Stander Subdivision, and the utility easement that lies within the
Stander Subdivision.

REGULAR SESSION
The meeting was called to order at 8:10 P.M., Chairman Rice presiding.

I. APPROVAL OF MINUTES
Hill moved:
Pershing seconded: The Minutes of March 22 , 1962, be approved as printed.
The motion carried unanimously.
II. PARK-ELITCH CASE #5-62A
Love moved:
Hill seconded: The Public Hearing on the Park-Elitch rezoning be opened.
The motion carried unanimously.
A brief history of the case was given by the Director. • Notice was given in the Englewood
Herald on March 19, 1962, and the property has been posted the required length of time.
The following reasons were given for the rezoning request:
"This property abutts M-1 Industrial property owned by the same owner. It is entirely un-
suitable for development for any purpose other than industrial. There is no access or
possible access to this parcel to permit resident type development. This is a request for
an extension of an existing M-1 Industrial Zone. The City Ditch constitutes a natural
barrier protecting other residential zones to the East. The property is presently under
option contingent upon re-zoning for the immediate construction of industrial development
which will benefit the City of Englewood from · a tax standpoint."
Mr. Miles entered and took his place with the Commission members.
Slides of the subject and surrounding area were shown.
Mr. Mark Shivers stated he was the legal representative for Park-Elitch, but that Mr. Ray
Ludwig has been in closer contact with the applicant as their realtor. Mr. Ludwig stated
that Colonel Danks owned five (5) acres immediately to the north of the two (2) acres under
consideration for rezoning to ·M-1, and that in discussion with Colonel Danks' son, it was
indicated that they would have no objection to the rezoning. The Park-Elitch Company in-
tends to construct a street running east from Santa Fe and dedicate same to the City . This
will be the only ingress-egress to this property. The eastern 1 /2 of the property is planned
for immediate development.
Mr. James D. Uhlman presented the Commission with a petition signed by 36 resident s in the
area opposing the rezoning request. The following reasons were cited by Mr. Uhlma n:
(1) If said property ·were rezoned, it would create a ha ~dship on the undersigned property
owners by lessening the value of property in the vicinity, which is zoned p re dominately
R-1-B.
(2) The proposed rezoning would be in opposition to the objectives of the recen t c ity-wide
rezoning, whereby a buffer zone of R-1-D or R-2 zoning was placed between R-1-A or
R-1-B, and industrial a reas, wherever possible.

(3) We believe that rezoning is unnecessary to insure the future development of this plot
as, at the present, it adjoins residences on two sides, and residential construction is pro-
ceding immediately adjacent.
Mr. Uhlman further stated the petition represented 87 % of the property owners within 500
feet; and 100% of the people contacted.
Mr. Ludwig emphasized that the subject land could not be developed as single family and that
the only access would be from Santa Fe.
Mr. Shivers stated that in order to · extend West Stanford across the City Ditch, an inverted
syphon would have to be used. Mr. Shivers doubted that Denver would · permit this.
Mr . Uhlman felt a street dedication of Mariposa or Lipan would give adequate access to the
area from the north and west.

Hill seconded: The public hearing be closed.
The motion carried unanimously.
Miles moved:
Love seconded: The matter of the Park-Elitch rezoning request be tabled for further
study.

III. CARMEL PARK SUBDIVISION CASE #22-61F
Love moved:
Hill seconded: The public hearing be opened.
The motion carried unanimously.
Mrs. Romans stated that registered letters had been sent to adjoining property owners
notifying them of the public hearing. The final plats have been sent to the various City
Departments and utility companies. The Telephone Company has requested an easement on the
west side of this proposed subdivision, and the Public Service Company has requested one on
the west and the south side. To date, five building permits have been issued.
Mr. Hill asked if there was any possibility of having 1 /2 of Cherokee Street dedicated. Mr.
Erwin stated that previous attempts have been made to put a street , through and in his opinion
the owner to the west had been uncooperative. He pointed out also, that in his opinion,
Mr. Thompson owns 167' of land and can dedicate his own street and . it will not be a detriment
to future development of his land.
Mr. Summers stated he represented Mr. Thompson, owner of the land immediately to the \\est of
proposed Carmel Park. Mr. Thompson would have to dedicate a full 60 foot street which would
leave only 107 feet for development. Mr. Summers felt this would injure Mr. Thompson's
chances for development of his land. He further stated that Mr. Thompson has never "refused"
to dedicate his portion of Cherokee; that at the time a dedication was attempted, both sites
were undeveloped and he "could see no need to give land for street purposes". Mr. Summers
pointed out that the 30 foot entrance ways provided by Peerless Builders are not dedicated
to the City. On behalf of his client, Mr.Summers asked that approval of Carmel Park Sub-
division be withheld until Peerless Builders gives 30 feet for street.
Mr. Erwin felt that 50 feet for a street would be adequate as the street would be but one
block long. He saw no reason the plat could not be accepted. Mr. Erwin pointed out that
the plans have been developed around the present ordinances and the City Attorney's ruling.
Kreiling moved:
Love seconded: The public hearing be closed.
The motion carried unanimously.
Mr. Rice stated he felt the developer should contact the utilities companies to get the
matter of the required easements solidified before the Planning Commission recommends approval.
Love moved: The Planning Commission request the subdivider to present a letter of
agreement· with the utilities companies and that the required easements
be shown on the subdivision plat.
Mr. Erwin stated that a letter of agreement would be obtained and •presented to the Commiss:i:n.
Mr. Love withdrew his former motion.
Love moved:
Hill seconded: The matter be tabled until proper evidence of agreement is presented.
The motion carried unanimously.

IV. OLD BUSINESS
A. M~s. Romans reported that the proposed meeting with the City Council, Board of Adjustment,
and Planning Commission had tentatively been set for April 23, 1962. Mr. Love and Mr.
Kreiling stated they could not attend a meeting that evening. After brief discussion, it was
the Commission's decision to ask Council to "consider May 14 as a possible meeting date.
B. Planning Commission members were reminded of the forthcoming hearings on April 19, 1962.
The T-Zone, the C-3 Ordinance and the Framzmann-Folkert rezoning request are scheduled to be
heard that evening.

C. A brief discussion on progress on the Master Plan followed. Mrs. Romans displayed
several maps and overlays to be used for the sections of the Master Plan.
Kreiling moved:
Hill seconded: The map to be used in the Master Plan for the Parks section be
approved.
The motion carried unanimously.
The Director .presented proposed street plan maps and traffic maps. Discussion ensued.
There was considerable discussion on the ramp fr om Highway #70 to Broadway, and the possible
elimination of left turns at Bannock and the Highway.
D. Commission members were reminded of the weekly work sessions held every Saturday morning.
E. Park-Elitch Rezoning Case #5-62B
Miles moved:
Love seconded: Inasmuch as .other considerations had not taken as much time as had
been anticipated and that the meeting on April 19th would be a long
one , the matter of the Park-Elitch rezoning be rem oved from the table.
The motion carried unanimously.

Kreiling seconded:
Discussion followed.
The rezoning request made by Park-Elitch for change from R-1-D to M-1
be granted.
