Members present: Hill, Miles, Pershing, Rice, Kelley Romans , Ex-officio Members absent: Martin I. APPROVAL OF MINUTES The Minutes of September 7, 1961 were approved as printed. II. GORDON TRACT Hill moved: Miles seconded: That the matter be raised from the table. The motion carried unanimously. CASE #13-61B September 7, 1961 July 20, 1961 I I I I I I Page 589 Mrs. Romans showed some slides of the area on the screen. It was pointed out that if Clay Street were extended south, people would have frontage on both Clay and Decatur. A memorandum from the City Clerk was read regarding the zoning of Centennial Acres Fourth Filing. The area has not been rezoned, and is presently R-1-A, with Decatur Street and Lot 1, Block 31, Centennial Acres Fourth Filing zoned R-1-B. Mr. Rice stated that if the entire area were to be rezoned M-1, there would be the usual problem of additional truck traffic from an Industrial area right next to a residential area. A brief discussion followed: Mr. Kelley read the following list of reasons the applicant had given on his application for the requested rezoning: 1. The areas immediately adjacent to the above land on the North are presently in the City of Englewood, and are zoned M-1, and immediately to the East are zoned M-2 (Light Industry). 2. The present use of these lands does not conform to the present zoning of R-1-A. 3. The land is most adaptable and best suited for industrial development by virtue of the terrain, the closeness of arterial highways a nd railroad lines. 4. The type of zoning, namely, light industry, will act as a buffer between the present zoning immediately to the East of this land, which is M-2 or heavy industrial, and the land immediately to the West of this tract, which is presently zoned residential. Discussion followed. Rice moved: Pershing seconded: That the request made by Mr. Gordon for rezoning of subject area from R-1-A to M-1 be denied. Mr. Kelley asked if the Commission wished to give further consideration, and maybe make a recommendation of change of zoning in part : Discussion followed. Upon call of the role: Ayes: Hill, Kelley, Miles, Pershing, Rice Nays: None Motion carried unanimously. lII. BEN NAZARENUS CASE #18-61A The Planning Director displayed a large land use map of the area between Lafayette and Clarkson, Highway #70 and Floyd. The subject area is between Highway #70 and Hampden, Marion and Downing, and presently zoned R-1-D; zone change request is for R-3-B. Mrs. Romans had slides shown of the area. She stated the Planning Office had received additional communications from residents in the area, including a petition signed by 28 property owners in the area favoring the rezoning. Chairman Kelley read a letter op- posing the rezoning signed by 14 property owners, setting forth 10 reasons for opposition. They are: 1. This is a one block residential area with Marion running into State Highway #70. 2. R-3 zoning places this area in a commercial status with the exception there would not be any selling of merchandise or products. 3. A 24 unit apartment would place an additional burden on Hay school which is overcrowded now. 4. Traffic: so many children ·crossing Hampden and Marion would be hazardous. The remaining residents would have very little if any parking space on the stneet. Front drive ways would always be blocked thus causing more work for the police and an irritation in the neighborhood. 5. Parking: as stated by the party requesting rezoning, the parking would be on the south and north ends of the said property, thus disturbing the peace of the present property owners. There is no parking allowed on the highway. 6. Transportation: there is no regular bus this far out thus calling for more cars than one per family. 7. Traffic will be heavy both day and night, holidays, Saturday and Sunday. With the Cinderella Shopping Center going in, this area will be very crowded as well as very noisy. 8. Irene Cherry, now of Wickenberg, Arizona, tried to buy lots for a one unit dwelling and the owners would not sell. These people were liv i ng in this city at the time. This will show that the area is still attractive to one unit dwellings. 9. The petition which was presented to the Commission on Sept. 7 approving the R-3 zoning is approximately 2 years old. The names of Britt and Ricard are not valid because they do not presently own property in this area. Mr. Joe Ricard was deceased, over a year ago. Requests for two names to be removed have been made to your office. 