Members present: Hill, Kreiling, Love , Miles, Rice Romans, Ex-officio Members absent: Pershing Also present: M. M. Summers, Walter Erwin I. APPROVAL OF MINUTES Miles moved: Kreiling seconded: The minutes of March 8 ·, 1962 be approved as .presented. The motion carried unanimously. The Chairman asked for ratification of the special meeting of the Planning Commission, Friday, March 16, 1962, at 12 :00 Noon in the Planning Department Office. On the call of the role, the following members stated they had received notification of the special meeting by the Secretary of the Planning Commission over the phone prior to the day of the special meeting: Hill, Kreiling, Love , Miles, Rice Absent: Pershing Miles moved: Kreiling seconded: The Minutes of March 16, 1962, be approved as presented. The motion carried unanimously. To ratify the procedure of the special meeting on March 16, 1962, the Commission agreed to reaffirm the action that had been taken. Love moved: Kreiling seconded: A Public Hearing be held on April 19, 1962, on the C-3 Ordinance, as printed, and that proper publication for such hearing be given. The motion carried unanimously. Love moved: Kreiling seconded: A Public Hearing be held on the T-Zone Ordinance on April 19, 1962, as printed, and that proper publication for such hearing be given. The motion carried unanimously. II. OLD BUSINESS A. Anderson Rezoning Case #2-62B Miles moved : Hill seconded: The matter of the Anderson rezoning request be removed from the table. / . The motion carried unanimously. A written summary of this case and a small map was passed to Commission members. The re- quest is for an R-3-B Zone. It is presently zoned R-2-B. It was pointed out that two of the proponents for the rezoning do not reside within the area and that several re s i d ent s ob- jected to the rezoning. Three persons stated they had signed the petition, but now wis hed to oppose the rezoning. It was pointed out by the Director that, on the basis of an extensive land use study com- pleted in January, 1962, only 11.3% of land zoned R-3 is developed satisfactorily as such .. It was also stated that should this area be rezoned, it would render most of the existing uses non-conforming, inasmuch as the sites would not meet frontage and area requirements of the R-3-B zone. The area under consideration is now well developed with newer structures. It would be rather expensive to tear down these structures in order that higher density units than are already permitted could be built. Page 626 Miles moved: Love sec onded : That the rezoning request made by Mr. Anderson f or the rezoning of the area bounded by South Sherman on the west, East Jefferson Drive on the north, South Logan on the east, and East Kenyon on the south, be denied for the following reasons: 1. No clear indication of need has been shown. 2. The rezoning o f this area would render most o f the existing uses non-conforming, inasmuch as they would not meet fr onta ge and area requirements. 3. The subject area is well developed according to the present zone. The motion carried unanimously. B. Summers-Thompson Rezoning Case #4-62A Love moved: Kreiling seconded: The matter of the Summers rezoning case be removed fr om the table. The motion carried unanimously. The rezoning request for the area bounded by West Grand Avenue on the north; Cherokee Street extended on the east; West Belleview Avenue on the south; and by the South Cherokee-South Delaware alley, extended, on the west is for R-3-B. The present zoning is R-1-B. A brief written summary and map of the area was presented to Commission members. Mr. Hill stated he did not feel it wise to have R-3 zoning right against an R-1-B Zone. Mr. Hill felt there should be a bu ffer zone in this subject area. Hill moved: Miles seconded: The rezoning request made by Mr. Summers for R-3-B Zoning be denied because sufficient proof of need for additional R-3 zone in the City was not established by the applicant, and the high density zone would not be compatible with the adjacentR-1-B Zone area. The motion carried unanimously. C. Pleasant View Lane Case #l-62B This area is bounded by South Lowell Boulevard on the west, by South Irving Street on the east, and extends on either side of Pleasant View Lane to the present City limits. The rezoning request is for R-1-C. Kreiling moved: Love seconded: The matter be removed from the table. The motion carried unanimously. A brief discussion o f this case brought out the following points: 1. There is a possibility of a multi-family and commercial zoning to the north and west of this area due to the Fort Logan development. 2. No objection has been voiced by property owners within the subject area. 3. The zone would make possible a development compatible to adjacent area. Love moved: Miles seconded: The Planning Commission recommend to City Council that the rezoning re- quest for the area bounded by South Lowell Boulevard on the west, by South Irving Street on the east, and extending on either side of Pleasant View Lane to the present City limits for R-1-C zoning be granted. The motion carried unanimously. D. Carmel Park Subdivision Case #22-61E Mr. Walter Erwin, attorney for Peerless Builders, was present on behalf of his client. An improved preliminary plat was shown the Commission by the ?lanning Director. Mr. Erwin stated that the developer will dedicate a portion of South Acoma Street and West Grand Avenue in ex- change for that portion of South Bannock Street that is dedicated lying immediately west of Stander Subdivision being vacated. Hill moved: Love seconded: The Planning Commission approve the preliminary plat of Carmel Park sub- ject to utility easements being shown on the plat and the dedication of the portions of South Acoma and West Grand Avenue which Peerless Builders have title to. The motion carried unanimously. Hill