CONFORMITY WITH REGULATIONS a. Subdivision Required The division of any tract of land within the City of Englewood into two or more lots, tracts, sites or parcels, any one of which has an area of less than three acres, must be accomplished by the filing and acceptance of a plat as specified within this ordinance. b. Prerequisite to Sale and Deed No person, firm, corporation or other entity shall sell, exchange or offer for sale or purchase any parcel of land which is required to be subdivided under provisions of this ordinance .nor shall any person, firm, corporation or other entity offer for recording any deed conveying such a parcel of land or interest therein, unless he shall have made or caused to have made a plat thereof, which plat shall b e recorded before or at the same time such sale, exchange or purchase is effected and shall be in accordance with all of the requirements of this ordinance. c. Exception A parcel of land within the City of Englewood may be sold, exchanged or offered for sale or purchased, and a building permit may be issued for construction on same without further subdivision of said parcel only if it complie s with ALL of the follo.ving requirements: JOE M. (2) No further dedication of public right-of-way or utility or drainage easements is required. (3) No special agreement such as well-water usage or construction over a utility line or other special agreement is necessary. (4) Leaves any remaining unimproved adjacent land so that it, also, can be parceled into building sites which comply with zone district requirements. (5) No more than four (4) building sites can be situated within the undeveloped area, regardless of ownership, from which the parcel to be used is allocated." * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * CITY PLANNING AND ZONING COMMISSION MEETING MARCH 30, 1959 SPECIAL MEETING HELD AT 4:00 P. M. The meeting was called to order by Chairman Jones at 4:15 P. M. Members Present: Braun, Hill, Jones, Kelley, Romans, Lacy, Ex-officio Members Absent: Schmitt City Manager City Proposed Service Station at Lafayette and Highway 70 The Planning Director explained that Cherry Hills Village has set a hearing on a proposal to zone land at Highway 70, South Lafayette Street and East Hampden Avenue for a service station. Chairman of the Plannin Commission of Cherry Hills stated to the Englewood Planning Director that the Cherry Hills Town Board and Planning Commission are still very much op- posed to a service station at this location but that they could no longer deny the owner a hearing on the matter. In the discussion that followed, it was pointed out that such use at this site is not in the best interests of good planning and zoning, anu further curb cuts and merging of traffic would cause serious traffic hazards-along Highway 70 and that the best ultimate development and use of the land could not be served if a service station were located on this site. The land on which the new clinic is located was zoned C-2 to allow the clinic to be located in such a way that no service station could be located in the area to impede Hi g hway 70 traffic. Braun moved: Hill seconded: That the Planning and Zoning Commission recommend 'to City Council that Englewood notify the Town Board of Cherry Hills Village that Englewood is strongly opposed to a filling station at Lafayette, Hampden and Highway 70, setting forth the reasons for such opposition. Ayes : Braun, Hill, Kelley, Jones, Romans Nays: None Absent: Schmitt I ' I I I I I Planning Office City Master Plan, Section 2 Park Development Page 371 Hearing No. 4-59B January 22, 1959 March 19, 1959 The Planning Director presented research work on the subject section along with a memorandum to the Planning Commission relating the general study data to the specific consideration of possible park land west of South Inca Drive just ncrth of West Belleview Avenue. Commissi0m members considered the study which was requested at the March 19th meeting and re-affirmed the recommendation to the City Council made at that meeting. Such factors as the possibility of future flooding, the separation of future City park usage in adjacent Water Fund land from street accesses, and the fact that a subdivision plan for the area seems imminent were heavily considered. Kelley moved: Romans seconded: That the study be received with favor and that Planning and Zoning Com- mission recommend the plan be presented to the Council March 30. Ayes: Braun, Hill , Kelley, Jones, Romans Nays: None Absent: Schmitt There being no further business to come before the City Planning and Zoning Commission, the mee t ing was adjourned at 5:15 P. M. Banfield Recording Secretary * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * CITY PLANNING AND ZONING COMMISSION MEETING APRIL 9, 1959 The meeting was called to order by Chairman Jones at 8:05 P. M. Members Present: Braun, Hill, Jones, Kelley, Schmitt, Lacy, Ex-officio Members Absent: Romans Dr. Robert Byall 3920 S. Clarkson Rezoning Corner Property South of Intersection of South Sherman Street and East Jefferson Drive. Hearing No. 12-59 Dr. Robert Byall, owner of the subject area, appeared to discuss the requirements for con- structing a small office building on the subject area. His tentative plans call for moving the existing structure off of the property and providing parking on the ground floor under a multi-storied structure. The number of stories and the location of the building on the lot are not yet definitely proposed. In discussion, Planning Commission members informed Dr. Byall that such a development would require C-1 zoning which is not inconsistent with abutting zoning to the north. The matter of complying with half block area policy was also mentioned. Mr. Braun and Dr. Byall both attested to the sharply-increased demand for office space in this area since the start of construction of Dry Creek Shopping Center . Dr. Byall was g iven rezoning application forms and indicated that he would prepare a formal request and submit the $25.00 fee in order that c onsideration might begin. During the discussion the projected traffic flow on East Jefferson Drive was considered. It was definitely the opinion of all present that the street width for paving in 1959 should be forty-four feet rather than thirty-six feet. Walter Boggs 4301 S. Bannock Subdivision West Side of South Half 4600 Block of South Galapago. Hearing No. 8-59A March 5, 1959 The Planning Director presented the final plan for subdivision of the subject area. Mr. Kelley suggested that the word "excepted" as it appears in the dedicated street east of the subject area be removed to preclude any title question in the future. It was also mentioned that an abutting subdivision is the "Huls" Subdivision and not "Hills" as is shown on the plat. Mrs. Henry Huls of 4680 S. Huron and Mrs. Ralph Davenport o f 4690 South Huron appeared to discuss the status of the additional five foot width of the alley along the easternmost edg e of the subject area. It was explained that the entire twe nty-one foot width alley would be pu b lic property and that any vacation immediately after dedication could invite litigation from the present owners of the land now being subdivided. It was agreed that . paving requirements under the subdivision regulations should be waived since the subdividers do not control ownership on both sides of any street , and all streets as such are already dedicated.