10. We would not object to a R-2 zoning. Mr. Kelley also read a letter from Mr. and Mrs. Resley stating they wished to have their names removed from the petition they signed two years ago favoring the rezoning. Discussion followed. Page 590 Hill moved: That the matter be tabled for approximately 30 days to give time for further study, and the Commission would try to make a final determination at that time. Mr. Kelley pointed out that failure to act within 60 days could be determined to mean approval. Mrs. Romans asked whether it was from date the application was received or date of public hearing. Discussion followed, and the Commission felt it was from the date of public hearing. Mr. Miles pointed out that the matter was still tabled, as no motion had been made to remove it from the table for action. Chairman Kelley declared the motion made by Mr. Hill dead for lack of a second. No action was taken, and the issue was left tabled. IV. JOHN BRUNO CASE #17-61A September 7, 1961 Hill moved: Miles seconded: That the matter be removed from the table. The motion carried unanimous l y. The Planning Director handed the members copies of a letter from Richard Graham, who represented Mr. Bruno at the public hearing. Slides were shown of the subject area. Discussion followed. Chairman Kelley asked why the zone pattern in the area was so ir- regular. Mr. Hill stated that he believed that at one time it was the policy of the Com- mission not to divide the zoning classification on property under one ownership. Since the areas have been platted, the zone breaks on an alley. Discussion followed; the Planning Director reminded the Planning Commission of the three rules for rezoning, and that the holding capacity study indicated 80% of the area zoned R-3 is not now developed to its capacity. Mr. Hill felt the developer would be doing some- thing for the city in cleaning up the area, opening and blacktopping the alley, and pro- viding the beginning of possible through access for emergency vehicles. Miles moved: Pershing seconded: That the rezoning request by John Bruno to change the zone from R-1-C and C-2 to R-3-A be denied for the following reasons: 1. The area was not contiguous to like zoning. 2. Proof was not presented to show need for additional R-3 zoning. 3. The area was not one city block in size, and would constitute spot zoning. Ayes: Kelley, Miles, Pershing, Rice Nays: Hill The motion carried. V. PLANNING COMMISSION CASE #15-61A September 7, 1961 Hill moved: Miles seconded: That the matter be raised from the table. The motion carried unanimously. The Planning Director had slides of the area which were shown the Commission. She also stated that there had been no further contact by anyone in the area with the Planning Office. Mr. Rice questioned zoning the area that is both P and C-2 to T. He was concerned with the fact that a business might be split by the zoning. Mrs. Romans pointed out t hat the Commercial area on Broadway between Belleview and Yale was not fully developed, and that if this area on Acoma were to be zoned for Commercial use, there would need to be some valid reasons given not to zone Acoma and Lincoln from Belleview to Yale if requests are made. Discussion followed. Stephen Dreher Jr. presented the Commission with a petition signed by 80% of the people involved in the three block area opposing the T zone, and requesting permission to apply for C-2. Discussion followed. It was explained that an application for any rezoning request could be obtained from the Planning Office. Rice moved: Pershing seconded: That the rezoning of the area from Layton to Belleview, Broadway-Acoma alley to Acoma from "P" and C-2 to "T" be denied. The motion carried unanimously. HI-RISE ZONE AMENDMENT CASE #19-61B August 24, 1961 August 10, 1961 Mrs. Romans stated memos on this proposed amendment had been sent to different Department Heads for comments, and the replies had been received. Mr. Babcock indicated he was con- cerned with water pressure in the building. The Building Inspector had indicated that the problem would be taken care of in Type 1 construction under the Building Code. Chief Tillman had replied that there would be a minimum per capita cost of $6.00 for police ser- vices. She stated she had met with Mr. Gratts earlier that day to discuss the proposed amendment and work on a revision of Mr. Ritter's proposal. Discussion followed. Mrs. Romans stated she would like a date set for a public hearing on the proposed amendment. Hill moved: Rice seconded: That the date for a public hearing on the proposed amendment of the R-3-A Ordinance be set for October 12, and that notice be published. The motion carried unanimously. VII. JENSEN SUBDIVISION CASE #20-61B August 10, 1961 July 20, 1961 Mrs. Romans stated the preliminary plats had been received and forwarded to the various departments and companies for approval. VIII. CINDERELLA CITY SITE PLANS The Planning Director