befo re the Co mmissi o n toni ght is CASE #2008-04, which is proposed am end m e nts to the
Eng lewood Municipal Code related to land scap in g and sc ree nin g standards for new
development and redeve lop in g properties . Th e proposed amendments w ill rep lace Sect io n
16-6-7 Land scap in g and Screen i ng in its entirety. He stated he had already submitted fo r the
reco rd th e Staff Report and Proof of Publi ca tion that notice of th e public hearing was
published in th e Englewood H erald o n Jul y 30, 20 10 and was also o n the City's webs ite
from July 28 11i through Aug u st 1 7111
, 20 10.
The Comm unity Development Department is requesting th at the Comm iss ion revi ew the
proposed Ordinance, take public testimony and forward to C ity Co un c il a recommendat ion
for approva l of the proposed Ordinance .
The landscape regulations in the c urrent Unified Development Code (UDC) h ave remained
relatively unchanged sin ce abo ut 1998. With th e m ajority of the C ity's redeve lop m ent
occurrin g o n smaller in -fi ll t ype properties, portions of the c urr e nt Code were determined to
be l ess th an effective in relation to th e City's goa ls for future development.
In drafting the ame ndm ents th e Com missi o n ha s foc u sed o n th e following pr in c i p les:
1. Emphasize quality of land scap in g and materials, rath e r than quantity of
landscap ed area.
2. Lo cate req uired land scap in g w h e re it is most visible to the p u b li c.
3. Pro v id e greate r flex ibility fo r d ifferent landscap e solutions wh il e encou rag in g
variety.
4 . Allow maximum u se of the property while minimizin g v isu al impa cts .
5. Offer alternat ive methods of comp lian ce and fee-in-li eu options w here
approp ri ate .
Based on these princip l es, proposed ame ndm e nts t o th e landscape reg ulations we re
prese nted to the Comm iss io n on seve ral occas io n s. At the last st u dy session a n early
comp l ete d raft was reviewed. The fin al edits have been made an d a copy of the propos ed
amendments was includ ed in th e m ee tin g packet.

Chair Kn oth asked Staff if they had a certain dollar numb er in mind. Mr. Bell said at l east
$3 .00 per square foot. The fee is c urr entl y at $1.50 per square foot and it c os t s about $1 .50
per square foot to put rock down on top of weed barrier. It costs a lot mor e to do irri gation
and turf or shrub beds w ith trees. When you average in that 70 % of you r land scape ne eds
to be living, not just rock, that's why it raises it co nsid e rably. When Staff does take this is su e
to Counc il he wi ll provide a breakout of how Staff arrived at a number in terms of a non-
living number and a li ving number and justification as to what the final number ends up
be in g. He said the fee has been $1.50 as lon g as he ca n remember.
Cha ir Knoth asked if Staff cou ld provide the Commission with that information when it
became avai lab l e. Mr. Bell said h e would be h appy to provide the Commission with the
in formation.
Mr. Roth stated the fee needs to be high enough so that it's not the cheaper alternat ive. Mr.
Bell said as it stands right now it would be the cheaper alternative. He said to keep in mind
th e f ee-in-lieu is not eli gib le for parking lot landscaping or screen in g or landscaping
between the principle structure and the cu rb.
Mr. Welker asked if the fee-in-li eu applies to just area. Mr. Bell said it counts mainly for area.

Mr. Fish asked what the purpose of fee-in-lieu is; is it to discourage landscaping or provide
an alternative when a situ at ion is difficult? Mr. Bell said it is to provide an alternative wh e n
the situation is difficult, which does happen and more so on existing properties. The
applicant has to exhibit that they have tried to do some other type of alternativ e
compliance prior to going the fee-in-lieu route. Mr. Fish sa id he did not disagree with Mr.
Roth, but is not sure he wants a motion that says in it specifically that we are try ing to
d iscourage the use. Mr. Roth said that is what we've done with this Ordinance by making
the prerequisites. Mr. Calonder said maybe it's implied for it to be discouraged. Mr. Fish
said he feels the number shou ld be raised, but didn't want the motion to say discoura ged .
Chair Knoth said the motion is saying the Commission wou ld like the fee to be looked at.
Ms. Reid asked Mr. Fish if he was asking for a friendly amendment. Mr. Fish said he was
not, he was just commenting on it. Mr. Brook said as far as alternatives for comp li ance, Staff
sees the fee -in-lieu as typically the last alternative to be considered. He read the langua ge
from the amendments : "Only after it has been determined by the C ity that an alternative
comp li ance p lan is not practica l or feasible, a fee-in -li eu eq ui va lent may be cons id er ed ".
Mr. Welker stated he was comfortable the issue has been addressed and had no problem
with making a recommendation that simpl y says it shou ld be high enough, but doesn 't want
the Commission to set the numb e r and that certa inl y should not b e in the Ordinanc e. H e
said if Mr. Fish doesn't think the Commission shou ld make the motion he cou ld vote
• against it.

Direc tor White thanked the Commission for all their hard work on th e La1id scape
regulations and for the acknowledgment of Brook's hard work. He did a great job . H e said
thank yo u to Brook.

thank e d Tricia Langon for her wo rk on th e Amendments .
Tentativ e Schedule: September 8 (Wed n esday): Public Hearing -Flood Pl ain Amendments
Mr. Bell distr ibuted a letter from a citizen regarding the Kent Place red eve lopment. He
noted there was also another letter included in the meeting packet.
H e stated Staff w ill be moving ahead to City Council with the Landscap e Amendments and
subsequent ly with the fee-in-lieu discussion. Also, Staff will be following up with th e
Commission rega rding the revised landscape worksheet as we ll as th e lands cape m a nual
when c ompl et ed.
