M. Members Present: Braun, Hill, Jones, Kelley, Lacy, Ex-officio Members Absent: Romans, Schmitt Dr. Robert Byall 3920 S.Clarkson Rezoning Corner Property South of Inter- section of South Sherman Street and East Jefferson Drive From R-2-B to C-1 Hearing No. 12-59-C April 9, 1959 April 23, 1959 May 7, 1959 The hearing · was opened with the presentation of a land use survey and showing of photographic slides of the area by the Planning Director. Mr. Jones stated that citizens present and interested in the proposed rezoning would be heard at this time. Dr. Byall, the applicant, stated that the va.lue of his property has dropped $5,000.00 be- cause of the fact that the subject area is zoned residential and not commercial. He felt he should not have to wait until some future date for rezoning as he had secured signatures of most surrounding residents in favor of the rezoning, and he believes there is a shortage of first class office space in Englewood. Mr. W. C. Ross , 3687 South Grant, stated that in his opinion there is enough lmd already s o zoned. With such piecemeal zoning he felt the citizens would become victims of "creeping zonitis." Mrs. J. R. McManus, 3£54 South Sherman, said that the area residential and she would like to have it remain the same. two blocks from Broadway to Sherman should be commercially this block. Kelley moved: Braun seconded: That the hearing be closed. Mr. Kelley commented upon examining the land use study and the official zone map, that the projection of the commercial area as requested is not in fact a projection into a surrounding current commercial usage. The land use survey shows that the subject area is bounded by two-family usage on the south and east with the only commercial usage south of Broadway being the TUcker Building. Mr. Braun sugg ested that the two other Planning Commission members should be available to give fullest consideration to this matter before a decision is reached. Kelley moved: Hill seconded: That the decision on this matter be delayed until other members of the Commission can be available. Ayes: Braun, Hill, Jones, Kelley Nays: None Absent: Romans , Schmitt Mr. J. P. Smith for Temple Rest Home 3400 S. Lafayette Rezoning North Half of 3400 Block South Lafayette Street From R-1-D to R-3-A or B He aring No. 22-59 Chairman Jones announced that consideration of a request for rezoning the Temple Rest Home area was not in order. Mr. Banta, representing Mr. Smith (the applicant) requested a continuance in order that more information could be gathered to support the rezoning request. Chairman Jones asked persons in the room who were present to oppose the rezoning for their reactions to the requested continuance. Several persons spoke indicating that they wished the hearing to be held immediately as posted and advertised. Mr. Banta withdr ew his request for continuance and Chairman Jones announced that the hearing was open. The Planning Director presented a land use survey and photographic slides of the area. Richard Banta, 3 470 South Sherman, attorney for J. P. Smith, explained that the reason for the rezonin g is to make the zoning of the property conform to the use. The proposed alterations and additions to the premises are needed to meet expanding needs for nursing homes. The request for rezoning is proper at this time for an institution of this type must compl¥ with State statutes as to structure of the b uilding and maintenance of patients in the institution. Mr. J. P. Smith presented plans and explained the proposed alterations and additions to the Temple Rest Home. He stated that the area is ideal for a rest home because of the level ground and quiet neighborhood. Bill Bury, 3440 South Marion, presented petitions with signatures of 60 or 70 persons in the neighborhood opposed to the rezoning. Temple Rest Home is rated one of the best for the State and it will be better for the area if it remains as it is now. He stated that people b ought property and moved into the neighborhood with the understanding that it would remain as presently zoned. Mrs. Roy Forbes, 3383 South Lafayette, felt that if facilities are expanded, there will be many more aged people and their nurses and visitors will create parking problems on the surrounding blocks. Mr. O'Brien, 3411 South Marion, felt that discussion might bring better understanding on both sides of the issue. He did not feel the home could handle parking which would be necessary for such a large unit. Mr. Burnie Smith, 3303 South Marion, stated that the alley · should be kept in good condition and used as a feeder to the parking