The Planning Commission interviewed eight consulting engineer firms to determine which three
should be asked to submit proposals for drawing plans for a drainage parkway system. Eight
firms suggested by the City Engineer's Office , members of the City Council and the Planning
Office were asked to present the background of their organizations, and not to discuss the
City's storm drain plan as such. Each firm was allowed fifteen minutes to make its presentation.

*Asked to be considered; Planning Commission agreed to hear them although scheduled only
at the last minute.
After considerable discussion and consideration of the presentations, the Planning Commissi:Jn
selected the f oll owing firms to present detailed proposals for drawing the drainage plans.
1. Harold Hoskins & Associates
2. Henningson, Durham & Richardson
3. Phillips, Carter & Osborn.
The selection was based on:
1. Experience with similar projects in the Rocky Mountain region.
2. Diversity, qualification and size of staff.
3. Experience in securing Federal aid under Public Law 560.
4. Availability o f personnel to begin work.
5. Format of similar finished project plans.
The Planning Director was asked to consult with State consultant authorities and the City
Engineer's Office to prepare a basis for the proposals requested and contact the firms to
secure the proposals as soon as possible.

Mr. Smith was present to hear the Planning Commission discuss the above request for rezoning.
Mr. Braun stated that he felt the request should be denied because it would constitute a spot
zone and because petitions of persons in the neighborhood indicated a substantial protest
against the movement.
Mr. Smith stated that the Temple Rest Home was in fact a hospital according to the State's
interpretation of their operation. Members of the Planning Commission stated that as far as
the Zoning Ordinance is concerned, it is clearly a nursing home. It was agreed that if thE
question of interpretation were important to pursue further it would require a legal opinion.
Mr. Kelley stated that the City should not take a stand which would deprive the owner who
has held the property f or thirty-seven years the use of his property or his vested rights
in not granting a request which would allow his present use to be expanded. After brief
discussion it was pointed out that the present usage would not be affected in any way by
the denial of the request.
The Planning Director stated that the rezoning which would allow the expansion of the Temple
Rest Home would change the characteristics of the traffic in the neighborhood since more
people would be visiting the increased number of patients and more service traffic would be
generated. He reminded the Planning Commission of the protesting citizens' complaint that
patients had entered their homes from time to time and although no harm was done, the people

were very much concerned about this sort of thing increasing if the home were enlarged.
Since petitions have been submitted opposing this matter, it would require a favorable
vote of at le a st eight councilmen to grant the rezoning.
Mr. Jones pointe d out that the matter of housing for sen±or citizens is becoming a serious
problem in Englewood as in other communities. He suggested that more thought must be given
to the situation and possibly a change in the zoning Ordinance which would allow expansion
of nursing homes in certain residential zones.
Braun moved:
Hill seconded: That inasmuch as this request constitutes spot zoning and is against
the policy of the Planning Commission and Council for required land
area, and in light of substantial neighborhood opposition, this
request be denied.

The Planning Director stated that the matter of housing senior citizens is certainly be-
coming more of a problem as indicated by the increase in inquiries in the Planning Office
concerning such housing. He suggested that the high rate of elder citizens in Englewood
warrants specific study of the problem leading to an indicated solution in the appropriate
section of the Master Plan.
Mr. Smith stated that he appreciated 'the Planning Commission's constructive outlook toward
the problem and volunteered any assistance he might be able to give. Mr. Jones assured him
that he would be consulted and that the regional organization of nursing home · operators
would also be asked to contribute to the solution.

Sales Tax Study

The Planning Director introduced a twenty-five page study titled "A Sales Tax and An
Englewood Revenue Source" which had been transmitted previously. He mentioned that the
material in the study had been gathered in order that Council might consider the impact of
a sales tax to help finance a capital improvements program. The study will be received
by the City Council on July 6th and will provide facts for consideration by Council of a
Capital improvements program on July 20th.
Since members of the Planning Commission had only received the study twenty-four hours
prior to the meeting, it was agreed that no overall discussion could be held and that
the report should be simply received and studied at this time.

The Planning Director stated that department heads have until July 15th to complete their
list of suggested capital improvements. The Public Works Department and the Fire Department
have already completed their project sheets. The only other lists of capital improvements
are from the City Manager in the 1959 Budget · and from the Planning Commission.
He suggested that since these projects have not yet been compared with one another it
would be premature to assign priority numbers until some preliminary analysis can be given
the suggested projects. It was agreed that because of the heavy load at this meeting and
the needed analysis of the suggested projects that furiler consideration be deferred until
July 9th.

Mr. Braun stated that he was very much in favor of granting rezoning of the corner
property for reasons previously stated at the hearing on June 4. He stated that he felt
the need for additional office space in this area, the matter of heavy traffic on the
highway, the availability of off-street parking across Sherman, the future use of Sherman
Street and East Jefferson Drive and the need for a buffer building between the heavily
travelled streets and the existing residential area were all reasons why he favored granting
the rezoning of Dr. Byall's property. He again. stated that he did not intend to vote on
the matter since he has a personal business interest in the outcome.
Planning Commission members questioned whether or not only the Byall property could be
rezoned since the hearing also included the property immediately to the south of the owner's
property. The Planning Director explained that under provisions of the Zoning Ordinance
the Planning Commission hearing was actually an unofficial hearing and was for the purpose
of determining the wishes of the citizens in the area as well as bringing out all implications
of any requested rezoning. He pointed out that Planning Commission's recommendation to
Council does have a legal implication and cannot be changed by Council unless it is referred
back to the Planning Commission.

Mr. Jones stated that he felt that the corner might eventually justify a commercial use but
he questioned the timing in granting such a commercial use at present since all of the ground
in the area is developed with buildings which will serve sound residential purposes for
many years to come. He stated that the appreciation in value for the corner property might
be over-ridaen by the depreciation in desirability for residential use of the existing
structures which are now used primarily as zoned, i.e., for R-2 usage.
It was agreed that if the corner property is to be rezoned that it should include only the
property owned by Dr. Byall which is scheduled for redevelopment and not include the property
immediately to the south since no commercial use such as off-street parking can be made of
that property as long as the masonry two-family residence now existing still remains.
The Planning Director pointed out that granting of .Dr. Byall's request would constitute a
definite deviation from area requirements in the rezoning policy as suggested by Planning
Commission and sanctioned by City Council. He suggested thatif a deviation is to be made,
the reasons therefor be clearly stated.
Schmitt moved:

similar commercial use to provide a buffer use between the anticipated
heavy traffic at the intersection of Highway #70, Sherman Street and
East Jefferson Drive, and to provide additional modern office space.
Said area is triangular in shape, surrounded on two sides by commercial
usage and on the third side by developed two-family residential use,
and petitions signed by thirty-four property owners in the area indicated
general agreement with the change.

Mr. Sparks was present to discuss the preliminary design for subdivision of the subject area
into three sites. The Planning Director presented the preliminary design which had been
studied and approved by the Public Works Department and the Utilities Department.
