DATE: July 5, 1962 SUBJECT: Approval of Flood Rezoning Request RECOMMENDATION: The Planning Commission recommend to City Council the rezoning request submit t ed by Mr. Dale Flood for the area bounded by South Clarkson on the west, South Emerson on the east, and the c,2 Zoning on East Hampden on the north, and Colorado Highway #70 on the south, from R-1-D to R-2-B be approved. Welty Recording Se.cretary * * * * * * * * * * * * * * * * * * * * * * * * * * * * '* * * * * * * * * * * * * * * * * CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION Minutes of July 19, 1962 The meeting was called to order at 8:10 P.M. by Chairman Rice. It was stated by Mr. Rice that the Commission was a citizens' advisory committee, appointed by the City Council. The Commission makes recommendations to Council, but their recommendations are not binding upon the Council. Members present: Kreiling, Love, Pershing, Rice Romans, Ex-Officio Members absent: Hill, Miles I. APPROVAL OF MINUTES. Kreiling moved: Pershing seconded: The Minutes of July 5, 1962 , be approved, with the following addition to Section VIII, Page 7: "The Planning Commission recommend to City Council that East Eastman P lace, from Downing to Lafayette, be vacated; [that South Marion Street , from the southerly line of the proposed cul-de-sac to the point of intersection with East Eastman Place, be vacated]." The motion carried unanimously. II. E. J. SHAFFER Area immediately east of Kinney's Shoe Store on South Broadway at East Chenango Avenue. Love moved: -----,- REZONING R-1-C to C-2 Kreiling seconded: The public hearing on the Shaffer rezoning be opened. The motion carried unanimously. CASE #20-62 Page 652 The Planning Director gave a brief review of the case. The Public Notice was given in the Englewood Herald on July 2, 1962. The area has been posted. A rezoning request for R-3-A was denied by the Conunission in September, 1961. The Chairman asked for the proponents of this rezoning. There were none present. man then asked for the opponents to the rezoning request. There were none present. Love moved: Kreiling seconded: The public hearing be closed. The motion carried unanimously. Kreiling moved: Love seconded: The matter of the rezoning request made by E. J. Shaffer be tabled. The motion carried unanimously. -------.. The Chair- III. THOMPSON REZONING R-1-B to T CASE #21-62 Area between West Grand Avenue and West Belleview Avenue; South Cherokee extended and the South Cherokee-South Delaware Alley. Love moved: Pershing seconded: The public hearing on the Thompson rezoning request be opened. The motion carried unanimously. The Planning Director stated the public notice was given in the Englewood Herald July 2, 1962. The area has been posted. Mr. M. M. Summers, agent for Mr. and Mrs. Thompson, stated that the area had been considered for rezoning on two previous occasions. At those times, an R-3 zoning was requested, but was not granted. Mr. Summers stated he felt this was an ideal place for a T zone, as there is an apartment complex within 15 feet of Mr. Thompson's property line. He questioned whether an R-3 in Mr. Thompson's front yard would be more objectionable than a T zone in the back yard of the residents on the east side of 5000 block South Delaware. He pointed out that in the T zone the height is restricted; there can be no merchandising; and screening must be pro- vided for a non-residential use. He felt there would be less noise from a T zone tha a strictly residential area. Mr. Summers further felt the T zone would double the value of Mr. and Mrs. Thompson's land. Mr. Thompson stated he had lived there 27 years; he did not like the idea of the "other f e llow being helped and he being cut off"; he stated he would have to furnish the full 60 foot street and it would depreciate his property. Jim Sletten 5050 South Delaware -stated he was opposed to ' the T zone. He felt such would devaluate his property. Louis Canjilla 5000 South Delaware -stated that with a 60 foot roadway, it would separate the R-3-A complex from Mr. Thompson's land by 75 feet. He did not like the provision in the T zone for social clubs, as he felt bars would be in these clubs. Mr. Canjilla stated he was opposed to the change of zoning. Mr. Summers stated he did not feel that "clubs". and "bars" were synonomous; and added that Mr. Thompson's property value loss would be $18,000 were the T zone to be denied. Mr. Good 5090 South Delaware -stated he was opposed to the T zone request. Mr. Breene 5080 South Delaware -stated he was opposed to the T zone request. Kreiling moved: Love seconded: The public hearing be closed. The motion carried unanimously. Love moved: Kreiling seconded: The matter of the Thompson rezoning request be tabled. The motion carried unanimously. IV. JAMES MARKS Area between West Bellewood Drive and west Belleview Avenue; South Federal and the South Federal-South Grove alley. Love moved: ZONING C-2 Pershing seconded: The