Welty Recording Secretary Page 621 * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION MINUTES OF MARCH 8, 1962 Regular Session The meeting was called to order at 8:10 P.M . by Chairman Rice. Members Present: Hill, Kreiling, Miles, Pershing , Rice Romans , Ex-officio Members Absent: Love Also Present: Alan Koppel, Planning Assistant Mr.Rice stated that the Planning Commission was a cit izens advisory committee, appointed by the Englewood City Council; and that rezoning hearings were held on a quarterly basis. I. APPROVAL OF MINUTES Kreiling moved: Miles seconded: The minutes of February 8, 1962, be approved as printed. The motion carried unanimously. II. PLEASANT VIEW LANE CASE #l-62A January 17, 1962 Mrs. Romans gave a .brief review of this case. An R-2-B Zone classification had been re- quested in September, 1961. The rezoning request was not recommended to City Council by the Planning Commission. In an effort to work with the property owners of the area, the Planning Commission had initiated the R-1-C rezoning, which they felt would be compatible to the surrounding area. Miles moved: Hill seconded: That the hearing be opened. The motion carried unanimously. Slides of the subject and surrounding area were shown by Mr. Koppel. Mr. Rice asked the proponents of the rezoning to present their case. Mr. Fred Walden 3325 West Pleasant Lane -stated he was a property owner in the area, and was very much in favor of the change. He felt the present R-1-A zoning was too restrictive; and that the requested R-1-C would be compatible with the neighborhood. The question was raised as to what type construction the houses in the proposed development would be? The opponents desired brick development in the area. Mr. Rice stated there was no restriction as to the type construction a house had to be. Mr. Kenneth Schuricht 3292 West Stanford Ave. -stated that all the houses in the area were of brick construction, priced from $16,000 up,with 1100 square feet of floor space. To the south, Mr. Schuricht stated the homes were priced fr om $22,000 up, and had an average of 1500 square feet of floor space. Mr. Schuricht presented petitions protesting the rezoning signed by 81 property owners east of Irving, and also by all but three property owners on West Pimlico. Mr. Schuricht stated he did not feel the pictures shown of the area were representative of that area, that they emphasized the bad points of the area. Mrs. Jackson 4550 South Lowell -asked what the requirements were in an R-1-A zone classification. She is a property owner in the subject area, and in favor of the zoning change. Bill Hughes 3585 West Pimlico stated he wished to present petitions opposing the rezoning. Mr. Hughes asked if the platting of the area as R-1-A would be unfeasible; if so, he felt there would be more justification for the R-1-C. Messrs Herner and Hoffman stated they were opposed to the rezoning, as it would undoubtedly increase the sc hool population. Mr. Walden stated it was the intention of the property owners to build "nice" structures, probably brick, and that the average lot area would be 8200 to 8400 square feet. Mayor Holland of Sheridan, stated the present zoning to the north of the subject area was R-3, single-family residential. At the present they had no restrictions. Page 622 Mayor Holland stated there had been some consideration of multi-family zoning in this area, due to the hospital in Fort Logan. Hill moved: Pershing seconded: The hearing be closed. The motion carried unanimously. Miles moved: Hill second e d: The matter be tabled for further study. The motion carried unanimously. III. ANDERSON REZONING CASE #2-62A January 17, 1962 The rezoning request is for R-3-B zoning; the area bounded by South Logan on the east, South Sherman on the west, East Kenyon on the south, and East Jefferson Drive on the north is presently zoned R-2-B. Pershing moved: Hill seconded: The hearing be opened. The motion carried unanimously. Mr. Koppel showed slides taken of the area. Charles M. Anderson 1861 South University -stated he owned property at 3649 South Grant, and that 17 property owners had signed the petition for rezoning of this area. Mrs. Margaret Cohrs 3650 South Grant St. -stated she had signed the petition, but had not been in favor of the request. Mr. V. A. Buckmaster 5175 South Elati Drive stated he had been a property owner in the area since 1953. He stated the character of the area has changed a very great deal since 1953, and he was very much in favor of the R-3-B zoning. Mr. Buckmaster's property is at 3630 South Grant Street. Mrs. Connors 3662 South Sherman -asked where parking would be provided for a multi-family development. She stated that at the present time, all occupants of basement apart- ments were parking their cars in the alleys. Mrs. Ross 3687 South Grant -stated she signed the petition, but did not favor the rezoning. Mr. Miller 3659 South Grant stated he was in favor of the rezoning. Mrs. Cohrs asked how Mr. Buckmaster planned to develop his property. Mr. Buckmaster replied that he was planning a modern medical building. Miles moved: Pershing seconded: The hearing be closed. The motion carried unanimously. Hill moved: Miles seconded: The matter be tabled for further consideration. The motion carried unanimously. IV. M.M. SUMMERS CASE #4-62 Miles moved: Kreiling seconded: The hearing be opened. The motion carried unanimously. Mrs. Romans gave a brief review of this case. The area is presently zoned R-1-B and is vacant. The area has 167 foot frontage on Grand and Belleview. It was up for rezoning in February, 1961; the request for R-3-A was not recommended to City Council by the Planning Commission. Pictures of the subject area were shown by Mr. Koppel. Mr. M. M. Summers stated he was representing Mr. Thompson, who had been a land owner in the area for a number of years. Mr. Summers presented members of the Commission with a sketch of the area. Mr. Summers stated they desired the zoning change to increase the value of the land; also, that they felt