IX. NEW BUSINESS
Mrs. Romans gave a brief outline of the September 7th meeting, at which time there are six
rezoning hearings scheduled. She showed the areas on the ·map, and stated there would be
slides · of the areas which would be shown that evening.
Mr. Hill left the meeting.
Mrs. Romans said the rezoning requests were : 'I
1. Belleview to Layton, Broadway /Acoma alley projected to Acoma--·--from P and C-2 ; to T;
2. Gordon Tract, east of Decatur and South of West Union----R-1-A to M-1;
3. Pleasant View Subdivision--between South Irving and South Lowell immediately south of

That the Planming Commission recommend to Ci'ty Council the approval of
Englewood Unlimited's plan to improve Logan Street from Highway #70 to
Hampden and improve Hampden from Logan to Broadway to their maximum
practical width with appropriate signs, traffic signals, etc.; Cherokee
to be extended fr om Dry Creek to West Floyd with a bridge over Dry
Creek and with appropriate signs, traffic signals, etc.

for the Proposed C-3 Shopping Center, and a letter of transmittal to the Planning Commission.

Mr. Harry Carle no, representing the proponents of the rezoning request, indicated the area
on the map. He asked t he Planning Director if the area had been posted and proper publica-
tion given. Mrs. Romans answered in the affirmative. Mr. Carleno gave a brief history of
the area being considered and the area immediately surrounding it. To the east of the
river, it is zoned M-2 and to the immediate east of the Gordon Tract it is zoned M-1. He
stated the proponents wished to attract a light industry such as the Martin Company.
Mr. Carleno asked those favoring the rezoning to stand. Eight people were in favor.
Fourteen people stood to oppose the rezoning.
Mr. Wade, 2903 West Layton, presented a petition containi~g 32 signatures of property owners
in the proposed area and immediately west of the area opposing the rezoning. He felt a
buffer zone was needed; they did not want a direct break from R-1-B to M-1.
Mr. Curtis, 2900 West Saratoga, stated that 1 /3 of the people owning l and in the Gordon
Tract were protesting the rezoning. He stated he did not want the area to be degraded.
Mr. Ferguson stated he owned three acres in the area. He stated the only streets serving
the area of 30 acres were West Union and South Decatur. He further stated there were no
utilities, no gas, and the area was highly undesirable for anything at the present time,
and would not be desirable as an industrial area for some time to come. He stated that
Mr. Parr, Mr. Duckett, Mr. Tidwell and himself owned 10 1 /2 acres of 15 acres that lie high
and level. He said they did not want that 15 acres zoned M-1, a s he feld it would be more
desirable for other purposes.

III. WALDEN
R-1-A to R-2-B
REZONING
South of Sheridan City Limits,
West of Irving, East of Lowell
Boulevard.
CASE #16-61
Mr. Walden stated the area he was concerned with was on either side of Pleasant Lane; Sheridan
City Limits was to the north, Denver to the west, Arapahoe County to the south, and the City
of Englewood bordered the east. He stated there were 20 acre s of undeveloped land, upon which
6 houses have been built within 16 years. He said he was seeking the R-2-B zoning as a pro-
tection from the proposed higher density to the north; it would then serve as a buffer and
protect the people to the south.
Upon a request from Mr. Walden, 6 people favoring the rezoning request stood.
Mr. Ken Schuricht, 3292 West Stanford, read a petition opposing the rezoning signed by 17
residents of the City of Englewood. Mr. Schuricht stated the type construction proposed was
not compatible with the present construction in the area. He said he felt there would be
added traffic congestion in the area as a result of the proposed development.
Mr. Bill Hughes presented a petition with signatures of 70 people not presently within
Englewood, who opposed rezoning of the area.
Dr. Van Buskirk, representing the Centennial Acres Civic Association, stated his group wished
to go on record as unanimously opposing the rezoning.
Mr. Rice stated the Planning Commission had letters from Fort Logan Elementary School Dis-
trict and Sheridan Union High School District opposing the rezoning.
Mr. Jess Bear, a member of the Board of Education of the Alice Terry School of Fort Logan
stated his group was against the rezoning. The additional traffic would be an increased
danger to the children.
Mr. Gordon Nuttal, consulting Engineer and Builder working with Mr. Walden, stated the six
property owners present favoring the rezoning, represented 75% of the property owners in the
subject area. Mr. Nuttal said a study had been made of the area, and it was determined that
an R-2 zone classification would be the proper zone; that it would serve as a buffer between
R-3 and R-1 to the north and south of the area.
Mr. Tomlinson asked if he had understood correctly that there was R-3 zoning to the north
with three to five story apartment houses. He stated it was his feeling that a buffer zone
was not needed; -there was no need for any further zoning butr R-1.
Mr. Rice syated that in a letter from the Sheridan City Clerk, it was stated that the area
was zoned R-1 when it was annexed in 1960, and the zoni~ had not been changed.
Mr. Irving, Sµperintendent of Fort Logan Schools, stated that thus far this school year,
they had rented two classrooms outside their schools. They could not possibly provide
additional rooms for the additional children the proposed development would bring in. Mr.
Irving stated that as of Monday morning, the library would be used as a classroom~ Hallways
and the Superintendents' office we re also to be used as classrooms.

