I. CALL TO ORDER.
CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION
APRIL 22, 19 6 4
The regular meeting of the Englewood Planning and Zoning Commission was called to order
at 8:00 p.m. by Chairman Carlson.
Members present: Touchton; Starkloff; Rice; Parkinson;
Fullerton; Carlson
Members absent: None
II. APPROVAL OF MINUTES.
Parkinson moved:
Rice seconded: The Minutes of April 15, 1964 be approved as presented.
The motion carried unanimously.
III. ENGLEWOOD SCHOOL DISTRICT
3600 Block South Lincoln
CASE #4-64A
Mr. Bishop, School Superintendent, and Mr. Jorgenson, School Board President, were present
to discuss plans for the vacation of the south half o f the 3600 block on South Lincoln and
a dedication of an access from South Sherman west to South Lincoln. The property east of
Flood Junior High School is now undeveloped. It is the intention that this area be developed
as a playground and physical education area. It was pointed out there will be provided an
off-street parking area for school employees on the northwest corner of the 3600 block of
South Lincoln.
Further discussion ensued. Mr. Carlson asked if the closing of South Lincoln was essential
to the development o f the land. Mr. Bishop stated this would enable them to put the land
to the best use.
Mrs. Romans pointed out that a 50 foot street is minimum in a residential area. The
architect for the School District had suggested a 36 foot dedication with a 25 foot roadway.
It is not felt this is adequate to carry the traffic. Further discussion followed. Mr.
Rice asked if the access from Sherman would be adequate for fire equipment. He also
mentioned the limited access plan the State Highway Department has discussed recently.
Mr. Starkloff stated that from a personal point of view as a property owner in the area
he felt it would hurt the apartment house and Tucker Building located north of the proposed
vacation. He felt he could not go along with any plan that would close Lincoln Street.
Further discussion followed. No decision was reached at this time. Mr. Jorgenson and
Mr. Bishop were assured this situation would be further discussed at a later time.

The area was indicated on the map. It was pointed out this would be a "spot" zoning, as it
does not meet the requirements set forth in the Resolution adopted by the City in June of
1962. However, Mr. Reynolds does have the privilege of paying the fee and making application.
Rice moved:
Parkinson seconded: The Planning Director inform Mr. Reynolds that his re q uest would constitute
"spot " zoning and does not appear feasible; however, Mr. Reynolds still
has the privilege of making formal application.
The motion carried unanimously.

V. NEW ENGLEWOOD COMPANY REZONING

Chairman Carlson read the following letter from Mr. Beausang, Clerk of the Council:

City Planning and Zoning Commission

Gentlemen:
The City Council in regular session on Monday, April 20, 1964, directed the City Clerk to
apply to the City Planning and Zoning Commission to initiate and consider rezoning the land
covered by the contract between the City of Englewood and the New Englewood Company, together
with the land immediately adjacent thereto on the west which are presently zoned R-1, to an
appropriate commercial district or districts.
You are respectfully requested to consider the above matter at the Commission's earliest
convenience.

The area was indicated on the map by the Planning Director. It was recommended by the staff
that B-1 zoning be initiated.
Touchton moved:
Fullerton seconded: The proposed initiation of zone change from R-1-C to B-1 be opened for
discussion.
The motion carried unanimously.
Mrs. Romans reviewed the reasons for the B-1 zoning rather than the B-3. The screening re-
quired in B-3 was felt to be unreasonable along Highway 70 and Santa Fe and adjacent to the
light industrial district on a portion of the east side of the area. There is Industrial and
B-2 zoning to the south and west of the area and the very restrictive B-3 is felt to be too
restrictive on this site.
Discussion followed.
Rice moved:
Fullerton seconded: The Planning Commission initiate the procedure of amending Ordinance
#26 series of 1963, Comprehensive Zoning Ordinance,by a change of zone
classification of the area hereinafter described from R-1-C to B-1; the
date for Public Hearing be set for May 20, 1964 at 8:00 p.m. at City
Hall Annex, 3000 South Bannock Street.
A tract of land lying in Sections 33 and 34, T. 4 S. R. 68 W., 6th P.M. described as follows:
Beginning at the point at which the center line of South Bannock Street intersects with the
north line of the S 1 /2 SW 1 /4 of said Section 34, thence west along said north line of the
S 1 /2 SW 1 /4 of said 34 and the north line of the SE 1 /4 SE 1 /4 of said Section 33 to the
easterly line of the Santa Fe Railroad right-of-way; thence in a southwesterly direction
~ong said ftasterly line of said right-of-way to the center line of West Hampden Avenue;
thence east along the center line of said West Hampden Avenue to the center line of South
Elati Street; thence north along the center line of said South Elati Street b the north line
of the SE 1 /4 SW 1 /4 SW 1 /4 of said Section 34; thence east along the north line of said
SE 1 /4 SW 1 /4 SW 1 /4 to the northeast corner of said SE 1 /4 SW 1 /4 SWl /4 ; thence north along
the east line of the NEl /4 SWl /4 SWl /4 of said Section 34 to the northwest corner of
McKinley's Subdivision, Second Filing; thence east along the northerly line of said McKinley's
Subdivision, Second Filing a distance of 311.15 feet to the northeast corner of said McKinley's
Subdivision, Second Filing; thence in a southeasterly direction along the northerly line of
McKinley's Subdivision as extended to the center line of the alley lying between said McKinley's
Subdivision and Flood's Addition; thence north along the center line of said alley to the
south line of Lot 2 of said Flood's Addition as extended; thence east along the south line
of said Lot 2 as extended to the center line of South Bannock Street; thence north along said
center line to the point of beginning;
Except for those tracts located in the southwest portion of the above described tract, along
the northern boundary of West Hampden Avenue, which are presently zoned I-1 (Light Industrial)
and B-2 (Business).
The motion carried unanimously.
Mr. Fullerton suggested that possibly more information would be available in regards the
traffic pattern, screening, etc. by the May 20th meeting. Mr. Carlson stated he hoped
information would be available by May 6th for consideration by the Commission.

