easier access to the Core Area and also to Highway 70 westbound, the straightening of Floyd
Avenue from South Lincoln Street to South Bannock Street, the widening of certain streets
within the Core area in order to provide a better flow of traffic and a provision for off-
street parking are some of the projects which the Commission has considered essential to the
sound development .of the commercial area , and therefore, to the City.
It was explained that the purpose of the Special Meeting was to review some of the Plans
and background material that would serve as a basis for the Commission members recommendation.
Mr. Small, Small-Cooley and Associates, was invited to attend the Special Meeting to review
some of the information he has gathered in his work as a traffic consultant working with t he
Citizens' Action Committee. Mr. Small explained that he had been retained to study and make
recommendations concerning improved access to and from the Core Area, parking and traffic
circulation. Mr. Small pointed out some of the problem areas that he is studying and discussed
some of the preliminary plans which have been presented to the Action Committee.
The Commission discussed the various plans presented. No action was taken.
The meeting adjourned at 3:30 p.m.

I. CALL TO ORDER.
CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION
MARCH 4, 1964
The regular meeting of the Englewood City Planning and Zoning Commission was called to
order by Chairman Carlson at 8:20 p.m.
Members present: Touchton; Starkloff; Rice; Parkinson; Fullerton; Carlson
Romans, Ex-officio
Members absent: None
Also present: Wayne Monson
II. APPROVAL OF MINUTES.
Fullerton moved:
Rice seconded: The Minutes of February 19, 1964 be approved as presented.
The motion carried unanimously.
III. FAIRLEY REZONING
R-2-B to
I-1
CASE #15-63C
A summary of this case was given by Mrs. Romans. The application was filed December 3 , 1963.
The request is for a change of zoning from R-2-B to I-1 for the area extending eastward from
the present I-1 zone boundary to the centerline of Galapago , were it dedicated to its re-
quired width and east to include Lots 1 , 2, and 3, Corder Subdivision, bounded by Dartmouth
on the north and Eastman on the south. The property has been posted and publication given
in the Englewood Herald on February 17, 1964.
Rice moved:
Fullerton seconded: The Public Hearing on the Fairley Rezoning Request be opened.
The motion carried unanimously .
Chairman Carlson asked for those in favor of the rezoning to speak.
Mr. M. E. Watson stated the Elks Lodge was in favor of the rezoning of Lots 1 , 2 , and 3,
Corder Subdivision.
No other persons present wished to speak in favor of the rezoning.
Mr. Carlson asked for those in opposition.
Mrs. Romans stated a petition signed by six property owners within the subject area
opposing the rezoning had been received in the Planning Office. The petition has been
signed by Louis J. Ostrousky, Julia Ostrousky, Paul A. Franzmann, Harvey J. Bevier,
Donald G. Franzmann, Charles B. Dunbar.
Mrs. Alfred Mares
3200 South Galapago -presented a petition containing 48 signatures of property owners
in the general area opposing the rezoning. Those persons who signed
the petition are: Alfred L. and Betty Mares, 3200 South Galapago; Lyle E. & Alvina Martin,
3210 South Galapago; Hazel & Harled E. McKee, 3240 South Galapago; Guy B . & Nelle Laughridge ,

Mr. Burfiend
1274 South Wyandot -stated he was a property owner in the area and was opposed to the
rezoning.
Mr. Jorgenson
3053 South Galapago -asked if there was a definite development planned in the area, or if
the proposed rezoning was based on speculation?
Mr. Martin
3210 South Galapago -stated he felt the I-1 zoning would decrease the value on his home
and was opposed to the rezoning.
Mr. Alfred Mares
3200 South Galapago -stated he was opposed to the rezoning prior to learning that the lodge
planned to locate there, and was very opposed now.
Mr. Rice asked the Planning Director to outline the reasons the I-1 zone classification was
requested.
Mrs. Romans stated the area was zoned Industrial under the 1955 Zoning Ordinance and Map , but
had not developed. Numerous inquiries were received by the Planning Department prior to the
adoption of the 1963 Comprehensive Zoning Ordinance in regard to the area being zoned R-2-B
and this area was zoned R-2-B at the time the Comprehensive Zoning Ordinance and Map was
adopted. Under the 1955 Ordinance, lodges were a permitted use in R-2-B; in the 1963 Compre-
hensive Zoning Ordinance, they were deleted from that district designation. She pointed out
that to zone only Lots 1, 2, and 3 of Corder Subdivision, (the site the Elks were interested
in) I-1, would be spot zoning. Therefore, the applicant included the area to the west to
give them contiguity with like zoning as required.
Mr. Watson
Elks Lodge -stated he felt the proposed development on Lots 1, 2, and 3, Corder Subdivision,
would be an asset to the community.
Mr. Gillpatrick
3890 South Galapago asked if the Planning Commission had the power to waiver restrictions
to permit the lodge without changing the zoning?
Mr. Carlson said such could not be done by a variance, only by a rezoning.
Mrs. Ostrousky
744 West Dartmouth -stated she was not objecting to the Elks Lodge, but was objecting to
rezoning the entire area. She asked if spot zoning could be permitted
in this instance to allow the Elks Lodge, but permit the rest of the
area to have R-2-B zoning.
It was pointed out that "spot zoning" is not permitted.
Further discussion followed. Mr. Watson asked if the opposition was directed against the
Elks Lodge or against the I-1 zoning? Mr. Mares stated he had no knowledge of the Lodge's
intentions until this evening; they were opposing the I-1 zoning on the whole.
Rice moved:
Touchton seconded· The Public Hearing be closed.
The motion carried unanimously.
IV, ENGLEWOOD INDUSTRIAL PARK CASE #2-64
Touchton moved:
Rice seconded: The Planning Commission consider the Preliminary Plat of the Englewood
Industrial Park.
The motion carried unanimously.
Mrs. Romans reported the plats have been submitted to the various utilities departments and
companies for their comments and suggestions. Copies of the plat were shown the Commission
for their study.
Mr. Monson gave a summary of the comments and suggestions from the various utility companies
and departments. It was pointed out that the street profiles and proposed grades would have
to be furnished with the Final Plat. It was noted that the Subdivision Regulations require
an 80' right-of-way in Industrial areas. To this date, 60' right-of-ways have been permitted.
Mrs. Romans stated the Preliminary Plat appeared to be in order; that the subdividers would
now need to file a Final Plat with the Commission and a Hearing date be set. It was also
pointed out that improvements must be in prior to the filing of the Final Plat, or a Bond
posted therefore.
Mrs. Romans also pointed out that Yale was designated as an arterial on the Master Street Plan
for Englewood; it is also designated as an arterial by Denver. It is designated as a "minor
arterial" -minimum width of 110' -by Arapahoe County.

