The Director presented a sketch of an area South of Belleview and East and West of Broadway under consideration by the Chamber of Commerce A\nnexation Committee, and a more detailed plan of a development within the area owned by Mr. Pasternak and Mr. Elenbogen. Richard Greene, Attorney for Messrs. Pasternak and Elenbogen has requested audience with the Commission at the July 6th meeting to further discuss the plan. It was the feeling of the Commission that until a formal request for annexation to the City had been made ~ and a public. hearing on the zoning had been held, they would be unable to consider the proposal. V. The Planning Director presented a preliminary report of the Master P l an or Guide for Growth for the City showing proposed and existing park and rec~eational sites, the proposed street pattern and zoning, and future City boundaries. M. Mr. Kelley presiding. Members present: Martin, Miles, Pershing, Rice, Kelley Romans, Ex-officio Members absent: Hill I. Helen Reeme Case No. 45-60E November 22, 1960 January 5, 1961 January 26, 1961 February 9, 1961 February 16, 1961 Mrs. Romans presented the Commission members with a small land use map of the area under consideration for the T (Transitional) zone. The area is bounded on the north by West Layton, on the east by South Bannock, on the south by West Chenango, and on the west by Bannock-Cherokee alley. A history of the area was given briefly. A previous application for rezoning of the area from R-1-B to R-3-A wa s denied by the Commission. It was appealed to the City Council by Mrs. Reeme, and referred by the City Council back to the Planning Commission for consideration of the T zone classification rather than the R-3-A. Mr. Kelley declared the hearing officially open. Mrs. Romans reviewed the T zone for the benefit of the audience, stating it was a buffer zone between two incompatible zones; would permit any use in an R-1 or R-2 zone; professional office buildings, nursing homes and fraternal organizations. It was pointed out that screening was required of other than residential or park use, and would not allow buildings over one story in height. Mr. Richard Simon, counsel for Mrs. Reeme, stated that Mrs. Reeme had operated a rest home at 515 West Tufts for nine years. He further reviewed the former petition for R-3-A zoning, stating that at a public hearing before the City Council on March 6, 1961, twelve photos of the area under consideration were presented to the Council. The matter was tabled by the City Council until the Planning Commission could fully develop the T zone which they were working on at that time. Mr. Simon stated a new petition had been filed with the Planning Commissiou. He further stated that only three residents in the area had refused to sign the petition. A drawing of the proposed development was presented to the Commission. There were no opponents to the rezoning request present, and Mr. Kelley declared the heari n g closed. Rice moved: Martin seconded: That the rezoning of the area bounded on the north by West Layton, on the east by South Bannock, on the south by West Chenango and on the west by the Bannock-Cherokee alley from R-1-B to T (Transitional) be recommended to Council. The motion carried unanimously. II. Temple Rest Home Case No. 16-59 It was stated that the area bounded by East Girard on the north, South Lafayette on the east, the north line of the. C-2 zoning on East Hampden on the south, and by South Marion on the west was under consideration for rezoning from R-1-D to T zone ~ 1( Page 572 A brief history of the area was given by Mrs. Romans. It was pointed out that in the re~ zoning application of 1959, only the area owned by Temple Rest Home was under consideration; with the present rezoning application, all of the block except the C-2 area on East Hampden is being considered. The first rezoning application had requested the change from R-1-D to R-3-A or R-3-B. It was felt this would be spot zoning and was denied. The .present applica- tion was for T (Transitional). A letter was passed to the Commission members from Fire Chief R. George Woods, giving specifications to be met by the Temple Rest Home before it would be up to standards. The hearing was declared open. Mr. Smith, of Temple Rest Home, said the state requirements for Rest Homes were in conflict with the city zoning laws. He stated that he felt the Temple Rest Home was compatible to the surrounding areas, and that it is . their intention to bring their equipment up to standards. He stated they would provide screening for the property, and already had a 50 car parking