The regular meeting of the City Planning and Zoning Commission was called to order at 8:10
P.M. by Chairman Rice.
Members present: Kreiling; Love; Miles; Pershing; Rice
Romans, Ex-officio

I. APPROVAL OF MINUTES.
MILES MOVED:
PERSHING SECONDED: The Minutes of April 19 , 1962, be approved as presented.
The motion carried un animously .
II. CENTENNIAL INDUSTRIAL PARK
Area Northeast of Federal-
West Union Intersection.

LOVE MOVED:
MILES SECONDED: The public hearing on the Centennial Industrial Park Subdivision be
opened.
The motion carried unanimously.
The Planning Director stated proper notification by registered mail had been given to
immediately adjoining property owners. The area was indicated on the map. The eastern
line o f the proposed subdivision is the Public Service easement which runs through Mr.
Adams property. Preliminary plats were sent to City departments and Utility companies
concerned. Two corrections or suggestions had been noted on these plats: (1) That a 16'
easement rather than the center line be shown for the Valley Sanitation Sewer Line; and
(2) the street running east and west be designated as West Tufts rather than West Stanford.
Mr. Raymond Turner
Attorney for Mrs. Weeks -stated Mrs. Weeks owned land north and east of Mr. Adams'
property, and water rights from Chenango Avenue on Federal.
Mr. Turner stated that a 30' ditch easement is necessary to
allow a 27" or 54" conduit which Mr. Wright, Engineer for Mrs.
Weeks, has stated is needed. Also, Mr. Turner's client objects
to the screening strip being set in the same easement, as roots
from the trees might get in the pipe.
Mrs. Romans stated that City Attorney Esch and Assistant City Engineer Barde have said
that in their opinion , a 20' easement is adequate.
Discussion followed; it was stated that the flow of the ditch is 16-1/2 second feet; Mrs.
Weeks owns 2-3 /4 second feet and Tri-City Trust owns the remainder.
Mr. Turner suggested the existing ditch be shown on the plat.
MILES MOVED:
LOVE SECONDED: The hearing be closed.
The motion carried unanimously.
LOVE MOVED:
MILES SECONDED: The final plat of Centennial Industrial Park be approved with the follow-
ing corrections: (1) a 16' easement be shown rather than the center
line of the Valley Sanitation Sewer Line. (2) The street name be
changed from West Stanford to West Tufts. (3) The present location
of the Brown Ditch, as in abstract, be shown on the plat; or the
location to be negotiated and shown on plat.
The motion carried unanimously.
III. SULLIVAN DEVELOPMENT 4100 SOUTH HURON
A brief review was given of this case. The Planning Commission has been working with
developers of this area since 1957 and 1958. At that time, the street dedication was part
of the City Ditch. When Mr. Sullivan purchased this property, the street was vacated and
re-dedicated to give access to one building site. Now, they desire another building site,
and wish to vacate a portion o f the cul-de-sac and re-dedicate it to gi ve required access.
This area is in an R-1-D zone and has the required square footage for two building sites.
Mr. Terry
4117 South Galapago -stated that he, Mr. Paul , and Mr. Marshall own property adjoining the
subject property. They do not feel there is enough ground to accommo-
date houses that are comparable to theirs, which they were promised.
It was stated there is no alley; however, a 16' easement does exist. Mr. Terry felt the
the houses that had been moved into the area by Mr. Buckmaster and Mr. Hepler were de-
preciating the valuation of their property; the houses were small cinder block construction
and there were two families living in one of these houses. Mr. Terry also stated he had
been informed that the street would have to be widened by five feet.

It was pointed out that the City has no control over the types of construction, only on the
lot area and the lot coverage.
MILES MOVED:
LOVE SECONDED: The matter be tabled until such time as further information and verification
o f questions has been obtained.
The motion carried unanimously.
IV. NEW BUSINESS
A. Street Dedication in 4000 Block South Kalamath.
Mr . Joyce Williams stated that he was owner of property in the 4000 block of South
Ka1amath. The street has not been dedicated, but there is curbing on one side. The
street has recently been closed to travel, but has not been posted as private property.
Mr. Williams feels the street should be opened as soon as possible, as this is in a
rapidly developing industrial area. Mr. Williams further stated that, though Nassau
has been dedicated, it has not been developed. He feels that one of these streets
should definitely be developed. It was also pointed out that previous attempts to
dedicate Kalamath have not proven successful.
LOVE MOVED:
MILES SECONDED: The Planning Commission recommend to the City administration that
the Sealtest Corporation and other property owners be approached
in an attempt to gain full dedication of the 4000 block of South
Kalamath; that if Kalamath is not dedicated, that West Nassau be
opened and developed west to Santa Fe Lane.
The motion carried unanimously.
A recess was called at 9:50 P.M.
The meeting was called to order at 10 P. M.
V. DATE FOR QUARTERLY REZONING HEARINGS
There are three rezoning hearings scheduled for the next quarterly hearing. Requests are
for M-1 from R-1-D ; R-3 from R-2-A; and T from R-1-D.

MILES SECONDED: The hearing date be set for July 5, 1962.
The motion carried unanimously.
VI. PROCEDURE MANUAL
Commission members were given a c o mpleted preliminary copy of the Procedure Manual, which is
being compiled by the Planning Office f or the Planning Commission. This manual has been
compiled from State Statute, City Charter and resolutions from Planning Commission and City
Council minutes.
After a brief discussion on the fee for rezoning applications, the Commission approved a $50
rezoning fee to be filed with the application.
A discussion followed on the requirements for rezoning applications. Mr. Love suggested
the fo llowing:
"The area must complete at least one city block of compatible zone classification or must
consist of at least one city block and be contiguous to like or compatible zoning classifica-
tion."
The Commission agreed to discuss it at the meeting May 14 with the Board of Adjustment and
Appeals and the City Council.
In a brief discussion of the Subdivision portion o f the Manual, City Manager Dial suggested
that the Commission write in the requirement that the subdivider bring in certificates of
ownership of adjoining property owners.
Brief discussion followed.

The motion carried unanimously, and the meeting was declared adjourned at 11:55 P.M.

RECOMMENDATION: •

MILES SECONDED: The Planning Commission recommend to the City administration that the
Sealtest Corporation and other property owners be approached in an
attempt to gain full dedication of the 4000 block of South Kalamath;
that if Kalamath is not dedicated that West Nassau be opened and

II. J. A. TOWNE ALLEY VACATION
Block 1, Higgins
Englewood Gardens
CASE #13 -62
Mr. J. A. Towne stated he represented 65% of the property owners in this block who were
requesting that this alley be vacated. Mr. Towne felt it would be to the advantage of the
property owners to have this alley vacated, inasmuch as only 60 feet of the present dedica-
tion has ever been used. There are no rear access garages dependent upon this alley and it
is not being used for deliveries to the commercial property fronting on Hampden. Mr. Towne
stated that no persons contacted refused to sign the petition.
HILL MOVED:
KREILING SECONDED: The Planning Commission recommend to City Council that the alley
in Block 1, Higgins Englewood Gardens, be vacated; and that letters
be sent to property owners notifying them of such vacation by the
Planning Director.
The motion carried unanimously.
III. HARRY HUMPHRIES DEVELOPMENT IN 3100 SOUTH GALAPAGO
Mr. Harry Humphries stated that he owned property in the 3100 block of South Galapago and
wished to develop the area into a nice industrial park. Mr. Humphries stated his property
had 82-1/2 f oot frontage on Dartm outh ; there is an existing 30 foot dedication for Galapago,
dedicated at the time the Corder Subdivision was accepted, on the east side, but 30 foot
more is needed to develop the street to meet the requirements for streets in an 'M-1 zone.
Mr. Humphries asked if a street width of less than 60 feet would be approved by the Com-
mission.
Discussion f ollowed; it was the feeling of the Commission that a 60 foot minimum width
street should be required in the 3100 block South Galapago. No acti on was taken.
