DATE: SUBJECT: RECOMMENDATION: Hill moved: Pershing seconded: March 8, 1962 Approval of Jensen Subdivision, Third Filing. Welty Recording Secretary * * * * * * * * * * * * * * * * * * * ** * * * * * * * * * * * * * * * * * * * * * * * * ** CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION Minutes of March 16, 1962 SPECIAL SESSION The meeting was called to order at 12:15 P.M. by Chairman Rice. Members present: Kreiling, Love, Pershing, Rice Romans, Ex-officio Members absent: Hill, Miles Also present: Alan Koppel, Planning Assistant Lawrence Hazzard, Planning Aide Joseph W. Esch, City Attorney. I. A special meeting of the Plannirg Commission was called ~t the request of Chairman Rice to discuss with the City Attorney, Mr. Esch, and Mrs. Romans, the Planning Director, the status of the C-3 Ordinance and T-Zone since the ruling handed down by Judge Lee. It was the opinion of Mr. Esch that a public hearing should be held on these two ordinances as printed, by the Planning Commission for referral to the City Council for proper consideration. Love moved: Kreiling seconded: A public hearing be held on April 19, 1962, on the C-3 Ordinance, as printed, and that proper publication for such hearing be given. The motion carried unanimously. II. Mrs. Romans presented Commission members with a rezoning application filed by Mr. Don Franzmann for an R-2-B zone. Mr. Franzmann's request is for the five north lots on the east side of the 3200 block South Huron. The $2,000 needed to move the power poles is now in escrow, but Public Service Company has revused to move the poles until Mrs. Sigrid Franzmann's home is removed, as high voltage wires would then be over a dwelling. Mrs. Franzmann's house cannot be moved, according to Mr. Franzmann, until they receive an R-2-B zoning to construct a duplex for Mrs. Franzmann's residence. The Director suggested that, inasmuch as the people on the west side of Huron are interested in rezoning, that they be contacted and, if the rezoning request meets with their approval, include that area in the rezoning. The Director was instructed to make this contact and in- clude it if it met with approval. It was further suggested that in order to make a more logical zone pattern, the rezoning re- quest include both Block 1 and Block 2 of the Franzmann-Folkert Subdivision, rather than only a portion. This would, in effect, rezone both sides of the 3200 block of South Huron. This would include the three single-family homes, but they would be a permitted use in the R-2-B zone. Pershing moved: Love seconded: The date for the public hearing on the rezonirg request of the 3200 block South Huron made by Mr. Don Franzmann from R-1-D to R-2-B be set for April 19, 1962, and that proper publication be given, and the property posted. The motion carried unanimously. I I I I I Page 625 III. A brief discussion was held on the Master Street Plan study being done by Mr. Hazzard. There was also discussion on the Master Plan in general. Mr. Koppel g ave Commission members copies of a section on recreation, which he had prepared. Brief discussion followed. The meeting adjourned at 1:30 P.M. Respectfully submitted, Gertrude G. Members present: Hill, Kreiling, Love , Miles, Rice Romans, Ex-officio Members absent: Pershing Also present: M. M. Summers, Walter Erwin I. APPROVAL OF MINUTES Miles moved: Kreiling seconded: The minutes of March 8 ·, 1962 be approved as .presented. The motion carried unanimously. The Chairman asked for ratification of the special meeting of the Planning Commission, Friday, March 16, 1962, at 12 :00 Noon in the Planning Department Office. On the call of the role, the following members stated they had received notification of the special meeting by the Secretary of the Planning Commission over the phone prior to the day of the special meeting: Hill, Kreiling, Love , Miles, Rice Absent: Pershing Miles moved: Kreiling seconded: The Minutes of March 16, 1962, be approved as presented. The motion carried unanimously. To ratify the procedure of the special meeting on March 16, 1962, the Commission agreed to reaffirm the action that had been taken. Love moved: Kreiling seconded: A Public Hearing be held on April 19, 1962, on the C-3 Ordinance, as printed, and that proper publication for such hearing be given. The motion carried unanimously. II. OLD BUSINESS A. Anderson Rezoning Case #2-62B Miles moved : Hill seconded: The matter of the Anderson rezoning request be removed from the table. / . The motion carried unanimously. A written summary of this case and a small map was passed to Commission members. The re- quest is for an R-3-B Zone. It is presently zoned R-2-B. It was pointed out that two of the proponents for the rezoning do not reside within the area and that several re s i d ent s ob- jected to the rezoning. Three persons stated they had signed the petition, but now wis hed to oppose the rezoning. It was pointed out by the Director that, on the basis of an extensive land use study com- pleted in January, 1962, only 11.3% of land zoned R-3 is developed satisfactorily as such .. It was also stated that should this area be rezoned, it would render most of the existing uses non-conforming, inasmuch as the sites would not meet frontage and area requirements of the R-3-B zone. The area under consideration is now well developed with newer structures. It would be rather expensive to tear down these structures in order that higher density units than are already permitted could be built.
