e thanked Carl for his serv i ce.

Brick -Carl was his mentor when he first join ed the Commission and he appreciated the
guidance and direction. Carl will be miss ed .

Welker -The Planning and Zoning Commission was a good fit for him and allowed him
to bring insight from his professional career to assist the group in evaluating subjects as
though they were in use. He feels that Englewood's Zonin g Code is general l y above
others in that it is easier to work with in comparison with other cities. He encouraged th e
Commissioners to con tinu e improving the code by taking an objective look at th e rules
and keeping in mind how it wi ll be used. He thanked th e Commissioners for their kind
words .
The meeting adjourned at 8:00 p.m. Th e next meeting is Feb ru a ry 4 , 2014.