space. Mrs. Frey, 3475 South Marion, stated she was a newcomer to the area. She asked how far the area was being considered extended. She further stated she would register a protest as she believed the transitional zone would lead to further commercial development. Mrs. Romans outlined the area on the map .and stated that the T zone was being instigated to act as a buffer between the commercial use on East Hampden, and the residential area to the north. Mr. Martin asked if there had been any opposition to the rezoning, and how Mr. Bullock of the Bullock Mortuary, felt about it. Mr. Smith stated there had been no opposition at all. Mrs. Frey stated the T zone sounded temporary to her. Mr. Miles replied that the T zone was a permanent zone. The hearing was declared closed. Martin moved: Miles seconded: That the Planning Commission recommend to Council that the subject area be rezoned from R-1-D to T (Transitional). The motion carrded unanimously. I I I. ,; Olson Rezoning Case No. 12-61 A land use map of the area was presented to the Commission, and it was stated that the area was a part of the Franzman-Folkert Subdivision. The rezoning request was for lots two through ten. Mrs. Romans stated the area had been properly posted and notice given in the newspaper. The hearing was declared open. Roger LeFant stated he represented the buyers and sellers of the property. He felt the highest and best use of, this . property would be in T zoning. He stated the land had been vacant a long time, a nd that he believed brick doubles proposed to be built on the site would be very compatible. He said the comments received from prospective buyers of the land had been mostly unfavorable due to the industrial area behind to the West. The original zoning request had been for R-2-B, but it was no t felt that it was the proper zone for that area. He further sia ted that the T-zone would be more in conformity with a recently made zoning study. Mr. Gordon DeCamp stated his firm had had the property for sale for over a year. He stated they had also sold the land situated to the west of the area, and he felt the buyers of the land must develop it at the price they paid for it. He stated he felt others in the area would seek similar zoning as the land could not be sold as R-1. Don Franzman stated he was opposed to the T zone as they had no guarrantee as to what would be built in the area. He stated that his home was in the $20,000 class and felt anything less than a brick double would be a detriment. He stated he had no objection to R-2 zoning. Paul Franzman stated he would like to see the type of double the developer intends to put there. Mr. LeFant stated they did not have their sketches with them. Mrs. Romans stated the restrictions in an R-2 zone were not as rigid as in the T zone. Discussion followed. The hearing was declared closed. Rice moved: Miles seconded: That the matter be tabled for further study. The motion carried unanimously. IV. Fred Walden Row Housing Mr. Walden stated he was interested in the development of "Town houses" in the Pleasant View Subdivision in Centennial Acres. He stated that west of Irving Street there is 20 acres of undeveloped l .and which came into Englewood as R-1-A. Gordon Nuttal, a general contractor, stated that he was asked to explore the possible uses of the area. He stated that ~he area to the north was zoned for heavy density (residential apartment living); to the west was a new development; to the south, a good residential area that was not yet in Englewood, and to the east the portion of Centennial Acres recently annexed by Englewood, for which 9,000 sq. ft. was the minimum area per site. He felt the I I I I I Pa g e 573 only alternative was "town houses"; they wanted the requirements to be something lesser than the 9,000 sq. ft. per site, yet wanted it something greater than required in R-3. Mr . Nuttal showed a picture of the proposed development, stating it represented 36 buildings of 6 units each. There would be approximately 200 residences in the 2 0 acre tract. He stated each unit would be a complete house. Discussion followed. Mrs. Romans pointed out that the staff was in the process of revising the present zoning ordinance, and did not believe it wise to recommend Council's further amending this ordinance. No act1on was taken. V. Approval of Minutes Martin moved: Miles seconded: That the minutes of June 22 and June 29 be approv ed as presented. The motion carried unanimously. VI. Vacation of Alley The Acting Planning Director, Mrs. Romans , stated that there had been a request to vacate the alley immediately north of