stated the site plans had been distributed to various departments for consideration. She further stated Alex Holland had notified her of a few minor changes in the plans that would be presented soon. IX. ALLEY VACATION The Planning Director stated she had received a letter from Richard Banta for Swedish Hospital, to vacate all or portions of the alley between Pennsylvania and Pearl south of Girard. The request has been transferred to Engineering Department, Utilities Department and Colorado Central Power for comment s or suggestions. X. DUTIES OF RECORDING SECRETARY Mrs. Romans stated that the City Manager wished clarification as to whether his appointee signed public notices issued by order of the Commission through the Planning Office. Miles moved: Hill seconded: That Gertrude Welty be authorized to sign public notices issued by order of the Plann ing Commission. The motion carried unanimously. XI. NEW BUSINESS Mrs. Romans stated a meeting would be set up with property owners in the area of the Franzmann-Folkert Subdivision to discuss the light poles in the middle of 3200 South Huron Street. The Planning Director stated she had talked to Mr. Irving Mock who wished to dedicate West Baltic between Zuni and Vallejo and Vallejo and Tejon. The property owners say they will agree to initiate a paving district for the street, but want the sewer line in before the paving is done. There was a brief discussion on Highway #70 at Cherokee, Bannock, Sherman, Logan and Clarkson as pertains to Englewood.· Hill moved: Rice seconded: That the Planning Commission recommend to the City Council that the Council request the State Highway Department to make a study of Highway #70 at South Cherokee, South Bannock, South Sherman, South Logan, and South Clarkson. The motion carried unanimously. The Planning Director stated a representative of ICRPC had agreed to meet with the Planning Commission at their regular meeting on October 19, 1961. The meeting was called to order by Chairman Kelley. Page 593 The Planning Director reviewed the motion made by Mr. Hill and seconded by Mr. Rice at the regular meeting of the Planning :Commission on September 21, which read: "That the date for a public hearing on the proposed amendment of the R-3-A Ordinance be set for October 12, and that notice be published." It was pointed out that the effect of this motion would apply to the entire presently zoned R-3-A area, and that· the Commission should determine whether or not this was their intent. Discussion ensued. Because there is considerable area within the City presently zoned with an R-3-A zone classification that might not be feasible for the hi-rise type building, it was the general opinion of the Commission that the Hi-rise Zone should be an additional classification in the Zoning Ordinance rather than an amendment to the R-3-A zone. Miles moved: Pershing seconded: That the public notice advertising the October 12th public hearing regarding Hi-rise Ordinance read: That the date for a public hearing on the proposed amendment of the Zoning Ordinance adding an additional zone classification, R-3-C, be set for October 12, and that notice be published. Members present: Hill, Martin, Miles, Rice, Kelley Romans., Ex-officio Members absent: Pershing I. APPROVAL OF MINUTES The minutes of September 21 and September 25 were approved as presen±ed. II. CINDERELLA CITY SITE PLANS Alex Holland presented four sets of revised pages 2,3,4, and 5 to the Planning Commission. Mr. Holland stated the changes were primarily in building locations. He also stated an additional four se~s would be filed when completed. Mr. Kelley stated he wished the record to reflect that the Cinderella City Site Plans were received, and would be referred to Department Heads of the City for study. III. ALLEY VACATION AT SWEDISH HOSPITAL Mr. Richard Banta, representing the Hospital, stated they wanted that portion of the alley between South Pearl and South Pennsylvania, East Girard and East Hampden not already vacated, to be vacated. It was pointed out that part of the new construction being done by the hospital would be on the alley. Planning Director Romans stated the request had been referred to Colorado Central Power Company, the City Utilities Director and the City Engineer .. The Engineer's Office had asked that a 16' easement for sewer realignment be obtained, and that at this time, the alley not be vacated north of the South property line of the residence, in order that there would be access to the residence. Harold Rust of Colorado Central Power Company, stated the line south of the last pole had been removed and put underground. He said there was no objection to the proposed vacation. Brief discussion followed.