Rice moved:
Fullerton seconded: The Planning Commission approve the Preliminary Plat of the Englewood
Industrial Park with the provision that the Plat be corrected to show
provision for an 80' right-of-way for Yale for a future arterial; i.e.
a 40' dedication from the north property line of the Industrial Park .
Upon the call of the role, the motion carried unanimously.
Further discussion ensued.
Fullerton moved:
Touchton seconded: The Planning Director investigate the possibility of obtaining a 40'
dedication from the property owners to the north of the proposed In~
dustrial Park to give an 80' right-of-way width for Yale Avenue.
The motion carried unanimously.
Mr. Rice asked that notice be given the Chief Building Inspector that no building permits
be issued for the property to the north until such time as street dedication is obtained .
V. REAM -SOUTH LIPAN AND WEST OXFORD.
Mr. L. J. Ream was not present. No discussion was held; no action was taken.
III. (B) FAIRLEY REZONING

The Public Hearing held earlier was reviewed. Discussion ensued.
Rice moved:

Touchton seconded: The rezoning application filed by Mr. and Mrs. R. J. Fairley be
denied for the following reasons:
(1) The land was zoned industrial previously without developing, and studies made at
the time the Comprehensive Zoning Ordinance was adopted indicated a strong possibility
of R-2-B development.
(2) Property owners in the area strongly objected to the proposed rezoning.
(3) No valid reason has been given the Commission for the rezoning request.
The motion carried unanimously.
Mr. Fullerton asked that Mrs. Romans continue to work with the Elks Lodge to help them
locate an area in which Lodges would be a permitted use.
VI . PARK AND RECREATION PLAN.
Mrs. Romans reported on the meeting she attended with Messrs. Esch, Carlson, Jorgenson ,
Malone, and Romans in regard the revised Park Program recently submitted to Council. The
Plan approved by the Parks and Recreation Commission and the City Council will be called the
Park Replacement Program.
VII. REPRESENTATIVE TO ASPO.
It was pointed out that Mrs. Romans had been designated to attend the ASPO Convention at a
prior meeting. A Commission member was to be designated at a later date.
Mr. Rice suggested Mr. Carlson be designated as the Commission representative, with an
alternate designated in the possibility Mr. Carlson cannot attend.

Mr. Carlson be designated as the Commission representative to
attend the ASPO Convention and Mr. Rice be designated as the
alternate .

VIII. The Planning Director reported several inquiries have been received in regard a
portion of the area bounded by Highway 70, Jefferson Drive, South Pennsylvania and
the Pennsylvania-Logan alley. This area is presently zoned R-3-A which requires a minimum
of 12,000 sq. ft. for a multi-family development. The particular site does not meet the
requirement , yet does exceed requirements for a single-family residence. It was pointed out
that this particular "hardship" is now the fault of the owner, and might logically be a
situation upon which the Board of Adjustment and Appeals should act. Discussion ensued.
No action was taken.

IX. ICRPC.
Members were reminded of the workship session which will be held March 7, 1964, 8:30 a.m.
at the Continental Hotel.
X. Mr. Fullerton stated he had received a call asking that the Commission consider giving
a recommendation to t' e citizenry of Englewood in regard the sale of the Park Land and
the proposed commercial development.
Discussion ensued.
Starkloff moved:
Fullerton seconded: The meeting be adjourned.
The motion carried unanimously and the meeting was declared adjourned at 11:15 p.m.

MEMORANDUM TO THE ENGLEWOOD CITY COUNCIL REGARDING ACTION OR RECOMMENDATION OF THE CITY
PLANNING AND ZONING COMMISSION.

SUBJECT: Denial of Rezoning Request.
ACTION: Rice moved:
Touchton seconded: The rezoning application filed by Mr. and Mrs. R. J. Fairley
be denied for the following reasons:
