Mr. Whitcomb felt that it would be helpful to add the number of parking spaces and cost figures to the over-all map. Mr. Fullerton suggested that perhaps the bibliography should be arranted in sections for clarity. He also felt the addition of the words "excess" and "deficient" to the last two items on pages 29 through 34 would be helpful. Various traffic and parking area problems and possible solutions were discussed. Mrs. Romans distributed copies of the Commercial Area Planning Study from ICRPC, which had been loaned for examination. She also stated that staff members of ICRPC would be happy to attend a meeting of our Planning and Zoning Commission to discuss their studies on Transporta- tion and Commercial Area Planning. CALL TO ORDER. CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION REGULAR MEETING NOVEMBER 4, 1964 The regular meeting of the City Planning and Zoning Commission was called to order by Chairman Carlson at 8:10 P. M. Members present: Whitcomb; Touchton; Fullerton; Carlson Romans, Ex-officio Members absent: Rice; Parkinson Also present: Planning Assistant Monson Audience: Messrs. Shelton; Parchen; Watson; Smith; and Robson. Mr. Carlson welcomed the audience to the meeting. II. APPROVAL OF MINUTES. Mr. