DATE: October 4, 1962 SUBJECT: Partial Approval o f Rezoning Request RECOMMENDATION: The Planning Commission recommend to City Council that Lots 3, 4, 5, 6, and 7, Belle Isle Gardens, Third Filing, be rezoned from R-1-D to M-1, and that no action be taken on the remaining land included in the re- quest until such time as provisions are made in the Zoning Ordinance to require screening in an Industrial Zone if the development is adjacent to an existing residential use. Welty Recording Secretary * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION Minutes of October 18, 1962 The Regular Session of the Englewood Planning and Zoning Commission was called to orde r at 8:00 P.M. by Vice-Chairman Pershing. Members present: Hill; Kreiling; Love; Miles; Pershing Members absent: Rice; Romans, Ex-officio Also present: Assistant Director Hess I. APPROVAL OF MINUTES Miles moved: Hill seconded: The minutes of Octobe r 4, 1962 be approved as presented. The motion carried unanimously. II. PLEASANT VIEW RE-SUBDIVISION Fred Walden Kreiling moved: Miles seconded: The Public Hearing be opened . The motion carried unanimously. CASE #3-62I Mr. Hess gave a brief summary of the proposed re-subdivision. The Final Plat was filed with the Commission on October 4, 1962 . A Pµblic Hearing date was set at that time and notices had been mailed, by registered mail, to all property owners within the proposed re-subdivision and to owners of adjoining property. Sta.ff review of the proposed re-subdivision revealed a few additions and changes to be made on the plat. Mr. Nicholls had met with Mr. Hess and had discussed these changes and additions, and has made the necessary corrections on the Plat. Mr. Hess pointed out the fact that the Subdividers have not yet complied with two requirements: 1. The City Attorney has stated that the names of holders of Trust on the properties be given on the Plat. 2 . A Performance Bond of $50,000 dollars has not been posted for the installation of curb, gutter, etc. Mr. Harry Carleno stated he had assisted with the annexation of this area. A zoning request f o r R-2 was denied by the Commission, but the area was subsequently zoned R-1-C. He stated he was now representing the property owners in their attempt to subdivide the area. Mr. Carlena filed with the Commission an original and three copies of "Addendum to Plat o f Pleasant View Subdivision, Second Filing, Dated October 2, 1962", listing the owners of Trust on the properties. Mr. Carlena stated the builder, Mr. London, has contracts for all the property but Block 5. Mr. Browning, the owner of Block 5, has indicated a desire to develqJ his property himself. Mr. Carleno presented a proposal on the Performance Bond , whereby Mr. London would post a Bond of $6500 as development for each block began. Mr. Browning has said he would post similar Bond f or the development of his property. Brief discussion among the Commission ensued. Mr. Pershing asked if there was any one present in opposition . I· I I I I I Page 679 Mr. E. W. Greiner 3315 W. Pimlico -stated the people in the Trumac Subdivision feel the frontages on the lots are too small. Also, the lots adjoining the Trumac Subdivision have a 16 foot easement. Mr. Greiner pointed out that this would leave 44 feet on which to build and ' that setbacks would have to be met. He did not feel this would accommodate a house to be erected that would be comparable to the homes in the adjoining area. Mr. Greiner was also concerned about the drainage problem, as their property is considerably lower than that in the Pleasant View Subdivision , and they are frequently flooded in the summer. Mr. Jack Cooley 3305 W. Pimlico -stated he owned Lot 12 of Trumac Subdivision and stated he had had the basement of his house flooded; it had been a necessity to have the window wells raised; and he had had 6 inches of water running through his garage. Mr. Cooley stated the problem would be worse with blacktopped streets and asked if the drainage system would be an open ditch, and how deep the ditch would be. Mr. Cooley was told this would be a matter for study by the City Engineer's Department. Mr. M. C. Smith 3325 W. Pimlico -stated he was also concerned about the drainage problem. Mrs . Grace Cary Cary & Peck Realtors -stated that some of the houses would be custom built, and pointed out that two contracts for sale