CITY OF ENGLEWOOD PLANNING AND ZONINJ COMMISSION August 5, 1964 The regular meeting of the City Planning and Zoning Commission was called to order at 8:05 p.m.; Chairman Carlson presiding. Members present: Fullerton; Parkinson; Carlson; Rice; Touchton; Whitcomb Romans, Ex-officio Members absent: None Also present: Planning Assistant ,Monson City Engineer Waggoner II. APPROVAL OF MINUTES. Mr. Carlson stated the Minutes of July 16, July 22, and July 29 have not been approved. He asked if there were any corrections to be made or any discussion on these Minutes? Rice moved: Touchton seconded: The Minutes of July 16, July 22, and July 29 be approved as presented. The motion carried unanimously. III. ANNEXATION SOUTH OF BELLEVIEW, EAST OF BROADWAY CASE #19-64 Mrs. Romans stated that Mr. Ernest P. DeMoulin owns five (5) acres of land which adjoins on the south property recently annexed to the City and which is under the ownership of Mr. Pasternak and Mr. Elenbogen. Mr. DeMoulin had asked to appear before the Commission to gain some indication of the feasibility of petitioning to be annexed to Englewood. Mr. DeMoulin stated he was under the impression a petition was in the process of being circula- ted in the area for annexation to Littleton, of which he was not in favor. He stated he was the sole owner of the five (5) acres in question. The address for his property is given as 5500 South Pearl. Mr. DeMoulin stated his property was bounded by Dry Creek on the west; by the homes on Clarkson Street on the east, and adjoins the Elenbogen-Pasternak property on the north. He further stated it is his desire to develop his property in multi-family units and feels it could be very compatible with the adjacent area. There is now existing multi- residential zoning in Littleton to the west of his property. Further discussion ensued in regard to the service of water and sewer in the area. Mr. Carlson asked if the 1 /6 contiguity restrictions for annexations was met for this area? It was determined this should be checked by the Engineer's Office for confirmation. Mr. DeMoulin asked the feeling of the Commission on extending ·the proposed R-3-A zoning to encompass his property in the event the annexation is accepted? Discussion followed. It was the feeling of the Commission at this time that the possible extension of the R-3-A zoning appeared to be feasible; however, Mr. DeMoulin was told that the Commission could not pre- empt a Public Hearing that must be held by the Commission and the City Council on any zoning matter. IV. ZONING REQUEST R-3-B to B-2 DR. TOLLEY Lot 1, Rafferty Gardens Sub. CASE #16-64A Dr. Tolley was present to discuss his request to have the proposed zoning of R-3-B for his property in the recently annexed area south of Belleview, west of Broadway changed to B-2 to permit a Veterinary Hospital. Dr. Tolley stated he had been unaware until recently that this property had been annexed to the City of Englewood; he had purchased the property from Mr. Mcspadden in April of 1964, and notices sent to property owners had not been sent to him. Dr. Tolley explained that he wished to construct on this property a Veterinary Hospital; he stated the Hospital would be sound-proofed to avoid being a nuisance in the area, and the entire operation would be within a building. There would be no outdoor runs, kennels, etc. Page 790 Mrs. Romans explained to the Commission that because of the illness of the City Attorney, notice for zoning had not been published in the official City Newspaper in time to meet the 15 day requirement by August 19, and that the date for Public Hearing on the entire zoning procedure would have to be changed. Inasmuch as this is the case, she felt the legal could be changed now, if this were the wishes of the Commission, rather tnan to go through an en- tirely separate zoning Hearing. Discussion ensued. Rice moved: Fullerton seconded: Prior to legal publication being made in the official City Newspaper, the legal boundary of the pr,opose d B-2 Zone District be corrected to include Lot 1, Rafferty Gardens Subdivision. The motion carried unanimously. Mrs. Romans asked Dr. Tolley about a possible access dedication for his present property on South Broadway in the 5000 block. This was discussed; Dr. Tolley indicated his cooperation in obtaining sufficient access in this area. V. CHANGE OF DATE FOR ZONING HEARING. Mrs. Romans stated the date for Public Hearing for th Zoning had been set for August 19; however, the publication was not made in time to meet the 15 day requirement, and stated that another date would have to be set. Rice moved: Touchton Seconded: The Date for Public Hearing on the zoning south of Belleview, east and west of Broadway, be set for August 26, 1964, property to be so posted, and publication to be given in the official City Newspaper. The motion carried unanimously. III. (B) ANNEXATION SOUTH OF BELLEVIEW, EAST OF BROADWAY. This possible annexation was again thoroughly discussed. Touchton moved: Rice seconded: The Planning Commission recommend to City Counc~l approval of the anticipated petition for annexation of the five (5) acres owned by Mr. DeMoulin adj o ining the property owned by Mr. Pasternak and Mr. Elenbogen immediat el y to the south, subject to meeting required annexation stipulations. Mr. Fullerton stated he did not feel a recommendation could be made until a petition had been presented. Discussion ensued. Mr. Fullerton also reviewed the situation resulting from this recent annexation by Englewood. He stated he felt an agreement between Englewood and Littleton was made as indicated in Minutes of a meeting between the two cities' officials and recorded by Mr. John Curtice. Mr. Carlson asked if these Minutes recorded by Mr. Curtice had ever been officially approved as Minutes, or were they notes taken at a meeting? Mr. Fullerton indicated he was not sure if they had been approved as official Minutes or not. Mr. Parkinson stated he would like further clarification as to the "agreement", but stated that he did not feel the "Minutes" could be considered if they were not approved "Official Minutes." Further discussion ensued. Mr. Touchton stated he strongly felt that City