Highway #70 between South Marion and South Marion -South Downing alley by Mrs. Nipper. It was pointed out that the alley served no purpose and absolutely could not be used. Discussion followed. Mayor Kreiling and Councilman Braun entered the meeting. Martin moved: Miles seconded: Thatthe alley be vacated if the Nippers would agree to s~and the expense ·. The motion carried unanimously. :._ - - - VII . Jensen Subdivision A pre-preliminary plat of the Jensen Subdivision was presented to the Commission. Discussion followed. It was suggested that the staff would continue to work with Mr. Jensen on the subdivision in order that the lots would meet the minimum lot area requirements and to eliminate the one foot reservation on South Jason Street and Radcliff Place. VIII. Street Dedication Mrs. Romans stated that Lee Schillinger, owner of property at 4675 South Pecos, wished to dedicate a strip of his land , 10' x 126', to be used for street purposes to the City. Discussion. Miles moved: Martin seconded: That the Planning Commission recommend to Council that tre 10' x 126.' street dedication at 4675 South Pecos be accepted . The motion carried unanimously. IX. Brown's Road It was pointed out that County Road #1, or Brown's Road west of Santa Fe to the river had never been officially desi g nated as West Union Avenue . Discussi·on. No action was t a ken . X . Parking Zone ¥rs. Romans stated that several inquiries had been received at the office concerning the zoning of the area just north of West Belleview from Broadway-Acoma alley to Acoma. People want to sell their land and feel their use is restricted . Discussion followed and it was pointed out that the T zone mi g h t be app l icable in th's c ase. No action was taken as no formal application for change of zoning had been filed, arr:l the staff is not prepared to make a recommendation at this time. Page 574 XI. Kent School Rezoning and Annexation Case No. 11-61 Mrs. Romans stated that Kent School Board of Trustees had asked the Commission to consider zoning their property C-1 with restrictive covenants between Kent School Trustees and adjacent property owners. It was the feeling of the Commission members not to consider C-1 zoning with restrictive covenants. XII. The Acting Planning Director reported there had been several reque s ts for rezoning of the area between Highway #70 and Girard and Lafayette and the R-3 zoning at Clarkson. Discussion followed; it was stated that the area was not suitable for "high-class" single family residences because of the State Highway, the commercial zoning on Hampden, and the many non-conforming uses in the area. No action was taken. XIII. Hi-rise Apartments The Acting Planning Director stated she had received a proposal for the construction of Hi- rise Apartments i n Englewood. As there are now no provisions in Englewood's Zoning Ordinance to permit them, it will be necessary to make provisions in the revised zoning ordinance to allow this type of structure. Councilman Braun stated that tpe Ordinance had provisi9ns for Pffice Buildings felt could apply to hi-rise apartments. No action was t a ken. ~ -------- - - XIV. Alley Vacation Chenango and Br o ad ay-Lincoln Alle y that he Mrs. Romans pointed out the area just east of Broadway and between Chenango and Belleview on the map presently zoned C-2 and R-1-C. There is a portion of an alley dedicated in back of Kinney's shoe store and it has been requested that the ·alley, be vacated. The Acting Planning Director suggested that the Planning Commission not consider vacating the alley at this time, and that more information would be given the Planning Commission at the next meeting. Discussion followed. No action was taken. XV. Gordon Tract Rezoning The Acting Planning Director stated an application had been filed reque~ting a change of zoning from R-1-A to M-1, and that the proponents wished to have the rezoning hearing held in August. Discussion followed, and it was the decision of the Commission that there were to be no re- zoning hearings in August; that the next quarterly rezoning hearings before Planning Com- mission would be in S e ptember. XVI. Rezoning Mrs. Romans said a pet~tion to have the area bounded on the north by East Cornell, on the east by South Lincoln, on the south by East Dartmouth, and on the west by the Lincoln-Broadway alley rezoned from R-2-B to T would be filed. Again there was a reqIBst to have the hearing in August. Discussion followed and the members of the Commission felt no need of rezoning hearings until the regular quarterly hearings in September. XVII. Zoning Ordinance The Acting