public hearing on the Marks rezoning request be opened. The motion carried unanimously. CASE #18-62 The Director stated the Public notice had been published July 2, 1962. The area has been posted. I I I I I Page 653 Mr. Dale 5034 South Grove -asked why the area needed to be rezoned, as it had been zoned for business in the County. It was explained to Mr. Dale that when the area was annexed to Englewood, it came in as R-1-A; therefore, the present commercial uses were non-conforming. The C-2 zoning would not change the character of the area, and would make all existing uses conforming. Pictures of the subject and surrounding area were shown. It was noted that there is no alley between the residential and commercial areas. Mr. Ronnestad 5054 South Grove -stated he wanted a higher fence separating the residential area from the commercial area. He said the existing fence was only 6 feet high; and stated he desired a fence 8 or 9 feet in height. Mr. Ronnestad feared the drive-in directly behind his property, would tend to depreciate the value of his property. Mr. Dale 5034 South Grove -asked why the fence had been discontinued. Mr. Marks stated they were negotiating with other bus~ness owners in the block to erect the fence the full length of the block, but the owner must pay for the fence running behind his property. Pershing moved: Love seconded: The hearing be closed. The motion carried unanimously. Love moved: Kreiling seconded: The matter of the Marks zoning request be · tabled. The motion carried unanimously. V. PLANNING COMMISSION 4400, 4500, 4600, and 4700 Blocks South Acoma Street Kreiling moved: I REZONING R-1-D to T Love seconded: The public hearing be opened. The motion carried unanimously. CASE #6-62 The public notice was published in the Englewood Herald on July 2, 1962, and the property was properly posted. A resume of the ~ase was given. It was explained that the Planning Commission had initiated the change of zone from R-1-D to T zone after several persons had indicated that they felt the single family zone was rather restrictive. The intent of the T zone was explained. Slides of the subject and surrounding area were shown. The Director stated the T zone, if recommended, would not make any of the existing uses non-conforming. It was also pointed out that the Commission may recommend a change in whole or in part. Chairman Rice stated discussion would be by the block. 4400 Block South Acoma There were no persons present who wished to speak for the rezoning. Mr. W. Fischbach 4425 South Acoma -asked what the T zone would do to the taxes, and how long was this area going to remain T zone? Mr. Rice stated the taxes are based upon the development of the land, not the zone; and that the Commission has no intention of changing any zone classifications except where it would be feasible. A standing vote was called for --the results were nine (9) persons in the 4400 block South Acoma for the rezoning; five (5) against. 4500 Block South Acoma There were no persons present who wished to speak in favor o f this rezoning. Mr. Tully,4564 South Bannock -stated that he saw no need for the T zone as the area was fully .developed. Mr. Bard 4540 South Bannock -stated he felt as Mr. Tully did; there was no need, and he was opposed. Mr. Holland 4525 South Acoma -stated he was opposed; he further felt the area had been improperly posted, even though there were two signs in every block. Mr. Lukezic 4548 South Bannock -stated the area was developed with good houses, and he didn't want the possibility of Dr's offices, etc. going in; he stated he was opposed. Page 654 Robert Craig 4556 South Acoma -said people knew the property abutted a commercial area when they moved there. He is opposed to the T zone. Mrs. Collier 4443 South Acoma -asked if one block could go T zone, or if it all had to. Mr. Rice reminded the audience the Commission could recommend changed in whole or in part. Mrs. Paul Johnson 4524 South Acoma -stated she was opposed to the rezoning change. Mrs. George Bury 4506 South Bannock -said she was opposed. Mr. Hegna 4581 South Acoma -said he was opposed to the requested change. Lida Shuster 4542 South Acoma -said she was opposed. A standing vote was taken. No persons present were for the requested change. There were nine (9) residents on Acoma opposed; there were eleven (11) on Bannock opposed. 