3275 South Fox St. -stated she felt it would be to the advantage of the Planning Commission
to discuss the situation with the residents of the area.

Mr. Carlson read the following communication from the City Council:
"April 22, 1964

Gentlemen:
Enclosed is an original and a photostat of a petition filed with the City Council at its
regular meeting of April 20, 1964. The petition respectfully requests that South Fox
Street from West Dartmouth Avenue to West Floyd Avenue not be included as a through street
to the proposed new shopping center.
As the traffic flow pattern for the New Englewood Shopping Development will be considered
by the City Planning and Zoning Commission, the City Council referred this petition without
any consideration whatever to the City Planning and Zoning Commission for their information
or action.

stated they did not have the signatures of renters in the area;
that only one person they contacted was opposed to the petition.
The Planning Commission accept the petition and place it on file for
future reference and further discussion.

VI. BERENBAUM

Mrs. Romans stated that Mr. Berenbaum represents the owner of Lot 12, Block 11, Hampden
Hills Third Filing, and Lot 13, Block 2, Hampden Hills Subdivision. The two lots comprise
the building site. This site was subdivided in two separate actions. Lot 13, Block 2,
Hampden Hills Subdivision was recorded April 24, 1952. Lot 12, Block 11, Hampden Hills
Third Filing was recorded November 10, 1954. An easement on Lot 13 was not vacated when
the Third Filing was approved, and a recent survey indicated the house is situated in such
a way that the easement runs through a portion of it. The Utility Companies have said they
do not need the easement.
Discussion ensued.
Fullerton moved:
Starkloff seconded: The Planning Commission recommend to City Council the easement on
Lot 13 , Block 2, Hampden Hills Subdivision, be vacated; the Planning
Director to obtain written verification from the various utility
companies the easement is not needed.
The motion carried unanimously.
VII. ENGLEWOOD SCHOOL DISTRICT
3600 block South Lincoln
Parkinson moved:
Fullerton seconded: The matter be raised from the table.
The motion carried unanimously.

Discussion ensued. It was pointed out that access to the property on the East side of
Lincoln North of the school site would not be denied by the proposal of the School District.
Mr. Rice stated he felt residents on Sherman Street should be notified of the proposal as
they will be affected by the change in the traffic pattern.
Fullerton moved:
Parkinson seconded: The Planning Director be directed to notify the residents in the 3600
blocks South Lincoln and South Sherman and Fire Chief Woods of the
proposed vacation and dedication, and to ask for comments and suggestions
for review and consideration by the Commission at their May 6th meeting.
Further brief discussion followed.
The motion carried unanimously.

VIII. ASPO CONFERENCE.
Mr. Rice and Mrs. Romans reported on the ASPO Conference they attended in Boston.
IX. INSTITUTE OF PLANNING OFFICIALS
Mrs. Romans stated the sixth annual Institute of Planning Officials would be held in Boulder,
May 15 and 16. Members were urged to attend if possible.

Rice seconded: The meeting be adjourned.
The motion carried unanimously, and the meeting was declared adjourned at 10:20 p.m.

PLANNING AND ZONING COMMISSION.

RECOMMENDATION:
The Planning Commission recommend to City Council the easement in Lot 13, Block 2, Hampden

p.m. by Vice-Chairman Touchton.

II. APPROVAL OF MINUTES.
Parkinson moved:
Fullerton seconded: The Minutes of April 22, 1964 be approved as printed.
The motion carried unanimously.
III. AUDIENCE.
The audience present was acknowledged and thanked for their attendance. It was announced
that the Mayor's "Coffee-klatsch" would again be held in the Planning Office at 10:00 a.m.
Thursday morning. Interested citizens were invited to attend.