Planning Director stat e d the staff was in the process of revising the i:resent zoning ordinance. It was suggested that there might be areas of c-0nformity between the Denver, Englewood, and Littleton zoning Ordinances. Mrs. Romans also stated the staff was making a new land use study and bringing the land use map up to date. XVIII. More meetings for PLAN~ING The members of the Commission and Mrs. Romans discussed the possibility of more meetings to work on the revision of the Zoning Ordinance, and other matters requiring considerable time and thought. M. with Mr. Kelley presiding. Members present: Hill, Pershing, Rice, Kelley Ro mans, Ex-officio Members absent: Martin, Miles Audience: Mr. Frenchy Gratts, Mr. Paul Franzmann I. Mr. Franzmann stated that his presence had nothing to do with the Olson's request for rezoning of Lots 2 thru 10 inclusive, Block 2, Franzmann-Folkert Subdivision; rather it is in connection with a letter dated November 13, 1958 concerning the water taps for the property which his family owns, and now wishes to develop. A 60' dedication for Huron Street was accepted by the City when the Subdivision was approved; however, an 8' easement down the center of this dedication was not shown on the plat, and power poles were at that time in- stalled in this easement. At the time the Subdivision plat was accepted by the City, it was understood by the Franzmanns and Mr. Folkerts that the light poles were to be removed before the City would furnish water for any of the lots in the subdivision other than Lots 1, 2 and 3 of Block 1. It was the Franzmann's understanding that Mr. Folkerts agreed to have the poles removed when he sold his property. Mr. Franzmann stated his family feels they are being deprived of the right to develop their property and request permission to build on lots 4 through 9, inclusive, Block 1, Franzmann-Folkerts Subdivision. Mr. Kelley read a copy of the letter dated November 13, 1958, which was directed to Utilities Director H. H. Babcock. Mrs. Romans gave a brief review of the Minutes of the Planning Com- mission of 1957 and 1958, which had no record of this problem. It was pointed out that the Olson's who had requested rezoning of Lots 2 thru 10, inclusive, Block 2, Franzmann-Folkert Subdivision, had only an option to buy the Folkerts' property, and that the Franzmann's felt if they were restricted in the development of their property on the east side of the street, that the west side of the street should be similarly re- stricted. Mr. F ranzmann stated that according to the letter, the land his family owns could not be used. He further stated that the power poles could be moved either to the west or to the east in the alleys. He stated that it would be up to the Engineering Department and Colorado Central Power Company to determine the location. Mr. Hill stated he felt that if the City accepted the easement on which the light poles are situated, it was the City's problem to see that they were rem9ved ; but from reading the letter, it was inferred that the property owners should see that the poles be relocated. It was pointed out that the total cost was estimated to be $4,500 of which the Power Company would pay $2,500. Mr. Franzmann stated that if Mr. Folkerts was able to sell his land, he had tentatively agreed to pay the remaining $2,000. He further stated he felt the Folkerts needed to be advised that the poles should be removed before the T-zon e would be approved for the west side of the block. Mr. Kelley stated that he felt the answer was to check back on this problem, advise the Folkerts, and to get in touch with Joe Esch. Mr. Franzmann said they would be willing to take their Mother's house out, and dedicate the portion of the street the house sits on if they could get a release of their property so they could get water and develop the rest of their land. At the present time, the elder Mrs. Franzmann's home is located partially in the intersection of Huron and Eastman, and an ease- ment across Lots 8 and 9, Block 1, Franzmann-Folkerts Subdivision provides access from East- man to Huron. Mr. Hill suggested making a one way s ·treet on each side of the poles, and having the developers put in curb and gutter on each side of a strip five or ten feet wide, and plant evergreen in the median strip. Mr. Kelley stated that it might increase the Franzmann's property value with such screening. Discussion followed. Mrs. Romans was asked to discuss the matter with City Attorney Joe Esch; Harold Babcock, Utilities Director; and Bill Davies, City Engineer; and to report back to the Planning Commission. I I I