Mr. Tomlinson stated they did not want a development devoted to old age pensioners and
retired residents either. They didn't want ambulances rushing on their streets continually.
Jim Robbins, 3175 West Stanford, stated he believed the R~2 would be an isolated finger
rather than a continuity of zoning. He pointed out that the people whoffigned for the R-2
originally signed for the present R-1 zoning when the area was annexed.

IV. BEN NAZARENUS REZONING

CASE #18-61
Mr. Simon, representative for Mr.Nazarenus, stated he did not file the application; that
the ptition had been circulated in the a r ea some time ago. Mr. Simon stated that according
to a study made by Mr. Bowes for Englewood, the area between Clarkson and Logan, Highway
#70 and the Creek was shown to be best suited for an R-3 zone, and that th~s area is in a
comparable situation. It.was pointed out that the older homes in the area didn't justify
remodling. It was also stated that there were only seven (7) people in the whole area
opposed.
Mrs. Weese, 3 5 35 South Marion stated the clinic at Lafayette caused no trouble, that that
Cinderella City would cause additional noise and traffic in the area, as would an R-3
development. She further pointed out that Charles Haye School was crowded; they would ap-
prove an R-2 zone, but not an R-3 classification.
Tony Monte stated he was opposed to the zoning change. Mrs. Monte stated there was a probl e m
already for children crossing the streets and highway to get to school. They did not need
additional traffic in the area.
Mrs. Nipper stated she was against the rezoning. She would not object to doubles.

CASE #14-61
Mr . Simon, representative for Dr. Davis, stated the request was for lots 25 ,to 45 inclusive,
Block 8, Strayers Broadway Heights, or the west side of 3000 Block South Lincoln. A brief
history of the area was given, in whXh it was pointed out that a rezoning request for C-2
had been denied by the Commission in 1958, and upon appeal to Council was also denied; reason
for denial being given as spot zoning. The 1955 Zoning Ordinance made Dr. Davis' use non-
conforming, and he could not expand his building.
A drawing of the proposed addition wa s presented to the members. Mr. Simon said that Dr.
Davis p e rsonally canvassed every house on the west side of the block, missi n g only three
home owners who were out of town. There wa s no opposition.
John Roberts, representing Arapahoe Oldsmobile, stated they were not opposed to the T zone,
but were concerned with the rumor that the T zone would eventually be applied the length of
Broadway on both sides, thus eliminating chances of getting C-2 zoning for their later use
on Acoma. He reported their business was located on the west side of Broadway.
Mr. Holland stated he owned property in the 2900 and 3000 blocks on South Broadway. He asked
what the T zone was. Mr. Rice explained the T zone was a new zone, and gave a list of uses
permitted in the T zone. Mr. Holland then stated he did not want T zone on the 2900 block
South Lincoln, he would like to have C-2 zoning.
Mr. Hill pointed out that if Commercial zoning was desired, a petition would have to be
presented , an application made and feasibility shown; but that the Commission would consider
it equally with any other request.

