DATE: SUBJECT: RECOMMENDATION: Love moved: Pershing seconded: February 1, 1962 Resolution Regarding Annexation to the City of Englewood. That, whereas there is interest in annexation to the City of Englewood in the area south of Belleview at Broadway; in the Centennial Acres area; and also two areas of industrial land to the north of Union and west of Santa Fe, and Whereas, the City of Englewood is ready and able to serve these areas with water, sewer, fire and police protection, and Whereas, possible proposed zoning is compatible with the Guide for Growth of the City and in foFmal discussion with other governmental units as to boundaries in this area is recognized; and Whereas, it is the Planning and Zoning Commission's thought to complete the Master Plan, and the border areas must be solved prior to the com- pletion thereof, NOW, THEREFORE, BE IT RESOLVED that the Planning and Zoning Commission recommend to the City Council that they act favorably to the petitions of those interested in annexing to the City from the aforementioned areas, and further BE IT RESOLVED that the petitioners give thought to annexing under the regulations of the simultaneous zoning and annexation ordinance. Members present: Hill, Kreiling, Love, Miles, Pershing, Rice Romans, Ex-officio Members absent: None I. APPROVAL OF MINUTES MILES MOVED: • I PERSHING SECONDED: The minutes of January 17, 1962, be approved as received. The motion carried unanimously; LOVE MOVED: MILES SECONDED: The Minutes of February 1, 1962, be approved as received. The motion carried unanimously. II. RARITAN INDUSTRIAL PARK CASE #21-61D A brief summary of this subdivision was presented by Mrs. Romans. The Planning Commission has approved the preliminary plat. She emphasized the fa.ct that the hearing had nothing to do with zoning. A 20 foot alley will be dedicated, and the owners will dedicate 30 feet on all sides for street purposes. The area is to be divided into 16 lots, measuring approximately 75' x 125'. MILES MOVED: LOVE AND HILL SECONDED: The hearing be opened. The motion carried unanimously. Henry Cokayne 1989 West Iliff asked if the Commission was giving any thought to the residents in the area that is presently zoned R-1-D? He stated he lived right across the street from this proposed subdivision, and was opposed to an Industrial Park. I I I I I I Page 619 Mr. Jessee 1930 West Baltic -stated the residents of the area were interested in a T Zone in the area. They did not want Industrial zoning right against their resi- dential property; also, they did not want any more auto wrecking yards in the area. Mrs. Romans pointed out that auto wrecking yards are not a permitted use in an M-2 Zone; only in M-3. At the present time, there is no M-3 Zone District in the City of Englewood. Mr. Kreiling asked how close the sewer line was to the area; and what control there would be until a sewer line could be put to the area. Mrs. Romans answered that the Tri-County Health requirements would have to be met until a sewer line was put in, and had been tapped onto. Discussion followed. HILL MOVED: LOVE & PERSHING SECONDED: The hearing be closed. The motion carried unanimously. LOVE MOVED: MILES SECONDED: The plat of Raritan Industrial Park Subdivision be approved and recom- mended to City Council; also, that the Council be reminded of Article II, Section 6, B of the Subdivision Regulations, which reads: STREET IMPROVEMENTS. In order to provide for the orderly construction of public improvements as areas are built and developed, to avoid intermittent sections so improved or unimproved, and to promote the public health, safety and welfare, all streets shall be graded and improved by paving, concrete curbs and gutters and sidewalks, unless and provided that the Council shall find, upon the recommendation of the Planning Commission, that paving, curbs, gutters and sidewalks, or any of them, are not required for an adequate use and development of the area involved. Also, that adjoining property owners put money in escrow for the im- provement of these streets. The motion carried unanimously. III. JENSEN SUBDIVISION CASE #20-61F A brief review of the proposed subdivision was given. The preliminary plat had been ap- proved by the Planning Commission. There are four corrections that will have to be made on the final plat. (1) the note referring to the Denver City Ditch will have to be removed; (2) property lines will have to be extended to the center of the ditch; (3) the radius would have to be shown on the plat (4) the spelling of COLEMAN would have to be corrected to COLMAN. LOVE MOVED: KREILING SECONDED: The hearing be opened. The motion carried unanimously. Mr. Watson 1030 West Stanford Drive -stated he had two main objections to the subdivision: (1) the plat as drawn, is not accurate; it does not present a true picture of the actual lay of the land; (2) he did not feel that Lot #6 Mr. Grasser had access to a street as there was no curb cut there. He also felt that Mr. Jensen was not paying his share of the cost of paving of West Stanford Drive. 