had been made for Mr. Browning's property; each development would have 90 foot frontage and the houses to be built would sell for approximately $28,000. Miles moved: Hill seconded:. The Public Hearing be closed. The motion carried unanimously. Love moved: Hill seconded: The Planning Commission support the procedure of posting the Performance Bond as outlined by Mr. Carleno; and recommend to Council that the Pleasant View Subdivision Second Filing be approved, subject to approval of supplementary documents by the City Attorney and the receival of the desired drainage information from the City Engineer's Office. The motion carried unanimously. - - - - - - - - - - - -I III. NEW BUSINESS Mr. Hill stated that he had been contacted by Mr. Summers about the possibility of the Commission initiating an R-2 zoning on the property bounded by West Grand on the North; South Cherokee extended on the East ; West Belleview on the South ; and the South Cherokee- South Delaware alley on the West. Previous attempts to have the area zoned R-3 and T have been denied by the City Council. Discussion ensued. Hill moved: Love seconded: The Planning Director be asked to study the aforesaid area , and if it is determined feasible for the Commission to initiate the R-2 zoning, to give a recommendation to the Commission in time to enable the Planning Commission to comply with the posting and publishing requirements prior to the next quarterly zoning hearings in December, 1962. The motion carried unanimously. There being no further business to come before the Englewood Planning and Zoning Commission , the meeting was declared adjourned at 9:30 P.M. Welty Recording Secretary - - -- -- --- -- Page 680 MEMORANDUM TO THE ENGLEWOOD CITY ENGINEERS DEPARTMENT REGARDING ACTION OR RECOMMENDATION .OF THE CITY PLANNING AND ZONING COMMISSION DATE: October 18 , 1962 SUBJECT: Pleasant .View Subdivision, Second Filing. At the regular session of the Englewood Planning and Zoning Commission , on October 18, 1962, a Public Hearing on the proposed re-subdivision of Pleasant View Subdivision was held. Residents of the Trumac Subdivision are concerned about the drainage problem in the area. After discussion , the Commission agreed to ask the Engineer's Department for their recommenda- tion as to the type of drainage system to be installed in this area -storm drains or an open ditch ; and if an open ditch , how deep? The Commission would appreciate your consideration of this matter and would ask that you send your findings to the Council with a copy to the Planning Commission for their files. After further brief discussion the following motion was passed: RECOMMENDATION: The Planning Commission recommend to City Council that the Pleasant View Subdivision Second Filing, be approved, subject to approval of supplementary documents by the City Attorney and the receival of the desired drainage information from the City Engineer's Office. APPROVAL OF MINUTES HILL MOVED: MILES SECONDED: The Minutes of October 18 , 1962 be approved as printed. The motion carried unanimously. II. THOMPSON-SUMMERS Bounded on the North by West Grand Avenue; on the East by South Cherokee extended ; on the South by West Belleview Avenue; on the West by the South Cherokee-South Delaware alley. REZONING R-1-B to R-2-A CASE #25-62 The Planning Director referred to the minutes of October 18, wherein she was asked to study the aforesaid area, and give a report and recommendation to the Commission. Mrs. Romans re- ported that there had been contact from adjacent property owners, and that they had indicated that they would not oppose an R-2-A zone classification , were it to be considered for that area. Mrs. Romans recommended the Planning Commission initiate the R-2-A zoning, inasmuch as it would serve as a "buffer" between the existing R-3-A zone classification on the East and the R-1-B zone classification abutting to the West, the Hearing to be held in December. MILES MOVED: HILL SECONDED: The Planning Commission initiate an R-2-A zone classification on the area bounded on the north by West Grand Avenue ; on the east by South Cherokee extended; on the south by West Belleview Avenue; on the west by the South Cherokee-South Delaware alley; the Public Hearing date to be set for December 13, 1962; the property to be posted and publication be given in the official city newspaper.
