The motion carried unanimously. IV. The Planning Director noted that several complaints had been received in regard to the number and height of anntennae erected by ham radio operators throughout the City. There are no restrictions on these uses in the 1963 Comprehensive Zoning Ordinance, and apparently none in the Building Code. Discussion ensued. Mr. Fullerton felt it would be wise to refer this situation to the City Attorney . It was moted, seconded, and unanimously carried the meeting be adjourned. Respectfully submitted, Gertrude G. Welty Recording Secretary MEMORANDUM TO THE ENGLEWOOD CITY COUNCIL REGARDING ACTION OR RECOMMENDATION OF THE CITY PLANNING AND ZONING COMMISSION DATE: April 3, 1964 SUBJECT: Annexation South of Belleview, East and West of Broadway ACTION: WHEREAS, the Planning Commission on February 1, 1962 approved the annexation of the area south of Belleview, east and west of Broadway, and WHEREAS, the City of Englewood is ready and able to serve this area with water, sewer , fire and police protection, and WHEREAS, The necessary number of signatures and required percentage of land area have been obtained, and WHEREAS, there is no written evidence of an agreement between Englewood and Littleton to which there would be a moral or ethical obligation, NOW, THEREFORE, BE IT RESOLVED that the Planning Commission recommend to City Council the area south of Belleview, east and west of Broadway be annexed to the City of Englewood. CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION APRIL 15, 1964 The meeting was called to order at 8:00 P.M. by Chairman Carlson. Members present: Starkloff, Rice, Parkinson, Fullerton, Carlson Romans, Ex-officio Members absent: Touchton Staff present: Wayne Monson II. APPROVAL OF MINUTES. Fullerton moved: Rice seconded: The Minutes of March 18, 1964 be approved as presented. The motion carried unanimously. Mr. Touchton entered and was seated with the Commission. The approval of the Minutes of April 3, 1964 was deferred until later in the evening. I I I I I I III. ROBERT REYNOLDS 3200 Block South Zuni Street REZONING I-2 to R-3 Page 759 CASE #7-64 Mr. Reynolds was present to discuss with the Commission the possible rezoningcf his property in the 3200 block of South Zuni. The south border of his property is the .Englewood-Sheridan City boundary. Mr. Reynolds indicated he was interested in rezoning only the west 300 feet of his property to a zoning permitting duplex-multiple uses. Mr. Monson indicated the area on the Map. East of Zuni, in Englewood, is Industrial; west of Zuni is residential; south of the property ,in Sheridan, is Industr i al. Mr. Reynolds stated he felt the use o f his property in Industrial developnent was at least five years away; if the access were improved, it would cut the time for development approxi- mately in half. Mr. Rice expressed the view that this would be spot zoning, inasmuch as the area is zoned Industrial on the north and east side in the City of Englewood, and is zoned industrial to the south in Sheridan. Further discussion ensued; no decision was reached. The Commission agreed to discuss the problem further and notify Mr. Reynolds of their decision. IV. MR. PARR Gordon Tract REZONING R-1-C to I-1 CASE #8-64 Mrs. Romans gave a summary of this case. Mr. Parr owns property in the Gordon Tract. At the time the Comprehensive Zoning Ordinance was adopted, the tract was zoned R-1-C on the west of South Clay extended, and I-1 on the east side. The Brown Ditch runs through his property and there is considerable difference in the grade of the land. Mr. Parr has indicated a desire to rezone the area southeast of the Brown Ditch to I-1 to enable him to use the area as storage area for his landscaping business. Discussion ensued; it was felt that the Brown Ditch would be a natural boundary, and that the boundary established by the Comprehensive Zoning Ordinance was arbi t rary. Fullerton moved: Touchton seconded: The Planning Commission initiate rezoning of the subject area from R-1-C to I-1. The motion carried unanimously. V. ENGLEWOOD INDUSTRIAL PARK CASE #2 -64B Mr. Monson reviewed the revised Preliminary Plat. Replies from the Utility Companies and Departments were also reviewed. The utility poles will be in the publtc right-of-way, as the easements have been eliminated. The probability of two sets of poles on a street has been pointed out by Mr. Peterson of the Telephone Company, and he has stated the developers should be made aware of this fact. A forty foot dedication for the south side of West Yale Avenue is indicated on the Plat; the railroad right-of-way is now proposed rather than dedicated as on the first Preliminary Plat . Discussion ensued. Mr. Rice stated he wanted further clarification on the matter of two sets o f utility poles in the streets. Parkinson moved: Touchton seconded: The Preliminary Plat be approved; however, prior to submission of a Final Plat, the Planning Staff is to contact the various Utilities Companies and Departments in regard to the problem of poles in the street. The motion carried unanimously. II.