VI. BRUNO REZ ONING CASE #17-61
C-2 and R-1-C
to R-3-A
The applicant was represented by Mr. Richard Graham. Mr. Graham stated the area considered
was 2 /3 R-1 residential and 1 /3 commercial, but was a poor location for either use. Mr.
Graham stated there was R-3 zoning in the neighborhood, but not directly adjoining t h is
property, which is directly behind Kinney's Shoe Store, just south of Chenango. Mr. Graham
stated the most logical zone would be C-2; the area could not be used for R-1 residential.
He stated there was not a n e e for another clinic in ~nglewood, and the lot was too large
for one anyway; there were many Doctor's offices in Englewood; the area would not accommodate
a filling station; furthermore, the people in the surrounding area did not want these uses.
They were, however, ~ery much interested in seeing the area developed.
Mr. Graham presented a sketch of the proposed development. It would not exceed
in height and would have a gabled roof. Parking would be to the east, and set
ments would be met. It was pointed out that a partially dedicated alley was in

Mr. Dickman stated the proposed two story apartment building would have 20 one bedroom apart-
ments, and five one bedroo m apartments. He said the developer hoped to rent to working people
without children, and that the area was too close to Broadway for family units. It was
stated there had been no opposition indicated in the neighborhood.
Mr. Schaffer stated he owned property to the south and was interested in the alley. He
further questioned what assurance they had the building would be only two stories high. Mr.
Shaffer indicated he would be willing to dedicate a portion of his property for an alley.
Mr. Jeffers stated his property was located directly against the area being considered. He
stated he did not loke the trailer courts; and inquired on the 'height limitations of an R-2
and R-3 zone.
Mrs. Polson stated the alley did not affect them, but she felt the whole block should be con-
sidered for rezoning.

VII. PLANNING COMMISSION REZONING
P and C-2 to T
CASE #15-61
Mrs. Romans stated this rezoning was initiated by the Planning Commission. It was felt by
the members that the area presently zoned "P" was too restricted, and would not hold up in
court. She stated the area under consideration extended from Layton to Belleview, from the
Broadway-Acoma alley to Acoma.
Mr. Hill asked if any of the area was presently developed for parking. Mrs. Romans stated
there was a portion developed; that parking was a permitted use in the "T" zone, so the
present use would not be harmed.
Mr. Bear s t ated he was owner of two lots and could not use them for anything but parking.
He was in favor of the change.
Mr. Walter Irwin stated he represented Mr. Conrad, a property owner in the 5000 Block South
Acoma. He stated at the present time Mr. Conrad's use was non-conforming. He suggested
zoning according to use. Mr. Irwin pointed out that his client was not opposed to the "T"
zone.
Gerry Rush said he felt the Planning Commission had taken a step in the right direction,
but wondered what was to be buffered. He stated he would like to see the entire area g o
Commercial.
Discussion followed.
Stephen Dreher Jr. said he felt the area should be zoned Commercial. Mrs. Dreher, Sr. stated
1 /3 of the 4800 block South Acoma was Commercial. She felt the T zone wouldn't conform with
the 60 unit apartment house across the street.

VIII. DETERMINATION OF HEARINGS
Mr. Rice stated any further discussion would be limited to the members of the Commission.

next regular meeting.

Martin seconded: That the rezoning request made by Mr. Walden for R-2-B zoning from
R-1-A be denied, as protest against rezoning was substantially greater
than reasons given for it.

Motion carried.
There was considerable discussion on the rezoning r•quest made by Mr. Nazarenus.

Hill seconded: That action on Mr. Nazarenus' request be tabled until a study can be
completed in detail on a map.

Nays: Martin, Pershing
Motion carried.

Martin seconded: That the request made by Dr. Davis for T zone from R-2-B be approved.

Discussion followed on the rezoning request by Mr. Bruno for a change from R-1-C and C-2
to R-3-A.

Miles seconded: That the decision to be rendered on the rezoning request of Mr. Bruno be
tabled for further study.

Nays: Martin
Motion carried.
Hill moved: That the rezoning action initiated by the Planning Commission for a
change of zoning from "P" to "T" be approved.
The motion died for lack of a second.

Martin seconded: That the action be tabled for further study.

IX. The minutes of August 24 were approved as presented.
X. NEW BUSINESS
Mr. Kelley stated he had one copy of "New Growth" from the Inter-County Regional Planning
Commission available for study.

Mrs. Romans reminded the Commission of the work on the Master Plan, and asked the members to
study this project carefully.
Mr. Kelley stated he wished to congratulate City Manager Rudd on his choice of Planning
Director.
