Welty Recording Secretary MEMORANDUM TO THE ENGLEWOOD CITY COUNCIL REGARDING ACTION OR RECOMMENDATION OF THE CITY PLANNING AND ZONING COMMISSION. DATE: May 6, 1964 SUBJECT: 3600 Block South Lincoln RECOMMENDATION: The Planning Commission recommend to City Council the proper vacation of a portion of 3600 Block South Lincoln and the Lincoln-Sherman alley as requested by School District #1 be approved; and that dedication of the proposed new access road be accepted, subject to any necessary easements. Attention must be given to the proximity of the proposed roadway to the properties abutting the School District site on the north, and to the traffic created thereby, which would be offensive to the residents of those properties. Consideration should be given to parallel rather than angle parking adjacent to the apartment house at 3650 South Lincoln in order that a more adequate screening strip can be installed and to the installation of a buffer adjacent to the property at 3651 South Sherman in order that the roadway will not be so close to the residence. CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION May 20, 1964 Regular Meeting The regular meeting of the City Planning and Zoning Commission was called to order by Chairman Carlson at 8:05 p.m. Members present: Touchton, Starkloff, Rice, Fullerton, Carlson Romans, Ex-officio Members absent: Parkinson Also present: City Attorney Esch Planning Aide Monson II. APPROVAL OF MINUTES. Touchton moved: Fullerton seconded: The Minutes of May 6, 1964, be approved as presented. The motion carried unanimously. III. ENGLEWOOD INDUSTRIAL PARK SUBDIVISION Touchton moved: CASE #2-64D Fullerton seconded: The Public Hearing on Englewood Industrial Park Subdivision be opened. The motion carried unanimously. Mr. Monson reviewed this Subdivision. It is located between South Tejon and the railroad, West Yale and West Bates Avenues. The Final Plats have been sent to the Utilities Companies. The Companies that have replied have indicated they have no objections to the proposed plat. There was no change in the Final Plat from the Preliminary Plat approved by the Commission. WAYNE PARR REZONING CASE #8 -64A 2800 West Chenango R-1-C to I-1 Fullerton moved: Rice seconded: The Pu blic Hearing be opened. The motion carried unanimously. The area was noted as lying west of Clay Street extended, south of West Union, north of the present Littleton City limits, east of the Brown Ditch. There is a considerable grade separati on between this property and that to the west of the Brown Ditch, and it is not feasible to leave this area zoned R-1-C when it cannot be used for such. It can more reasonably be developed as I-1 which is the adjoining zone classification to the east. Mr. Parr stated he was satisfied with the proposed change. There was no one present to oppose the proposed rez oning. Fullerton moved: Rice 8i Starkloff seconded: The Public Hearing be closed. The motion carried unanimously. Discussion f ollowed. Touchton moved: Fullerton seconded: The Planning Commission recommend to City Council the rezoning o f Mr. Parr's property from R-1-C to I-1 be appr oved f or the following reasons: (1) the area is adjacent to I-1 zoning to the east; and (2) the Brown Ditch provides a natural boundary and be the logical zone b oundary line. The motion carried unanimously. V. CRYS~AL ACRES 2900 -3000 Block South Downing St. Fullerton moved: REZONING CASE #5-64A R-1 -A to R-1-C Touchton seconded: The Public Hearing on the rezoning of the 2900 and 3000 blocks of South Downing from R-1-A to R-1-C be opened. The motion carried unanimously. Mrs. Romans gave a brief history o f the case. Under the 1955 Zoning Ordinance, the R-1-D (60' frontage) --R-1-A (75' fr ontage) zone boundary was on the centerline o f South Downing. In 1963, under the Comprehensive Zoning Ordinance, the R-1-A District was extended west 1 /2 block to the Downing-Corona alley to include this . area. It was recently brought to the attention of the Planning Department that in 1959, the area had been resubdivided into 55 foot lots. This matter had been inadvertently overlooked by the staff at the time , the Comprehensive Zoning Ordinance was recommended, and under the Comprehensive Zoning Ordina nce, some of the sites were made non-conforming in lot area. Mr. Wilson, owner of vacant property in the 2900 block South Downing, which is the only vacant land in the area, requested that the zoning be changed back to R-1-C (50' frontage) in order that he might build on his lots as resubdivided. There were no persons present to speak for or against the proposed rezoning. Starkloff moved: Rice seconded: The Public Hearing be closed. The motion carried unanimously. Discussion followed. Rice moved: Fullerton seconded: The Planning Commission recommend to City Council the rezoning of the 2900 and 3000 blocks South Downing, west side, be approved for the following reasons: (1) The land is adjacent to R-1-C zoned land; (2) The area was previously zoned comparably under the 1955 Zoning Ordinance, and (3) The proposed zone classification would permit compatable and reasonable development of the only vacant lan~ in the area in accordance with its re-subdivision approved b y the City in 1959. The motion carried unanimously. Page 770 VI. NEW ENGLEWOOD REZONING CASE #9-64B R-1-C to B-1 Fullerton moved: Touchton seconded: The Public Hearing be opened. The motion carried unanimously. Mrs. Romans outlined the area under consideration for rezoning. It is bounded roughly by