1050 West Stanford Drive -stated that he and Mr. Watson paid for the paving of that street, and that the street was very narrow -any additional traffic or another car parked across the street, and a very serious traffic hazard would be created. Discussion followed. Mrs. Parrish 4330 South Jason - MILES MOVED: LOVE SECONDED: stated she was concerned with the drainage problem. It was stated that the subdivision will not change the characteristic of the drainage way. The hearing be closed. The motion carried unanimously. MILES MOVED: LOVE SECONDED: The matter of Jensen Subdivision be tabled until such time as the questions raised in the discussion can be answered. The motion carried unanimously. Mr. Hill suggested that, considering the drainage problem in the area, a six inch vertical curb be required, rather than the Hollywood type curb. Page 620 IV. PLEASANT VIEW LANE -FRED WALDEN CASE #3-62 Mr. Walden presented three proposed plats for a subdivision of this area to meet the require- ments of R-1-C zoning, which has been initiated by the Planning Commission. Mrs. Jackson asked if there were any plans for Lowell to be widened. Their house was set back 40 feet from Lowell, and this would make a difference on the plats. Discussion followed. Mr. Walden stated he preferred the third plat, as did the owners in the area; it leaves Pleasant Lane where it is, and more closely follows ownerships. Mrs. Romans stated she would take the plats to the Engineer's Office for their review and consideration. No action was taken. V. OLD BUSINESS A. Planning Staff. Mrs. Romans reported on the progress made in attempting to attain adequate staff for the office. VI. NEW BUSINESS A. Annexation Information Mrs. Romans passed to Commission members copies Of the "Factlet" to be mailed to residents of the Centennial Acres Area. B. Copies of the Library study recently completed were give·n Commission members; also, they were given a copy of the Park and Recreation Capital Improvements Program. C. Rezoning Hearings -March 8. There are two rezoning cases to be heard in March; one on the Pleasant View Lane Area from R-1-A to R-1-C; the other, the area bounded by East Kenyon and East Jefferson Drive, from South Sherman to South Logan, from R-2-B to R-3-B. D. Appeal to Council. Mrs. Romans stated she had been informed that the rezoning request filed by the Lundgreens had been appeale9 to the City Council after denial by the Planning Commi~sion. Council .has set the hearing date for March 5, 1962. E. Approval of C-2 ·Zone ·District~ 1 l. - Mrs. Romans informed the Planning Commission that the request for C-2 zoning in the 4800, 4900, and 5000 blocks 'South Acoma had been passed by the City Council .on .first reading. F. The Commission briefly discussed the need for an increase of rezoning fees. At present, the fee is $25.00. Mr. Love suggested the possibility of a fee, plus any expenses incurred on the part of the City on the rezoning •. G. There was a brief discussion of the Institute for Planning Officials to be held in Boulder, February 16 and 17. The meeting adjourned at 10:40 P.M. Respectfully submitted, Gertrude G. Members Present: Hill, Kreiling, Miles, Pershing , Rice Romans , Ex-officio Members Absent: Love Also Present: Alan Koppel, Planning Assistant Mr.Rice stated that the Planning Commission was a cit izens advisory committee, appointed by the Englewood City Council; and that rezoning hearings were held on a quarterly basis. I. APPROVAL OF MINUTES Kreiling moved: Miles seconded: The minutes of February 8, 1962, be approved as printed. The motion carried unanimously. II. PLEASANT VIEW LANE CASE #l-62A January 17, 1962 Mrs. Romans gave a .brief review of this case. An R-2-B Zone classification had been re- quested in September, 1961. The rezoning request was not recommended to City Council by the Planning Commission. In an effort to work with the property owners of the area, the Planning Commission had initiated the R-1-C rezoning, which they felt would be compatible to the surrounding area. Miles moved: Hill seconded: That the hearing be opened. The motion carried unanimously. Slides of the subject and surrounding area were shown by Mr. Koppel. Mr. Rice asked the proponents of the rezoning to present their case. Mr. Fred Walden 3325 West Pleasant Lane -stated he was a property owner in the area, and was very much in favor of the change. He felt the present R-1-A zoning was too restrictive; and that the requested R-1-C would be compatible with the neighborhood. The question was raised as to what type construction the houses in the proposed development would be? The opponents desired brick development in the area. Mr. Rice stated there was no restriction as to the type construction a house had to be. Mr. Kenneth Schuricht 3292 West Stanford Ave. -stated that all the houses in the area were of brick construction, priced from $16,000 up,with 1100 square feet of floor space. To the south, Mr. Schuricht stated the homes were priced fr om $22,000 up, and had an average of 1500 square feet of floor space. Mr. Schuricht presented petitions protesting the rezoning signed by 81 property owners east of Irving, and also by all but three property owners on West Pimlico. Mr. Schuricht stated he did not feel the pictures shown of the area were representative of that area, that they emphasized the bad points of the area. Mrs. Jackson 4550 South Lowell -asked what the requirements were in an R-1-A zone classification. She is a property owner in the subject area, and in favor of the zoning change. Bill Hughes 3585 West Pimlico stated he wished to present petitions opposing the rezoning. Mr. Hughes asked if the platting of the area as R-1-A would be unfeasible; if so, he felt there would be more justification for the R-1-C. Messrs Herner and Hoffman stated they were opposed to the rezoning, as it would undoubtedly increase the sc hool population. Mr. Walden stated it was the intention of the property owners to build "nice" structures, probably brick, and that the average lot area would be 8200 to 8400 square feet. Mayor Holland of Sheridan, stated the present zoning to the north of the subject area was R-3, single-family residential. At the present they had no restrictions.
