Members Present: Jones, Kelley, Romans, Schmitt Members Absent: Braun, Hill - -- - - - - - ------- -- -- -- - - - - Page 349 Chairman Jones stated that the first order of business was the reorganization of the Planning and Zoning Commission. Romans moved: Kelley seconded: That Mr. Lee Jones be re-elected as Chairman of the Commission by unanimous ballot. Ayes: Jones, Kelley, Romans, Schmitt Nays: None Absent: Braun, Hill Jones moved: Schmitt seconded: That Robert Kelley be elected Vice-Chairman of the Commission by unanimous ballot. Ayes: Jones, Kelley, Romans, Schmitt Nays: None Absent: Braun, Hill Kelley moved: Schmitt seconded: That Mrs. Romans be re-elected Secretary of the Commission by unanimous ballot. Ayes: Jones, Kelley, Romans, Schmitt Nays: None Absent: Braun, Hill E. R. Davolt Subdivision 2812 So. Zenobia, Denver South One-half 4400 Block South Huron and South Galapago Hearing No. 39-58A November 6, 1958 Mr. C. R. Costin, Engineer, appeared representing Mr. E. R. Davolt and presented the final plat of the Davolt subdivision. The commission members examined the plat closely to deter- mine that all the necessary features were in compliance with the subdivision regulations. After some discussion relative to the drain course which exists within the area, Kelley moved: Romans seconded: That the Planning and Zoning Commission recommend to City Council that the plat of the Davolt subdivision be approved and that curb, gutter, and side walks be required for frontage along Huron Street. Paving improvements, as required by uniform subdivision regulations are recommended to be waived, unless the 4400 block of South Huron Street is included in the 1959 paving district. Ayes: Jones, Kelley, Romans, Schmitt Nays: None Absent: Braun, Hill Braun entered and was seated with the commission. Robert L. Gillpatrick 3890 South Galapago Subdivision Approximately One-half Block on West Side of 3900 Block S. Galapago. Hearing No. 42-58A (Also see minutes March 19, 1955 and March 31, 1955) Mr. Gilpatrick along with Mr. C. R. Costin, Engineer, appeared to present the preliminary plan for the proposed Gilpatrick subdivision situated in the subject area. The commission members examined the plan closely and in the discussion it was brought out that apparently no easement exists for the existing city sewer trunk line which extends through most of the proposed subdivision. The commission chairman explained to Mr. Gilpatrick the mutual need, both by city and developer, for such an easement. It was also brought out that an easement would be necessary for sewer service to lot one. Considerable discussion was held regarding the problem of construction of a dwelling on lot four which will require any house to be partially constructed over the existing city sewer trunk line. In further discussion it was definitely the feeling of the commission that the final plat could not be recommended for approval until some type of agreement between the developer and the city has been executed, for the protection of both, which will assure the proper encasement of existing trunk line in lot four beiore any structure is permitted to be situated thereon. Kelley moved: Braun seconded: That the plan of the Gilpatrick subdivision be tentatively approved sub- ject to showing of a 16 ft. utility easement properly situated to encompass the existing city sewer trunk line throughout the subdivision and that the utility easement for service to lot one be increased from 5 feet to 10 feet along the west side of the east line of lot one and along the south side of the north line of lot two, the portion in lot two to extend from the east line of lot one to the right-of-way of the city ditch. Ayes: Braun, Jones, Kelley, Romans, Schmitt Nays: None Absent: Hill Page 350 James Jordan 2750 So. Washington Subdivision Two Building Sites Near the South End of West Side of 2700 Block on South Clarkson Street. Hearing No. 1-59 Mr. James Jordan appeared and presented a preliminary drawing for a proposed subdivision o f land in the subject area in two building sites. A problem is involved due to an existing drain course area located between the south line of the proposed subdivision and East Amherst Avenue. The present city policy will not permit any structure to be bu ilt in a known drain course and Mr. Jordan has felt that some restitution should be made to compensate f or the investment involved in the drain course land upon which he cannot build. Mr. Jordan indicated that he had fina lly determined that $850 paid to him would make it possible for h im to proceed. Mr. Flagel of 2830 So. Clarkson Circle was present and representing various neighbors in the area was recognized and stated that they were in favor of this subdivision, if the draina ge problem is properly solved. Mr. Flagel stated further that the residents in the a rea have pledged $685.00 toward purchas e ·of drain course land and that if said monies were used it would be understood that the City would ta~e title to said land and develop same into a park area. At this time it was mentioned that Mr. T. W. Anderson has indicated his desire to participate in the project by giving to the City a vacant building site abutting the drain course area in question on the west side which would complete the proposed drainage channel through the block. It was brought out at this time that the jurisdiction of the Planning and Zoning Commission in this matter actually could cover only the recommendations for subdivision platting. Braun moved: Romans seconded: That ·the preliminary drawing for the proposed subdivision of two lots located in the subject area to be tentatively approved according to the plan presented and as corrected with the pencil line and on which shows the south line of the subdivision beginning at a point on the east line o f the subdivision 154 feet south af the north line of the subdivision and extending diagonally northwesterly; and that the common line between the sites to be properly adjusted to procude the necessary square footage therein with proper utility easements being included. Ayes: Braun, Jones, Kelley, Romans , Schmitt Nays: None Absent: Hill Mr. Jordan was advised to proceed with preparations of a preliminary plan and was referred to the planning director for assistance. Marvin Foote, Attorney William Moody, Owner 3385 South Bannock Annexation One Block South of West Belleview Avenue, Between South Elati and South Fox Streets. Hearing No. 28-58A The following memorandum was presented and read relating to proposed annexation of subject area: INTER-DFFICE MEMORANDUM TO: Mr. J. M. Lacy FROM: Mr. R. L. Rudd Date: January 6, 1959 SUBJECT: PROPOSED ANNEXATION OF TERRITORY SOUTH OF WEST BELLEVIEW BETWEEN FOX AND ELATI STREETS The City Council did as expected last night and referred this matter to the Planning Commission for recommendations, to be returned f or the January 19th session. Leo Barron tells me that the City Attorney has satisfied himself as to the eligibility of title. You already have a tracing and a print o f this proposal. It would be well for the Planning Commission to make recommendation that the annexation ordinance desi gnate R-1-B zoning for the area. LRR /ij L. R . RUDD City Manager An annexation map was presented f or consideration by the commission which appeared to be in order. ·The minutes of July 10 were reviewed which indicated that favorable consideration for this annexation would be given by the City Planning and Zoning Commission provided the block were to be considered in its entirety and that the annexati on would be contingent upon R-1-B zoning. After some discussion, Braun moved: Romans seconded: That the Planning and Zoning Commission recommend to City Council that the annexation of the subject area be approved inasmuch as the proponents have met the requirements set f orth in Planning Commission action of July 10, 1958 ; that annexation be contingent upon R-1-B zoning which complies with the applicant's questions. Ayes: Braun, Jones, Romans, Schmitt Nays: None Absent: Hill - ---- - ---- - -- - - - I I I I I I Page 351 Planning and Zoning Commission City Planning Commission Member Kelley mentioned that he had been in conference with Mr. Ragsdale of the Ragsdale Tool and Die Company at 4795 So. Broadway, who is desirous of expanding their machine shop operations on a 50 foot site immediately north of the existing building. Mr. Kelley indicated that there is some question in his mind as to th~ interpretation of the zoning ordinance which does or does not render the existing operation as a nonconforming use in the C-2 Zone. No action was taken as it was determined that the matter would have to be referred to the Zoning Board of Adjustments and Appeals for interpretation and initial action. Planning Office Master Plan Hearing No. 45-58A December 18, 1958 Chairman Jones stated that with the large amount of studying by the commission which will be involved in fhe forthcoming Master Plan Development. He felt that arrangements for an additional meeting each month should be made and asked all members to consider the best possible time for such a meeting so the determination for same can be made at the next meeting of the commission. Mr. Braun stated that he wished to inform the commission that he approved of the re-election of all the commission officials which action was taken prior to his arrival. There being no further business to come bef ore the City Planning and Zoning Commission, the meeting was adjourned at 10:40 P. M.