officials could not pre-empt citizens' choice on such a matter as annexation to what City. Mr. Whitcomb reviewed the annexation of the area west of Federal Boulevard, east of Lowell Boulevard, north of Belleview and s outh of Saratoga Avenue. He stated that citizens in the area had wanted to annex to Littleton, but Littleton had indicated they would not annex north of Belleview Avenue because they could not service the area, and to avoid annexation to Denver, the property owners annexed to Englewood. Further discussion ensued. Upon the call of the role, the vote: AYES: NAYS: Whitcomb, Touchton, Rice, Parkinson, Carlson Fullerton The motion carried. VI. MR. BURKHARDT STREET DEDICATION East Kenyon --Clarkson to Washington Street. CASE #18-64 Mrs. Romans stated that Mr. Burkhardt had contacted her office in regard a possible street dedication on East Kenyon. He does not think the south 20 feet has ever been dedicated. The Planning Staff has checked records, and feels it has been dedicated; no record of a vacation has been located. She stated she had talked to the City Attorney to determine whether a second dedication could be obtained and whether any complications could arise from accepting a second dedication. He has indicated he did not feel there would be any problem in accepting the second dedication. Discussion followed. Fullerton moved: Rice seconded: The Planning Commission recommend to City Council that the 20 foot dedication on the s o uth side of East Kenyon Avenue from South Clarkson to South Washington Street be accepted, if offered. The motion carried unanimou:; ly. I I I I I I Page 791 VII. TRUCK ROUTES Mrs. Romans reviewed the study of area truck routes. Several meetings of officials of the State, Cities, County and ICRPC have been held. It was stated that there is a possibility that South Zuni Street maybe opened to truck traffic between Highway 70 and the City of Sheridan's north City Limit line, and it is hoped that the County Commissioners may agree to surface it for truck traffic. General discussion of truck routes ensued. Mr. Carlson then stated that Mr. Waggoner, City Engineer, was present to discuss the bridge over the Platte River at Dartmouth Avenue. Mr. Waggoner stated he had met with the contractors constructing the bridge over the Platte River in Adams County. This is a two-lane bridge. After considerable discus s ion, he stated the contractor felt a comparable bridge could be constructed acro ss the River at Dartmouth for $60,000. Mr. Waggoner stated the bridge would have to span 2 30 feet across the River. It would be capable of carrying truck traffic; would be 34 foot wide, with 30 foot roadway width. Further discussion ensued. Parkinson moved: Fullerton seconded: The Planning Commission recommend to City Council that consideration be given to placing in the 1 9 65 Budget sufficient funds to finance construc- tion of the bridg~ across the Platte River at Dartmouth Avenue from 1965 Operating Funds. Mr. Fullerton requested that the Engineer's report be made to the Council giving specification, etc. The motion carried unanimously. The bridge across the River at West Union Avenue was discussed. Mr. Waggoner said he did not have any definite figures on this particular bridge; but felt it could be constructed for possibly $45,000; the span across the River at this point would be 150 feet. Further discussion ensued on the widening of South Bannock Street and the improvement of the bridge on Hampden across Dry Creek. Mrs. Romans asked Mr. Waggoner if an estimate could be submitted for a bridge across the City Ditch between Cherokee and Delaware on Kenyon. A recess of the meeting was called at 10:00 p.m. The meeting was called to order at 10:15 p.m. VIII. NEW ENGLEWOOD TRAFFIC CASE #C 9-64 A letter from Mr. Gerri Von Frellick, New Englewood Company, to Mrs. Dorothy J. Romans, was read the Commission. This letter set forth several items on which Mr. Von Frellick ne e ds to have definite decisions in order that leases can be completed. Discussion ensued. Mrs. Romans reviewed the meeting with Messrs. Bower, Shumate, Haase, Mertin, State Highway Depart- ment; Messrs. Carlson, Love, Dial, City Officials; Mr. Von Frellick, Mr. Eachon and Mr. Small on the traffic plans submitted by Mr. Von Frellick and by the Traffic Consultant, Mr. James Small. Mr. Shumate indicated that the State Highway Department was vitally concerned in this project and asked that detailed plans be submitted to the State Highway Department. Mr. Rice stated he now felt that all traffic plans to be submitted to the Highway Department should first come through the Planning ~nd Traffic Department. He stated he felt the meetings with interested citizens and the Highway Department and other organizations have been beneficial, but feels the development is now to the point where all work must come directly through the Planning and Traffia Department. Mr. Carlson concurred with Mr. Rice. Further discussion ensued. The points set forth in Mr. Von Frellick's letter were discussed. A definite traffic pattern on West Floyd Avenue has been approved and a contract signed. The revised Master Street Plan for the Downtown Area has not been adopted, however, and it was suggested that members of the Commission study this situation and be prepared to discuss it at the August 19th meeting. It was felt that any contacts with the State Highway Department must first come through the City Planning and Traffic Office. The proposed interchange at Dartmouth and Santa Fe was discussed. It was felt this problem was nearing a solution in light of the previous recommendation on construction of a bridge across the river from Operating Funds in the 1965 Budget. IX. TRAFFIC REPORT--SMALL, COOLEY ASSOCIATES. The Preliminary Draft of the Traffic Report submitted by Mr. Small, Traffic Consultant, was reviewed and discussed. The improvements made since Mr. Small began employment and suggestions made by Mr. Small were also discussed. General discussion followed. It was the feeling of the Commission that no decision could be made until Mr. Small has submitted his Final Report, and it has been reviewed. It was moved, and seconded that the meeting be adjourned.
