At the present time our studies show that only 1 /20 of the land zoned for R-3 purposes are used as an R-3 use and additio n al R-3 zoning should not be created until a need is established. Nies Recording Secretary * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION Minutes of February 16, 1961 The recessed Planning Meeting was called to orde r by Chairman Kelley at 8:10 P. M. Members Present: Hill, Rice, Martin, Miles, Kelley, Romans Munns, Ex-officio Mr. Esch, City Attorney Mr. Nie s , Planning Assistant Members Absent: None I. DEDA Mr. Bob Downing of the Englewood Chamber of Commerce explained Stage #1 of the DEDA plan to the Commission and pointed out three areas where access should be created. The three areas he referred to were (1) access from the east via Sherman Street, (2) access from the west via Cherokee Street and (3) access from west by a ramp off of Highway 70 onto Broadwa y. Mr. Downing felt that the first two items could be accomplished on the local level, possibly by the establishment of a special district. He stated that Mr. Merten of the State Highway Department had requested funds to complete item 3 in order to correct the problem at Highway 70 and Bannock . Mr. Downing asked the Commission members for their comments on the plan. Members of the Commission asked questions on various parts of theDEDA Plan, and Mrs. Romans presented a drawing of how she thought the traffic pattern should re in downtown Englewood. She felt that access fr om Cher okee Street could be eliminated by making Acoma one way to the south and B?nnock one way to the north between Highway 70 and Floyd Avenue. Mr. Smuckler, Ambrose and Abbott, representing DEDA, remarked that completion of interchange at Highway 70 and Santa Fe would increase the problem of access to downtown Englewood. They voiced the opinion that unless definite plans are launched now, downtown Englewood will lose more retail trade. Mr. Downing showed the more advanced stages of DEDA, and furiher discussion followed. Hill moved: Martin seconded: That the Planning Commission accept the proposal submitted by DEDA and the Chamber of Commerce for study, and recommend to City Council enabling acts to create a special improvement district. II . The correction of the minutes of February 9 , 1961 meeting were as follows: The last paragraph should state that the meeting was recessed instead of adjourned. III . City of Englewood C-3 · Amendment to Zoning Ordinance Hearing No. 2-61B January 5, 1961 February 9, 1961 The r.hairman remarked that Mr. Esch and The Planning Director had received suggested changes and that Mr. Munns would read the revisions they had incorporated into the proposed amendment . The Chairman also noted that the Northeast Englewood's Citizens Commi ttee had just submitted their letter with suggested changes. The Planning Director read the changes he and Mr. Esch felt were necessary. The major changes were: (1) clarification of the words center and district , (2) changing the section on statement o f policy so that the developer would not lose the right to develop his land if problems arose that were beyond his control and prevented him from meeting the deadline for completion o f a center, and so that reconsideration of zoning classification was more clearly stated as a policy dependent upon change of need, (3) special improvement district was deleted as a means of financing a drainage system, and (4) exits would have baffle lanes. The Chairman suggested the Commission review Northeast Englewood's Citizen's Committee letter. Mr. Feder, representing the Northeast committee, expressed his concern on a number of items he felt were still unanswered. Mr. Esch and the Planning Director replied that they thought the ordinance was sound as it was written. The Chairman felt that the Commissi on should be concerned with the intent and leave the wording up to the City Attorney. Hill moved: Rice seconded: That after due consideration of the proposed ordinance and careful study that it be referred to the City Council as revised. The motion carried unanimously. City of Englewood Amendment to .Zoning Ordinance Hearing No. 45-60D November 22, 1960 January 5, 1961 February 9, 1961 The Chairman briefly reviewed past action on the amendment. Rice moved: Martin seconded: That the ordinance for simultaneous zoning and annexation be referred to City Council for passage. The motion carried unanimously. Romans moved: Hill seconded: That because the present zoning ordinance does not contain adequate controls f or dealing with Shopping Centers, the City Council adopt the C-3 control ordinance before adoption of the simultaneous zoning and annexation ordinance. The motion carried unanimously. V. Dr. Byall Mr. Nies noted that Dr. Byall had applied for rezoning of his land located at Jefferson Drive and Sherman fr om R-2-B to C-1. He stated that the property was being posted and public notice would be given in the paper. VI. Flood Plain Zoning. The Planning Director briefly commented on Flood Plain Zoning. VII. 30 Unit Apartment The Commission was informed of construction of a 30 unit apartment at Jefferson and Bannock . VIII. Munns MEMORANDUM TO THE ENGLEWOOD CITY COUNCIL REGARDING ACTION OR RECOMMENDATION OF THE CITY PLANNING AND ZONING COMMISSION DATE: SUBJECT: RECOMMENDATION: February 16, 1961 C-3 Control Ordinance for Shopping Center That after due consideration of the proposed ordinance and careful study that it be referred to the City Council as revised, and that if it meets the approval of City Council that it be passed prior to the Simultaneous Zoning and Annexati on Ordinance . M. Members Present: Hill , Romans, Martin, Miles, Rice , Kelley Munns , Ex-officio Members Absent: None -_,_ - - - - - -- - I. The Minutes were approved as read . II. Jim Smith Temple Rest Home 3400 So. Marion . Case #4-61 Mr . Smith , the manager of the Temple Rest Home, was present at the meeting and explained that they wished to replace a kitchen facility that does not meet .the state health require- ments and add another unit to contain 28 beds, making a total of 54 beds. They eventually plan for 78 beds . In order to meet the state requirements of a home for senile patients they need to add several additional employees; and with their present 26 bed capacity this would not be profitable. They have 17 lots at this location which gives them area to expand. If they cannot expand the home , they have 8 acres at Fort Logan and plan to eventually move the operation to that location . The Planning Director stated he felt that in some cases restrictions on non-conforming uses which have been there long before zoning existed are causing bad relations between the City and the public. He felt maybe the non-conforming use ordinance could be amended so that limited changes could be made which would result in benefits to all parties concerned. Rice said they can improve their property up to 50% but they cannot expand their property. He thinks if we can open the door everyone will have a problem to be solved. Mr. Smith stated tha t the petitions submitted requesting R-3 zoning represented 95% of the property owners in the block. Hill thinks the non-conforming increase in floor area in Section 3 -page 29 should be in- creased to allow more than 25% expansion. Rice said each change should be considered very carefully. Romans moved: Hill sec o nded: The motion carried. III. Rose Leino Bell Realty (1) That the matter be referred to the Planning Director for study and recommendation at the next meeting of the Commission. (2) To arrange a meeting with the Board of Adjustment if he feels it is necessary in order that the Planning Commission might interpret their thinking concerning a possible change in the zoning ordinance. Hawthorne School 4100 South Bannock Case No. 3-61 The Planning Director reported that Mrs. Leino had visited the office to request rezoning of the Hawthorne School site at 4100 South Bannock from R-1-D to R-3-A. She was advised of the Commission's feelings about creating additional R-3 zoning and asked to wait until it could be discussed at a Commission meeting . The Director suggested that the Planning Commission recommend to the Board of Adjustment consideration of a variance ·i or permit for use of the building for office space until the Council amends the present zoning ordinance. Miles questioned whether or no t the Commission could consider her request until such time as Mrs. Leino is the owner of the property . Mrs . Romans stated she felt that office use of the building was compatible with the surrounding area since Broadway is commercial and the School Administration building is located across the street. Mrs. Leino states that she plans to remodel the building both inside and out and that the City and School District both would benefit from the increased tax base.