area of the nursing home. Mrs. Bill Bury, 3440 s. Marion, stated there is already a pa.rking pr©blem caused b y Bullock Mortuary and with, a larg e r nursing home the problem would be increased. Also, there have been mental patients wandering from the nursing home into neighboring homes and with the larger number of patients this would b.e likely to happen again. Roy Forbes, 3383 S. Lafayette, stated that the Temple buildings are well-kept .and at present look like a home. If larger hospital type structure is built, it will downgrade the neighborhood. Mrs. Morgans tern, 3445 S. Marion, was oppo·sed to the rezoning. Braun moved: Kelley seconded: That the hearing be closed. Ayes: Braun, Hill , Jones, Kelley Nays: None Absent: Romans, Schmitt Mr. Kelley suggested that the commission delay furth~r consideration of this matter until other commission me mbers were present and more study of the ·specific request in relation to the need for nursi n g homes throughout the City could be made. Commission members then asked Mr. Smith some que s tions and learned that if the request is granted, his development plan calls for demolishing the frame structures now on the site and a two-stage development. Present number of patients at the home is 26. The first stage would increase this number to 46 and the second stage would increase the capacity to the ultimate total of 62. Mr. Smith said that the open area for exercising patients would not be decreased even in the overall development. Page 392 Braun moved: Hill seconded: That inasmuch as this request constitutes spot zoning and is against the policy of the Planning Commission and Council for required land use, and in light of substantial neighborhood opposition, this request be denied. Ayes: Braun, Hill Nays: Kelley, Jones Absent: Romans, Schmitt Chairman Jones rulea that the motion did not pass. Kelley moved: Jones seconded: That the matter be tabled until other members of the Planning Commission could be present to consider the change in zoning. Ayes: Braun, Hill, Kelley, Jones Nays: None Absent: Romans, Schmitt; Charles F. Johnson 3149 South Broadway Annexation Tentative Zoning Study for Area South of Belleview and West of South Broadway. Hearing No. ll-59B March 19, 1959 May 7, 1959 The Planning Commission again considered the land use survey of the subject area in relation to the zoning north of Belleview (C-2, P, and R-3-A) and in light of the use east of Broadway made by the Brookridge Shopping Center. The Planning Director explained that a C-l usage would allow Mr. Johnson to proceed with possible development of the present vacant tract for an eight-story office building with a restaurant (not drive-in type) on the ground floor. He explained that this zoning would actually move the C-1 zone considerably farther west than originally shown in a 1955 plan by Harmon, O'Donnell & Hennesy Consulting firm. However, the existence of Lehow Road which does connect Broadway with Littleton Broadway might well justify the adqitional C-1 zoning, particularly if a substantial commercial development as indicated by Mr. Johnson were built. Mr. Hill indicated that he was not in favor of any C-2 in the area at this time. Braun moved: Kelley seconded: That the Planning and Zoning Commission recommend to the City Council that if a petition for annexation of the subject area is presented, a C-1 zoning of the area be also favorably considered to run concurrently with the annexation proceedings. Ayes: Braun, Hill, Jones, Kelley Nays: None Absent: Romans, Schmitt Mr. O. L. McBee for Mrs. Christiansen 3100 S. Lafayette Re-Subdivision East Side of 3100 Block South Lafayette Street Hearing No. 23-59 Mr. McBee, Mr. Garrett, and Mr. C. Co tin, Consulting Engineer, appeared to discuss a re- subdivision of the subject area. The Planning Director provided copies of the tentative plan for Planning Commission members and stated that it had been prepared after Mr. McBee had consulted with the Planning Office and the owner, Mrs. Christiansen. The purpose in the re-subdivision is to provide for practical development of the southern 3 /4 of the area which is now yacant and subdivided into 60-foot frontage lots. A natural drain course crosses the property which is zoned for 75-foot frontage building sites. The preliminary design was prepared in order to dedicate a 16-foot drainage easement across the subject area and still leave six practical building sites, three of which a r e under the required minimums with the other three substantially over the zoned minimum frontage. In the discussion that followed, it was agreed that