moved: Love seconded: That the Planning Commission recommend to Council the vacation o f that portion of South Bannock Street extended that lies to the West of Stander Subdivision, and the utility easement that lies within the Stander Subdivision. Wherever any stream, irrigation ditch or another water course is located in a subdivision, the subdivider, at his expense, shall make provision according to specifications and s tandards established by the City for straightening or widening the channel to carry .th e surfa ce water and shall provide and re- serve easements along such streams, ditches and wa ter cour ses in such widths as determined by the City for the purpose of widening, improving , p rotec ting and maintaining same and for recreational purposes. The subdivider shall subm it a ny dat a, including plats of profiles and contours, designs, calculations, etc., which may ass is t the -City Engineer in the prepara- tion of any report required of him regarding drainage conditions in the proposed subdivision and any drainage facilitie s proposed by the subdivider to serve the subdivision. No ir- rigation ditches shall be permitted on public roads except where acquired by vested rights or where crossing publi c roads." . , Mr. Hill asked if the s creening strip should be shown on the plat also. Mrs. Romans replied that it was Mr. Esch's feeling that it should not be shown, as the City might be obligated to maintain it. Discussion followed; it was the feeling of the Commission the screening strip should be shown, not as a dedication to the City, but as an indication of location on the plat. Hill moved: Love seconded: The preliminary plat of Centennial Industrial Park be approved subject to the showing of the Brown Ditch and the 20 foot screening strip; the date for a hearing to be set upon receival of a proper plat. Franzmann Rezoning Case #7-62A Mrs. Romans stated the Planning Office has received permission to include the entire 3200 block of South .Huron in the rezoning . request made by Mr. Don Franzmann for R-2-B. III. NEW BUSINESS A. Alley Vacation Case #17-62 Mrs. Romans stated a request has been r ec eived for the vacation of the alley in Block 7, Jackson Broadway Heights. She stated a very complete study would be made of this area before.any action would be taken. B. Denver Board of Water Commissioners A letter from R. S. Millar for the Denver Board of Water Commissioners was read. It was asked that the letter be received and placed on file. C. Enforcement-of Zoning Ordinance. Mr. Kreiling felt the City Council's attention should be brought to the fact that, in some instances, the 1940 Zoning Ordinance is enforced rather than, the 1955 Ordinance, and that a blanket approval of such has been given by the Board of Adjustment and Appeals to the Building Inspector. Mr., Kreiling feit : if our 1955 Ordinance is inadequate, we should possibly discuss it with members of the Board and ask them for their suggestions. Discussion followed; Mr. Kreiling felt that a meeting with members of the City Council, Board of Adjustment, and Planning Commission should be called to discuss this matter. Kreiling moved: Love seconded: That a communication be sent from the Planning Office asking a meeting be set at the · earliest convenience for members of City Council, Board of Adjustment and the Planning Commission. APPROVAL OF MINUTES Hill moved: Pershing seconded: The Minutes of March 22 , 1962, be approved as printed. The motion carried unanimously. II. PARK-ELITCH CASE #5-62A Love moved: Hill seconded: The Public Hearing on the Park-Elitch rezoning be opened. The motion carried unanimously. A brief history of the case was given by the Director. • Notice was given in the Englewood Herald on March 19, 1962, and the property has been posted the required length of time. The following reasons were given for the rezoning request: "This property abutts M-1 Industrial property owned by the same owner. It is entirely un- suitable for development for any purpose other than industrial. There is no access or possible access to this parcel to permit resident type development. This is a request for an extension of an existing M-1 Industrial Zone. The City Ditch constitutes a natural barrier protecting other residential zones to the East. The property is presently under option contingent upon re-zoning for the immediate construction of industrial development which will benefit the City of Englewood from · a tax standpoint." Mr. Miles entered and took his place with the Commission members. Slides of the subject and surrounding area were shown. Mr. Mark Shivers stated he was the legal representative for Park-Elitch, but that Mr. Ray Ludwig has been in closer contact with the applicant as their realtor. Mr. Ludwig stated that Colonel Danks owned five (5) acres immediately to the north of the two (2) acres under consideration for rezoning to ·M-1, and that in discussion with Colonel Danks' son, it was indicated that they would have no objection to the rezoning. The Park-Elitch Company in- tends to construct a street running east from Santa Fe and dedicate same to the City . This will be the only ingress-egress to this property. The eastern 1 /2 of the property is planned for immediate development. Mr. James D. Uhlman presented the Commission with a petition signed by 36 resident s in the area opposing the rezoning request. The following reasons were cited by Mr. Uhlma n: (1) If said property ·were rezoned, it would create a ha ~dship on the undersigned property owners by lessening the value of property in the vicinity, which is zoned p re dominately R-1-B. (2) The proposed rezoning would be in opposition to the objectives of the recen t c ity-wide rezoning, whereby a buffer zone of R-1-D or R-2 zoning was placed between R-1-A or R-1-B, and industrial a reas, wherever possible.