it impractical to develop the land as R-1-B with R-3-A zoning im- mediately to the east. Mr. Ken Root 5030 South Delaware -felt there was no need for additional multiple family development. It would place a burden on the school system. I I I I I Mr. Jim Sletten 5050 South Delaware Louis Berghauser Page 623 stated he had lived in the area for some time, and was opposed to the rezoning request. Berghauser Realty -stated he felt the City would be breaking faith with residents of the area to grant R-3-B zoning, inasmuch as the request for smaller lots on Delaware had been denied by the City Council in June, 1960. He cited an article from the Rocky Mountain News, which showed 27% of apartments in the Littleton area were vacant. Mr. Berghauser asked if there were any plans to extend Cherokee at this time. The Director pointed out that Cherokee between Grand and Belleview would provide access primarily to the development on the West side of Cherokee; the dedication would de- pend on the development of the area. Mr. Summers stated he had checked with people living across Grand and Belleview , and had met no objections. Hill moved: Miles seconded: The hearing be closed. The motion carried unanimously. NEW BUSINESS A. Park Elitch Case #5-62 The rezoning request made by the Park-Elitch Company is for a change of Zoning from R-1-D to M-1. Mr. Ray Ludwi g is the real tor, and Mr. Mark Shivers the attorney who filed their application. They are requesting a zoning hearing prior to the quarterly hearings in June. Miles moved: Hill seconded: That the Commission receive the rezoning request of the Park-Eli tch Company and proceed to post t he property and •publish for a hearing to be held April 5, 1962. The motion carried 'unanimously • . B. 4600 South Acoma Case #6-62 Mrs. Romans reported that Mr. Hill, who owns property in the 4600 block of South Acoma has contacted her office. Mr. Hill owns property 330 feet from Broadway west. He has said that if the City will initiate a rezoning for T-Zone, he will dedicate his portion of Acoma. Kreiling moved: Miles seconded: That the city initiate the rezoning of the 4400, 4500, 4600 , and 4700 blocks of South Acoma, the hearing to be held as soon as practicable. The motion 0arried unanimously. VI. OLD BUSINESS A. Jensen Subdivision Case #20-61G Mrs. Romans reported that all corrections had been made on the linen, and that all re- quirements have been met. Kreiling moved: Miles seconded: The matter of the Jensen Subdivision be raised fr om the table. The motion carried unanimously. Hill moved: Pershing seconded: The plat o f Jensen Subdivision, Third Filing, be accepted and referred to City Council. The motion carried unanimously. B. Carmel Park Subdivision Case #22-61D Mrs. Romans gave a brief review of the Carmel Park Subdivision. Mr. Walt Erwin has been hired as attorney for Peerless Builders. C. Walden Subdivision Case #3-62A February 8, 1962 Mrs. Romans reported that the preliminary plans Mr. Walden brought in had been submitted to the Engineer's Office. Brief discussion followed. DATE: SUBJECT: RECOMMENDATION: Hill moved: Pershing seconded: March 8, 1962 Approval of Jensen Subdivision, Third Filing. Welty Recording Secretary * * * * * * * * * * * * * * * * * * * ** * * * * * * * * * * * * * * * * * * * * * * * * ** CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION Minutes of March 16, 1962 SPECIAL SESSION The meeting was called to order at 12:15 P.M. by Chairman Rice. Members present: Kreiling, Love, Pershing, Rice Romans, Ex-officio Members absent: Hill, Miles Also present: Alan Koppel, Planning Assistant Lawrence Hazzard, Planning Aide Joseph W. Esch, City Attorney. I. A special meeting of the Plannirg Commission was called ~t the request of Chairman Rice to discuss with the City Attorney, Mr. Esch, and Mrs. Romans, the Planning Director, the status of the C-3 Ordinance and T-Zone since the ruling handed down by Judge Lee. It was the opinion of Mr. Esch that a public hearing should be held on these two ordinances as printed, by the Planning Commission for referral to the City Council for proper consideration. Love moved: Kreiling seconded: A public hearing be held on April 19, 1962, on the C-3 Ordinance, as printed, and that proper publication for such hearing be given. The motion carried unanimously. Love moved: Kreiling seconded: A public hearing be held on April 19, 1962, on the T-Zone Ordinance, as printed, and that proper publication for such hearing .be given. The motion carried unanimously. II. Mrs. Romans presented Commission members with a rezoning application filed by Mr. Don Franzmann for an R-2-B zone. Mr. Franzmann's request is for the five north lots on the east side of the 3200 block South Huron. The $2,000 needed to move the power poles is now in escrow, but Public Service Company has revused to move the poles until Mrs. Sigrid Franzmann's home is removed, as high voltage wires would then be over a dwelling. Mrs. Franzmann's house cannot be moved, according to Mr. Franzmann, until they receive an R-2-B zoning to construct a duplex for Mrs. Franzmann's residence. The Director suggested that, inasmuch as the people on the west side of Huron are interested in rezoning, that they be contacted and, if the rezoning request meets with their approval, include that area in the rezoning. The Director was instructed to make this contact and in- clude it if it met with approval. It was further suggested that in order to make a more logical zone pattern, the rezoning re- quest include both Block 1 and Block 2 of the Franzmann-Folkert Subdivision, rather than only a portion. This would, in effect, rezone both sides of the 3200 block of South Huron. This would include the three single-family homes, but they would be a permitted use in the R-2-B zone. Pershing moved: Love seconded: The date for the public hearing on the rezonirg request of the 3200 block South Huron made by Mr. Don Franzmann from R-1-D to R-2-B be set for April 19, 1962, and that proper publication be given, and the property posted.