Bannock on the east, West Floyd Avenue on the north, the railroad right-of-way on the west, and the present B-2 zone district, Highway 70, the I-1 zone district on the south. Mr. Carlson asked for the proponents of this rezoning. Mr. Ray Ludwig 2888 South Ogden cited the election for the sale of the park. He stated he felt it was the wish of the voters that this zoning be approved. Mr. Harold Rust, President Englewood Chamber of Commerce --urged approval of the rezoning request. Mr. Jack Eachon Citizens' Action Committee --stated the Citizens' Action Committee wanted to urge favorable consideration of the proposed rezoning. Mrs. Wm. Beier 316 7 S. Bannock --urged the Commission to favorably consider the proposed rezoning. Mr. Lee Bennet, Executive Director Englewood Chamber of Commerce --cited the study made by the Larry Smith Company in 1960 in which a development such as is proposed was highly recommended; the most desirable locatio n indicated in the report was the present City Park site. Mr. Bennett asked the Commission to favorably recommend the rezoning. Mr. Carlson asked for those opposed to speak. Mrs. Goss 3284 South Fox -stated she was not opposed to the rezoning, but requested the Commission to zone a strip along the north edge of the site B-3. She felt the area north of Floyd would be better protected by the very restrictive shopping center zoning. Mr. Harry Mumm 3265 South Fox stated he had not opposed the shopping complex prior to the election, but is now opposed. He stated the residents were promised a 50 foot screening strip on Floyd, and a 50 foot street south of the screening strip at a meeting held by the Citizens' Action Committee in January. The plans he has seen recently indicate a street going one-way west -- then a 20 foot planting strip --and a street going one-way east. Mr. Mumm asked the Commission to table the decision until provisions are made for the protection of the residents to the north. Mr. Rice stated he felt the Hearing should be restricted to the matter or rezoning. He felt traffic should be discussed at a later time. Mr. Shroyer 3216 South Fox stated he did not feel the rezoning should be approved until a definite traffic pattern is decided. He stated there is a traffic prob~em on Fox now. Mrs. Romans briefly reviewed the traffic pattern on Floyd as submitted by representatives a the New Englewood Company on May 6th. It was pointed out that if the portion of Floyd Avenue dedicated for street purposes were vacated, 1 /2 would revert back to adjoining property owners and there would still be no guarantee of the 50 foot planting strip. Mrs. Romans asked Mr. Small to further discuss proposed traffic plans. Mr. Small further reviewed the plan sub- mitted by the Developer and discussed access to the proposed complex from the east. Mr. Small stated he did not feel the bulk of the traffic would use existing Floyd Avenue. Mr. Mumm asked why all access from the north between Bannock and Santa Fe was not dead-ended? He pointed out that a petition had been submitted asking that Fox be a dead-end street. Mrs. Reiners 32 7 5 South Fox -asked why Fox was needed as through street? She emphasized the existing problem of traffic on South Fox. Mr. Von Frellick stated he felt there was a lack of communication. He stated that if the right-of-way were made available, his company would see that the screening strip was planted 50 feet wide, as understood by residents of the area. He stated there would have to be some provision for ingress and egress to and from the north, and some provision to take traffic through. Access would have to be provided to the properties having garages fronting on Floyd. He felt the one-way street pattern on Floyd took care of this provision. In regard to access from the north, he acknowledged the fact that the presence of the school and proposed park site did present problems, therefore, Fox was the only logical through street. He further felt the traffic on South Fox could decrease, inasmuch as much of the present traffic is taking a short-cut from Highway #7 0 to Dartmouth through the park to Fox and thence to Dartmouth. Mrs. Goss stated she felt the area had to be protected now, or it would be surrounded. Mr. Reed 3400 S. Cherokee Mr. Reddington stated he was opposed to the rezoning request. He felt the people of Englewood were misled before the election. He stated it would take 30 years to grow trees to adequately screen the shopping complex. 3064 S. Downing -advised the Commission to study the traffic problem very carefully. I I I I I I Page 771 Mr. Hix 3290 South Cherokee -stated he was opposed to the rezoning. He did not feel people voted to sell the park; only voted for a park in their area. Mr. M. M. Summers 3140 South Delaware -stated he had traveled in all parts of the country, but he has never heard of citizens voting to sell a park. He stated he was against the rezoni~g , the proposed shopping complex and all it implied. Mr. Summers asked why the City Hall property was included in the rezoning request? He stated he felt the City Hall would be sold and the Norgren plant purchased. Mr. Summers pointed out that there were 57 acres in North- east Englewood zoned for B-3 development. Mr. Starkloff stated he felt the discussion should be restricted only to zoning of the City Park land, and that thus far, many of Mr. Summers' arguments were irrelevant, inasmuch as the voters had given approval on the sale of the park for the shopping complex. Mr. Summers pointed out that