(B) APPROVAL OF MINUTES. Rice moved: Parkinson seconded: The Minutes of April 3, 1964 be approved as presented. The motion carried unanimously. VI. ANNEXATION South of Belleview- east and west of Broadway. CASE #6-64 B Mr. Fullerton stated the matter of the proposed annexation South of Belleview , east and west of Broadway had been referred back to the Planning Commission for further consideration. Mr. Fullerton cited Minutes of a joint meeting of the Englewood-Littleton City Councils of March 29, 1962 in which an "informal" agreement on an annexation boundary was indicated, and stated he felt his motion of April 3, 1964 was incorrect , inasmuch as the Commission did not have adequate or correct information. Mr. Fullerton further stated he felt there was a moral and ethical obligation to this agreement. Mr. Rice felt the Planning Commission should be concerned with the proper growth and sound economics o f the City, not with policy; further that the Commission is not b ound by any former agreements. Page 760 Mr. Parkinson reviewed the recommendation to Council made April 3rd, and as k ed if the motion would be correct if the fourth paragraph reading "WHEREAS, there is no written evidence of an agreement between Englewood and Littleton to which there would be a moral or ethical obligation" were eliminated? Discussion ensued. Mr. Carlson pointed out that the Commission was an Englewood advisory body working for Englewood. Mr. Touchton said the Councils could not preempt the desires of people on annexation, and there was no written agreement, therefore, he did not feel there was a moral or ethical obligation on the part of either the Commission or the Council. Touchton moved: Rice seconded: The following recommendation of the Planning Commission to the City Council of April 3, 1964 regarding annexation south of Belleview, east and west of Broadway be reaffirmed: WHEREAS, the Planning Commission on February 1, 1962 approved the annexation of the area south of Belleview, east and west of Broadway, and WHEREAS, the City of Englewood is ready and able to serve this area with water, sewer, fire and police protection, and, WHEREAS, the necessary number of signatures and required percentage of land area have been obtained, and WHEREAS, there is no written evidence of an agreement between Englewood and Littleton to which there would be a moral or ethical obligation, NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission recommend to City Council the area south of Belleview, east and west of Broadway be annexed to the City of Englewood. AYES: NAYS: Touchton; Starkloff; Rice; Carlson Parkinson; Fullerton The motion carried. VII. FLOYD AND BROADWAY. Mrs. Romans reported that Mr. Burt has indicated a desire to put a wholesale-retail bakery on his property at Floyd and Broadway. This area is zoned B-1, which will permit retail bakeries. Discussion ensued. No action was taken. VIII. LAND USE MAPS. Land Use Maps of the core area and westward were displayed. Brief d~scussion followed. CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION APRIL 22, 19 6 4 The regular meeting of the Englewood Planning and Zoning Commission was called to order at 8:00 p.m. by Chairman Carlson. Members present: Touchton; Starkloff; Rice; Parkinson; Fullerton; Carlson Members absent: None II. APPROVAL OF MINUTES. Parkinson moved: Rice seconded: The Minutes of April 15, 1964 be approved as presented. The motion carried unanimously. III. ENGLEWOOD SCHOOL DISTRICT 3600 Block South Lincoln CASE #4-64A Mr. Bishop, School Superintendent, and Mr. Jorgenson, School Board President, were present to discuss plans for the vacation of the south half o f the 3600 block on South Lincoln and a dedication of an access from South Sherman west to South Lincoln. The property east of Flood Junior High School is now undeveloped. It is the intention that this area be developed as a playground and physical education area. It was pointed out there will be provided an off-street parking area for school employees on the northwest corner of the 3600 block of South Lincoln. Further discussion ensued. Mr. Carlson asked if the closing of South Lincoln was essential to the development o f the land. Mr. Bishop stated this would enable them to put the land to the best use. Mrs. Romans pointed out that a 50 foot street is minimum in a residential area. The architect for the School District had suggested a 36 foot dedication with a 25 foot roadway. It is not felt this is adequate to carry the traffic. Further discussion followed. Mr. Rice asked if the access from Sherman would be adequate for fire equipment. He also mentioned the limited access plan the State Highway Department has discussed recently. Mr. Starkloff stated that from a personal point of view as a property owner in the area he felt it would hurt the apartment house and Tucker Building located north of the proposed vacation. He felt he could not go along with any plan that would close Lincoln Street. Further discussion followed. No decision was reached at this time. Mr. Jorgenson and Mr. Bishop were assured this situation would be further discussed at a later time. IV. ROBERT REYNOLDS 3200 Block South Zuni Street REZONING I-2 to R-3 CASE #7-64A The area was indicated on the map. It was pointed out this would be a "spot" zoning, as it does not meet the requirements set forth in the Resolution adopted by the City in June of 1962. However, Mr. Reynolds does have the privilege of paying the fee and making application. Rice moved: Parkinson seconded: The Planning Director inform Mr. Reynolds that his re q uest would constitute "spot " zoning and does not appear feasible; however, Mr. Reynolds still has the privilege of making formal application.
