STUDY SESSION [llJ DISTILLERIES, BREWERIES AND WINERIES Director White stated he asked the Planning Advisory Service for information on what other jurisdictions throughout the country do in regards to breweries and distilleries. He was parti c ularly interested in what kind of impacts come from these ty pes of uses. Their report w as included in the meeting packet. The State 's licensing procedures do not regulate these establishments based on production. The only places they regulate are brew pubs and that is for a percentage of sales from food. He said tonight's discussion will be to assign some production limitations to nano brew ery, micro distillery, distillery, micro winery and winery. The current Code will ne ed to b e amended in several places. Comments from the Commission included: > > > > > > > > > > > > > > How do you know if someone goes over their production limit? Might be useful to do an on-site visit to see what a 5,000 gallon establishment looks like . What is the impact on the neighborhood; production limits vs. size of business. Use square feet instead of barrels and ga ll ons for regulation. Requirements need to include that there not be noxious odors. Conditional Uses vs. Permitted Uses. Size will dictate where they go. Need a place to start; the code can be adjusted in the future. Commission needs to come up with some reasonable formula. Regulations need to be friendly to business. Need to find reasonable numbers that allow businesses to survive. What is the thresho ld between small and giant? State should have tax records that show production limits . Assume businesses will be licensed through the State and local sales ta x will be received. Suggested in the Industrial Districts uses are a Permitted Use and the oth e r Districts all be Conditional Uses and don 't put any numbers regarding size in the Code for them. If done this way how will prospective businesses know the guidelines? > Use Specific Standards need to be written so prospective businesses will know what is expected of them when they come forward with their Conditional Use . > Are distancing requirements needed? • • .. Th e Commission asked if th ey thought the y were headed in th e ri ght direction; th ey stated th ey did. Th ey suggested th e Com mis sion look at Portland, D enver and Lyons fo r in fo rm at ion as th ey alr eady have reg ul ations in p lace. V. ATTORNEY'S CHOICE rt] Ms. Reid noted Mr. Roth is the En glewood Citizen of the Year for 20 13 . A ce l ebration to honor his service to the City of Englewood w ill be held on M ay 13th at 7:00 p.m. at the Ma ll ey Center. She in vited all to attend. VI. H e st at ed City Council wou l d like Planning and Zoning to attend their Jun e 17th Stud y Session to discuss th e Comprehens ive Plan. If the Com mission m ee ts with City Council on th e 1 l1h th e Jun e 18th m ee ting wi ll be ca n ce ll ed. Direc tor White w ill repo rt back to th e Commission regard in g the proposed m eet in g once details have been finalized. VII. COMMISSIONER'S CHOICE ~ Mr. Knoth referenced an art icl e in th e paper where a neighborhood group 111 Littleton wanted to halt all multi-fami ly units in the city; they fe lt more retail was needed. Ms. Townley asked Ms. Reid to review the process on ho w to continue a public hearing; Ms . Reid respond ed. Mr. Freem ir e discussed the Open Meeting law. Mr. Kinton asked how long th e Commission has to co nclud e a hearing if it is continu ed. Ms . Reid responded . Cha ir Brick asked Director White about budgeting money for the Comp Plan rewrite. Last night City Council passed an Ordinance banning recreational marijuana retail sales , manufacturing, cultivation and testing facilities. At this point we still have three Medical marijuana centers, citizens still have their rights and privileges if you have a medical marijuana license or if you are a caregiver, and you are allowed to have 1 ounce of marijuana and grow up to six plants. An Ordinance was passed that prohibits people from use of marijuana in a ca r. She said City Council passed an Ordinance for an advisory ballot question for November asking the public if they want a ban on the retail part. The meeting adjourned at 8:45 p.m .
