CALL TO ORDER ~ The regular meeting of the City Planning and Zoning Commission was cal l ed to order at 7:05 p .m. in the City Council Conference Room of the Eng l ewood Civic Center, Cha i r Knoth presiding . Present: Absent: Staff: Blei l e, Roth, King, Krieger (e ntered 7:10), Knoth, Fish , Calonder Kinton (alternate ) (ex ited m ee ting at 7:47) Brick, Welker (Left ill pri o r t o th e m ee tin g co min g to o rder) Alan White, Community Development Director Nancy Reid, Assistant City Attorney II. APPROVAL OF MINUTES October 5, 2010 Calonder moved: Roth seconded: TO APPROVE THE OCTOBER 5, 2010 MINUTES Chair Knoth asked if there were any modifications or corrections. STUDY SESSION [?1J MEDICAL MARIJUANA AMENDMENTS Director White distributed information from the State on the section of the Statute that references licensing requirements. The discussion centered on primary and accessory uses. Several Commissioners felt they didn't have enough knowledge about the industry to make decisions at this time. Staff will gather more information for the Commission to review at a later date. Director White said the deadline to have regulations in place as a City is July 1, 2011 as that is when the State will begin issuing licenses for new facilities. IV. PUBLIC FORUM fl1l Doug Cohn and Jackie Edwards addressed the Commission . V. DIRECTOR'S CHOICE [?1J Director White said the Public Hearing on the new flood plain regulations was held last night. City Council asked that Director White pass on their thanks for the Planning and Zoning Commission's expeditious in-depth review and suggestions regarding the regulations. Director White asked the Commission their thoughts on cancelling the next Planning and Zoning meeting to be held on election night, November 2, 2010. After discussion it was decided to cancel the meeting. VI. STAFF'S CHOICE Director White had nothing further to report. AITORNEY'S CHOICE lt] Ms. Krieger asked Ms. Reid if there were guide lin es regarding testimony during a public h ea ring. Ms. Reid said the Public Forum section of the meeting is for a person to bring up a subject other than what was on the meeting agenda. Ms. Krieger said at future public hearings she wanted it made known to the public that during Public Forum the Commission is willing to listen to things other than what was discussed during the public hearing. Director White suggested using the language City Council has on their agendas that states Public Forum is the time for anyone to speak on something that is not on the agenda. Mr. Roth suggested at the beginning of the meeting the guidelines for holding a public hearing be explained. The Commission agreed that could be informative for the public in attendance. VIII. COMMISSIONER'S CHOICE [tlJ Ms. Krieger said she felt the public had a valid point at the last public hearing . She suggested Staff and the Commission introduce themselves at the beginning of the meeting. The Commission would like to make the atmosphere as friendly and comfortable as possible for those who attend and who testify . Mr. Roth stated he wanted to comment on the last public hearing. He said one of the co mments that h e h ea rd from the public was that "you guys have alr eady made up yo ur mind". He said the public hearing is the last step in this process for the Planning and Zoning Commission . The Commission has been through numerous study sessions and meetings b y th e time they get to a public hearing and do have most of the details worked out. Mr. Roth said at the last hearing there was a lot of misunderstanding about what the Commission was really trying to do. Ms. Reid noted that most of the public left before the Commission co uld respond to them during the discussion portion of the meeting. Several commented that a public hearing is not the place for questions and answers; that's why the Commission holds study sessions. Ms. Krieger stated the public can always go to the City's website and li sten to the minutes to see if the Commission commented on their testimony. The meeting adjourned at 8:25 p.m .
