CONSIGNMENT SHOPS IN MU-B-1 ~ Ms. Langon reviewed background information and several issues Staff has identified. She provided a brief overview of "Re tail Sales" in the Use Category of the Unified Development Code. Use categories were created with the 2004 revision of the UDC. All second hand type uses were placed under Retail Sales. Use types include : buy-back shop, second hand, thrift and consignment. All were permitted in MU-B-2, 1-1 and 1-2 zone districts. They were not permitted in the MU-B-1 zone district. There is currently a definition for what a second hand good is, but no definitions for the individual uses. Second hand would be any type of store that deals with used goods. A consignment shop generally pays a commission to the owner of the item and that person retains ownership of_._ the item until it is sold. Consignment is slightly different from a buy-back or second hand store in that thos e stores actually own the items. A thrift shop, at least in the original intention of the Ordinance, is the larger scale store (Goodwi ll , ARC, Salvation Army), is generally a non-profit and their items are received by donation and a tax exemption may be available to the donor of the goods. Again, the store owns the items until sold. Staff has received a request for a consignment shop in the MU-B-1 zone district, Central Business District. She noted Director White brought that request to the Commission two weeks ago. • She provided four options for the Commission's consideration regarding the issue of allowing consignment stores in the MU-B-1 zone district. • They are: 1. Leave the Code as is. 2 . Single Step Approach ... Allow all of the four uses in MU-B-1. 3 . Multi-Step Approach ... Establish thrift as a separate us e type. 4 . Split each use into its own use type in Table 16 -5-1.1 and designate appropriate zone districts in which each is allowed . Discussion ensued. Several Commissioners stated they liked Option 2. Mr. Brick stated he preferred Option 4. Mr. Welker asked about intern et sales stores. Ms. Langon noted that discussion was held a few years ago and is an allowed use in M-B-2 , 1-1, 1-2 and M-2. He stated he did not see it as being much different. Ms. Krieger said she does because the merchandise is not for sale in the shop so it's not technicall y reta il. Chair Knoth asked for everyone to hold up their hand if in favor of Option 2. A majority of the Commissioner's held up their hand. Mr. Brick felt it is important that there is good advertising regarding th e Public Hearing for the Community . • • • Planning and Zoning Commis sion Study Ses sion -Consignment Shops I Sign Code Am endments Case #2010-03 -#2009-05 March 2 , 2010 P ag e 3 o f 4 Welker moved: Fish seconded : TO DIRECT STAFF TO MOVE FORWARD WITH OPTION 2: MAINTAIN THE GROUPING OF BUY-BACK, SECOND HAND, THRIFT AND CONSIGNMENT STORES IN A SINGLE USE TYPE AND ALLOW ALL IN MU-B-1. AYES: NAYS: Roth , Krieger, Knoth, Fish , Welker, King, Calonder Brick ABSTAIN: None ABSENT: Bleile Motion carried. Ms. Langon stated Staff will move forward adding buy-back shop, second hand, thrift, and consignment shops into the MU-B-1 zone district in the Table of Allowed Uses. Ms. Langon noted definitions may have to be written in order to clearly identify each of the uses. Ms. Langon provided a timeline for the UDC amendments related to consignment shops in the MU-B-1 zone district. The Planning and Zoning Commission Public Hearing will be scheduled for April 6 1h. SIGN CODE AMENDMENTS lt] Ms. Langon reviewed what was discussed at the last sign code amendments meeting. Three categories were discussed: permitted, exempt or prohibited. Also discussed was whether a sign would require a permit. The six prohibited signs included: billboards, mobile billboards on-site, off premise or third party signs , search lights, signs on fences and signs resembling official traffic control signs. She noted there were several types ~of signs that needed further discussion, one of which is electronic signs. Ms. Langon noted signs in the right-of-way are not regulated by the zoning ordinance. She referenced two drafts of the Table of Allowed Uses hanging on the wall. Discussion ensued. Mr. Welker suggested using more footnotes to keep the table less cluttered . Ms . Langon asked the Commission if they had any questions. Several said they liked the direction Ms . Langon is taking. She noted what she is working on right now are signs that are attached to a building. Later the Commission will work on free-standing, temporary/portable signs and the mixed hybrid type of signs such as address. PUBLIC FORUM [tlJ Chair Knoth asked each of the guests if they wo uld like to say something. A ll thanked th e Commission for their time and efforts. Ms. Susie Fedders stated she had no idea how much was involved in th e process of changing the code. Mr. Bjorkman and Mr. Leonex were invited to attend the public hearing on April 6th to see the formal side of th e Commission. V.