4600 Block South Acoma Mr. Hill stated he owned property in this block to four it dedicated. He did not feel he needed to do anything classification in which he could develop his property. block on South Acoma is rezoned to T (Transitional) he Acoma that has not been dedicated. Chet Caldwell feet the other side of Acoma, were about the street until he got a zone Mr. Hill stated that if the 4600 will dedicate that portion of South 4631 South Acoma -stated he lived directly across from Hill's property and owns the ·property adjoining Mr. Hill's property on Acoma; he cannot develop his property un- til he gets frontage. He felt a street was needed, but did not know at this time whether he was for or against the rezoning. Mrs. Walitello 4650 South Acoma -asked Mr. Hill's intention for development of his property if the T zone were adopted. Mr. Hill replied he intended to have parking. Mr. Williams 4621 South Acoma -said everyone else in the block had to dedicate their portion of the street and asked why Hill didn't have to. Mr. Johnson 4601 South Acoma -asked if the area would be screened from the front or open. He felt the proper zone classification should be R-2, rather than T. He stated he didn't want private clubs in the area. Mr. Johnson wanted to go on record as being opposed to the rezoning. Mr. G. Worth 4611 South Acoma -stated he felt the "junk yards" condition was the fault of the City. A standing vote was taken on the proposed zone change. There was one person for the rezoning and eight (8) persons against it. 4700 Block South Acoma There were no persons present who wished to speak for the rezoning. Richard Zugschwerdt 4787 South Acoma -stated he was against the rezoning. A standing vote was taken. Seven (7) persons stood as being in favor of the rezoning. One (1) stood as being opposed. Love moved: Kreiling seconded: The public hearing be closed. 1' The motion carried unanimously. Kreiling moved: Pershing seconded: The matter be tabled for further consideration. The motion carried unanimously. A recess was called at 10:30 P.M. The meeting was called to order at 10:40 P.M. by Chairman Rice. VI. SHAFFER Area immediately east of Kinney's Shoe Store on South Broadway at East Chenango Avenue. REZONING CASE #20-62A R-1-C to C-2 Mr. E. J. Shaffer stated that he and a group of seven or eight people had gone to the City Hall by mistake. Mr. Shaffer said he did not believe anyone in the group was in opposition to his rezoning request. Kreiling moved: Love seconded: The matter be removed from the table. The motion carried unanimously. I I I I I I Page 655 Brief discussion followed. Kreiling moved: Love seconded: The Planning Conunission reconunend to City Council the rezoning of the area inunediately east of Kinney's Shoe Store, 4900 South Broadway, be- tween the Broadway-Lincoln alley and Lincoln projected, and fronting on Chenango, from R-1-D to C-2, and that simultaneous consideration be given to the access as proposed by Mr. Shaffer. The motion carried unanimously. Mr. Love advised Mr. Shaffer to appear before City Council with the proper deeds for the dedication of the 20' alley to the east of his property. Love moved: Kreiling seconded: The Planning Conunission reconunend to City Council that the portion of the existing Broadway-Lincoln alley in the 4900 block south, be vacated and the deed from Mr. Shaffer for a 20' alley running the length of his property on the east be accepted. The motion carried unanimously. VII . OLD BUSINESS A. Leonard Bounded by South Elati Street on the West ; West Ithica Avenue on the So.; South Delaware -So. Cherokee Alley on the East; and the Commercial zoning on Hampden on the North. Love moved: Rezoning R-2-A to R-3-B Pershing seconded: The matter be raised from the table. The motion car r ied unanimously. Case #12-62B Discussion followed. Mr. Leonard reiterated bis feelings that this would be a good apartment area. Mr. Rice reported on a study of apartment vacancies; nearer the core area, the rate of vacancies seems to be lower , but farther away f rom the core area, the vacancy rate tends to be high. Mr. Rice further stated he was basically against zoning an additional area R-3; but f elt this area was conducive to apartments, whether in an R-2 or R-3 zone. Discussion ensued; Mr. Love felt Mr. Leonard should presen t additional information to the Commission showing proof of need and the probable development of this area. Love moved: Kreiling seconded: The matter be tabled pending presentation of additional information by Mr. Leonard. The motion carried unanimously. B. Cununings Land located South of West Tufts Avenue, bordering the Englewood reservoir on the South , lying just East of South Pecos Street and West of the City Ditch. Rezoning R-1-D to M-1 Case #ll-62B Mrs. Romans reported a meeting of the property owners in the area had been set f or July 24th with the Arapahoe County Planning Commission. C. James Marks Area between West Bellewood Drive and West Belleview Ave.; South Federal and the South Federal- South Grove alley. Love moved: Zoning C-2 Case #18-62A Kreiling seconded: The matter of the Marks zoning be raised from the table. The motion carried unanimously. Discussion ensued. Page 656 Love moved: Kreiling seconded: The Planning Commission recommend to City Council the area between West Bellewood Drive and West Belleview Avenue; the South Federal Boulevard- South Grove alley and South Federal Boulevard be zoned C-2 , inasmuch as the area is now developed by uses permitted in this zone classification.