the final approval of the sale depended upon B-1 zoning being granted. Mr. Summers stated he hoped he would not be denied the right to present his case, and referred to prior rezoning hearings at which residents of Cherry Hills were given ample opportunity to present their arguments. Mr. Fullerton stated he felt the subject under discussion concerned the City Park , not the KLZ Site, and asked that comments be so restricted. Mr. Carlson asked that Mr. Summers confine his arguments to the problem of zoning on the City Park. Mr. Summers protested he was being denied the right to speak freely. to consider if the zoning would be proper, consistent, just, or fair? City was trying to destroy the park. Mr. Oscar McBee He asked the Commission He stated he felt the 940 W. Stanford Dr. -asked which came first, planning or zoning? He stated he was all for the shopping complex, but he has heard that the citizens "have been sold a bill of goods". Mr. McBee stated he wanted to see the City grow, and felt the citizens who voted in favor of the park sale did also. Mrs. Ostrousky 744 W. Dartmouth -stated her home was located in one o f the proposed park sites. She also pointed out that there is heavy traffic in the area. She asked who was to bear the expense of the traffic improvements necessitated by the development? Mrs. Reiners asked, if Floyd was vacated, why property owners could not be asked to dedicate it back to the City for the planting strip? She also stated she thought such discussion was pertinent to the zoning in this instance. Mr. Fullerton asked if Mr. Von Frellick would consider alternate access routes from the north, if presented for his study? Mr. Von Frellick stated he would be willing to consider other alternate access-ways from the north, but stated he didn't know just what the route could be. He expressed his desire to cooperate with the people in the area and the City in working these matters out, b ut he emphasized that the proposed development had to have adequate access in order to make it feasible. Mr. Touchton moved: Mr. Fullerton seconded: The Public Hearing be closed. The motion carried unanimously. Rice moved: Fullerton seconded: The proposed rezoning of the subject site from R-1-C to B-1 be tabled for further study and discussion. The mo tion carried unanimously. A recess was called at 9:50 P. M. The meeting was called to order at 10:10 P.M. III(b). ENGLEWOOD INDU S TRIAL PARK CASE #2-64D Rice moved: Touchton seconded: The matter of Englewood Industrial Park Subdivision be raised from the table. The motion carried unanimously . The subdivision plat was reviewed. Mr. Holland and Mr. Tatum, developers of the Subdivision, were present. Mrs. Romans reviewed the rough estimate for a Performance Bond submitted by the Engineering Department in the amou n t of $94,000. It was stated that a more detailed estimate would be obtained fo r the City Council's consideration. Mr. Tatum asked if Bond could be posted on only a part of the subdivision at one time, inas- much as they wanted to imrpove the property as they were able to sell it for development? Mr. Rice replied he did not believe the City Council would be receptive to such a proposal. Further discussion ensued. Page 772 Touchton moved: Fullerton seconded: The Planning Commission recommend to City Council the Englewood Industrial Park Subdivision be favorably considered and that the proper bonding requirements of the Subdivision Regulations be met. The motion carried unanimously. VII. NEW BUSINESS. A. Work Session. After considerable discussion, a work session for May 27, 1964 was agreed upon to review and f urther study the proposed New Englewood rezoning •. It was further agreed that Mr. James Small, Traf f ic Consultant, be present at this session. B. Arapahoe County Referral Case #11-64 Mrs. Romans presented a referral to the Planning Commission from the Arapahoe County Planning Office in regard to a rezoning request made by Mr. T. W. Anderson. The subject pro p e r ty is in the area petitioned for annexation to Englewood west of Broadway, south of Belleview. Mr. Anderson has indicated a desire for County zoning comparable to B-2 zoning in the City of Englewood. Mrs. Romans stated she had discus s ed the matter with the City Attorney, and it was felt by Mr. Esch that the City has no jurisdiction over the area at this time. Discussion ensued. Commission members agreed that the area was not within their jurisdiction for recommendation at this time. It was suggested that the County be notified that the requested zoning is not felt to be .compatible to zoning north of Belleview, and suggest the property be posted to better notify Englewood and surrounding County residents of the request. It was further suggested that, inasmuch as the area has petitioned for annexation, no change in the existing zoning s hould be recommended by the Commission in order that they not appear to be pre-empting consideration of the zoning when the annexation is final. Further discussion ensued. Starkloff moved: Rice seconded: A letter be sent to the County Planning Office stating that, out of consideration f or the adjacent property owners and inasmuch as this particular plot is included in the proposed annexation to Englewood. that the Planning Commission feels that the zoning should be left as it is at present until the annexation is finalized, at which time, according to Section 22.1-7 of the Comprehensive Zoning Ordinance , the Planning Commission will initiate appropriate zoning.
