Bishop, Superintendent of Schools, in which the possible closing of the 3600 block of South Lincoln was mentioned. A 20 foot roadway to serve the uses at the north end of the block was suggested. Discussion by the Commission followed. Mr. Fullerton suggested the property owners affected by the proposed vacation be asked to attend a meeting with Mr. Bishop and the Planning Commission. Further discussion followed. Rice moved: Fullerton seconded: The Planning Director be directed to contact the Superintendent of Schools to outline to him as many of the objections as we can see at the present time in view of other uses affected to see if they can come up with a better plan before formal presentation. The motion carried unanimously. C. Annexation -South of Belleview, West of Broadway Case #6-64 Mrs. Romans reported that six resident land owners have signed the petition for annexation. At least three additional signatures are needed. Discussion followed. D. Next Meeting Date. The next regular meeting of the Commission is April 8, 1964; however, the Director and at least one member will be unable to be present. Fullerton moved: Touchton seconded: The next meeting date be changed from April 8th to April 15th, 1964. The motion carried unanimously. Fullerton moved: Touchton seconded: The meeting be adjourned. CALL TO ORDER: CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION APRIL 3, 19h4 SPECIAL SESSION The special session of the Englewood Planning and Zoning Commission was called to order at 6:40 a.m. by Chairman Carlson. Members present: Touchton; Starkloff; Rice; Parkinson; Fullerton; Carlson Romans, Ex-officio Members absent: None II. ANNEXATION -SOUTH OF BELLEVIEW AT BROADWAY Touchton moved: CASE #6-64A Starkloff seconded: The matter of possible annexation south of Belleview at Broadway be considered. The motion carried unanimously. Mr. Fullerton stated he had understood that an agreement was made between the cities of Englewood and Littleton whereby Belleview Avenue was the north and south boundary lines of the cities. He asked that this be explained. Mrs. Romans gave a review of the annexations of Englewood and Littleton encompassing the past ten years. At a meeting of Englewood and Littleton officials held in the Pennwood Restaurant several years ago, it was agreed that the area north of Big Dry Creek until it intersec~~d Belleview and then Belleview Avenue could be better served by Englewood, and the Creek and Belleview were at that time regarded as the division line. Shortly thereafter, Littleton annexed the area north of Belleview, west of Windermere extended, west to South Decatur Street extended. Mrs. Romans reviewed notes taken at a meeting of Englewood and Littleton City officials at the time the Centennial Acres annexation was considered in 1962. No agreement was indicated. The Minutes of the Planning Commission of February 1 , 1962 were reviewed in which it was recommended to City Council that the area south of Belleview, both east and west of Broadway, be annexed. Three other areas, one of which was Centennial Acres, were also recommended for annexation. Mr. Rice stated that past Minutes had been reviewed, and no agreement was recorded. Further discussion ensued. I I I I I I Page 757 Mr. Fullerton stated he felt that if the Council predecessors had made such an agreement, that it was the moral obligation of the suceeding Councils to honor that agreement . It was pointed out that the area east of Broadway had been annexed to Littleton, and was at the time of the Commission meeting of February 1, 1962, still within the Littleton City limits. However, as noted in those Minutes, the annexation procedure was incorrect, and the area was de-annexed. In the ensuing two years, Littleton has not made an attempt to re-annex this area. Mr. Starkloff stated he felt there was more of a moral obligation owed to the people in an area who wanted to annex to a given city than to an agreement by past Councils. At meetings held two years ago, the people concerned asked the two cities to let t hem , the property owners, decide in which city they wanted to reside. Further discussion followed. Fullerton moved: Touchton seconded: WHEREAS, the necessary number of signatures and required percentage of land area have been obtained, and WHEREAS , there is no written evidence of an agreement between Englewood and Littleton to which there would be a moral or ethical obligation, NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommend to City Council the area south of Belleview, east and west of Broadway be annexed to the City of Englewood. Discussion followed. Rice moved: Starkloff seconded: The motion be amended by the following addition: WHEREAS, The Planning Commission on February 1, 1962 approved the annexation of thearea south of Belleview, east and west of Broadway , Mr. Carlson called for the vote on the amendment. AYES: NAYS: Touchton; Starkloff; Rice; Parkinson; Fullerton; Carlson None The motion carried unanimously. Mr. Carlson called fo r the vote on the motion, as amended. Discussion followed concerning the publicity this particular issue has received, particularly a n article which appeared in the Denver Post Zone 2 dated April 1, 1964. Touchton moved: That a firm stand be taken by the Commission and issues coming before the Commission be given proper publicity. Further discussion ensued in which it was suggested that this should be at the Council level. The motion was declared dead for lack of a second. Rice moved: Fullerton seconded: The Recommendation to Council be further amended by the following: WHEREAS, the City of Englewood is ready and able to serve this area with water, sewer, fire and police protection. The motion carried unanimously. III. CRYSTAL ACRES 2900-3000 blocks So. Downing Street REZONING R-1-A to R-1-c CASE #5-64 Mrs. Romans indicated the area on the Map. Under the 1955 zoning Ordinance the zone boundary was down the center line of South Downing, the west side being zoned R-1-D; the east side zoned R-1-B. Under the 1963 Comprehensive Zoning Ordinance the boundary was moved to the Downing-Corona alley, and changed to R-1-A. At the time of this change the staff had over- looked the fact that in 1959, the area was re-subdivided into 55 foot lots. The 1963 Comprehensive Zoning Ordinance R-1-A classification requires 75' frontage. Discussion ensued. Page 758 Rice moved: Parkinson seconded: The Planning Commission initiate rezoning of the west side of the 2900 and 3000 blocks of South Downing from R-1-A to R-1-C; hearing proceedings to be set for the earliest possible date. The motion carried unanimously. IV. The Planning Director noted that several complaints had been received in regard to the number and height of anntennae erected by ham radio operators throughout the City. There are no restrictions on these uses in the 1963 Comprehensive Zoning Ordinance, and apparently none in the Building Code. Discussion ensued. Mr. Fullerton felt it would be wise to refer this situation to the City Attorney . It was moted, seconded, and unanimously carried the meeting be adjourned. Respectfully submitted, Gertrude G. Fullerton moved: Rice seconded: The Minutes of March 18, 1964 be approved as presented. The motion carried unanimously. Mr. Touchton entered and was seated with the Commission.