this is the most feasible plan for developing the area. Planning Commission suggested that the tract of land on which Mrs. Christiansen's own home now sets also be included in the re-subdivision for simplification of lot lines throughout the entire half block. It was agreed that two lots should be made from the existing three lots at the north end of the block. Braun moved: Kelley seconded: That the preliminary design be approved subject to the inclusion of existing lots 1, 2, & 3 into the re-subdivision as new lots 1 and 2; and that the drain course be dedicated outright rather than an ease- ment for drainage. Subdivision Southwest Corner of East Jefferson Drive and South Clarkson Street Page 393 Hearing No. 15-59B May 7, 1959 May 21, 1959 Mr. Zeitlin was present to discuss the final plan for the Sandra Subdivision of the subject area. The Planning Director presented the tracing and indicated that although the existing roadway was shown on the final plan, it was not indicated that it is dedicated as Mr. Zeitlin said he would be willing to do. Mr. Costin presented a drawing from the City Engineer's Office indicating the true property line of the area and showing that an error in the original survey had shown approximately 20 feet of Mr. Zeitlin's property to be part of the indicated right-of-way for East Jefferson Drive. Mr. Jones questioned the actual usable width of East Jefferson Drive as limited on the north by the Little Dry Creek channel. ~he City Engineer's map showed this distance to be approximately 34 feet at South Clarkson Street. Mr. Zeitlin indicated he was willing to dedicate the necessary additional width from the south side of East Jefferson Drive (approximately 3 to 5 feet along the entire northern boundary of his subdivision with a curved portion at the Clarkson intersection measuring 21 feet alcng South Clarkson. This movement would make a dedicated right-of-way entrance into East Jefferson Drive of approximately 50 feet. The Planning Director stated that this widening of radius would be most desirable because of the indicated future use of South Clarkson Street and East Jefferson Drive as a major commercial artery connecting southeast Arapahoe Co u nty and downtown Englewood. The Planning Director stated for information only that the School Board had granted Mr. Zeitlin additional time beyond the June 1 deadline to secure an appraisal of his property before further negotiation on the purchase of a portion of the Zeitlin property is con- sidered by the School Board. Hill moved: Braun seconded: That the Planning and Zoning Commission recommend to City Council that the final plan of the Sandra Subdivision be approved subject to the dedication _of the additional right-of-way along the south side of East Jefferson· Drive to be approved by the Planning Director. Huron Subdivision Southwest Corner of West Chenango and South Huron Street into Three Lots Hearing No. 18-59A May 7, 1959 The Planning Director presented a final plan for subdivision of the subject area into three lots. He stated that the easements which had been in doubt previously had been resolved and were clearly shown on the plan and approved by the City Engineer's Office. Kelley moved: Hill seconded: That the Planning and Zoning Commission recommend to City Council that the f inal plan be approved. Ayes: Braun, Hi l l, Jones, Kelley Nays: None Absent: Romans, Schmitt Rezoning Charles F. Johnson 3149 South Broadway Northwest Gorner of South Galapago and West Eastman Avenue Mr. Johnson was present to request Planning Commission's opinion on the possible best use of a dwelling in the subject area which was being disposed of , by court action. The land is now zoned for light industrial use and is just s9uth of a natural drain course which creates problems for property to the north of the subject area owned by George A. and Emily Linkenheil. Mr. Johnson stated that it is not possible to arrange financing for the area because of its present non-conforming status even though it has been appraised at $11,000.00. The Planning Commission indicated that the area should remain zoned for light industrial use because any change would necessitate the moving of the zone line one full block to the west in order to keep the zoning break between residential and industrial use on the alley line. Such move would also permit subdivision of a portion of the area now zoned light industrial where the drainage problem now exists. The Planning Director explainedthat the drainage problem is one that could be solved by the installation of an 18-inch underground condujt across private property, and that this move is practical for an industrial buyer who would acquire the land in Jive separate ownerships in the area for development into a light industrial usage. It was agreed that no further ~ction or consideration of the matter could be taken by Planning Commission unless a · definite proposal was made. Page 394 Planning Office City Master Plan No. 1 Drainage Parkway Hearing No. 20-59A May 21, 1959 The Planning Director reported that City Council wishes to give other local consulting engineer firms an opportunity to make a proposal for the City storm drainage plan. He stated that Mr. Tom Robinson of Black and Veatch had spent six hours with City Planning and Engineering officials on Monday, June 1, and was preparing a · proposal to be submitted to the Planning Office prior to June 15th. Mr. Jones reminded the Planning Commission that one of the primary r e asons for mpving ahead with Black and Veatch was because of the Firm's excellent national reputation which makes them quite acceptable to the Federal Government as an organization with excellent background and experience to perform consulting work under Federal auspices. The Planning Director stated that this reason along with excellent recommendations from area engineering officials and the interest of time had been the primary reasons for moving so quickly toward a proposal by Black and Veatch with no other firms consulted initially. Mr. Braun stated that he agreed with Councilman Kreiling that since Black and Veatch did not even maintain a Denver office, they should not be given heavy consideration for a substantial engineering job as contemplated by the City. In the discussion which followed, it was agreed that certain engineering firms which had performed satisfactory work for the State Highway Department and other major agencies should be given an opportunity to make proposals on the drainage project ; and that Dale Rea who did the metropolitan drainage project for ICRPC and Ripple and Howe who drew the preliminary storm sewer system for the City of Englewood should likewise qe given an opportunity to consider the City's project in light of their experience with the local situation. The three firms recommended by Mr. Kreiling are Williams and Woodward , Phillips-Carter- Osborn, Inc., and Arrowhead Engineers. Kelley moved: Jones seconded: That the Planning and Zoning Commission recommend to City Council that the Planning Director contact five local engineering concerns and pro- vide them with all information necessary to prepare a proposal on the City's drainage plan, with such proposals to be made in person before the City Council along with the Black and Veatch proposal. Ayes: Braun, Hill, Kelley, Jones Nays: None Absent: Romans, Schmitt Planning Off ice City The Planning Director presented onto South Broadway. The first usage of the office building of of Highway #70. Master Plan No. 5 Master Street Plan Hearing No. 24-59 two drawings for developing highway ramps from Highway #70 plan showed a system necessary to maintain and continue Mr. Larry Colvert which is east of South Broadway and North The second plan showed the more d esirable means of development of the ramps indicating a connection by which sign a ls on South Broadway at th& ramp entrances would not be necessary. It was agreed that copies should be provided for each member of the Planning Commission and that the matter should be considered further at the next planning session after theCity Engineer has a n opportunity to study the plan along with the Planning Commission members and Chamber of Commerce officials. Planning Office City Capital Improvements Projects Hearing No. 14-59B Apri 1 23, 1959 May 21, 1959 The Planning Director suggested that a newspaper article be released requesting all Englewood citizens to submit capital improvement suggestions in writing prior to July 1st to be con- sidered for priority number along with Department head suggestions and Planning Commission projects. The Planning Director was instructed to proceed with this movement in order to publicize work on the master plan as well as compile a comprehensive list of all projects desired by Englewood citizens. Since the Planning Director, Mr. Hill and Mr. Braun will be out of the City on June 18th and since Mr. Jones and Mr. Braun will be out of the City on June 25th, it was agreed that the next planning session (for planning matters only) should be held on July 2, 1959. There being no further business to come before the Planning and Zoning Commission, the meeting was adjourn ed at 11:50 P.M. Jewell M.
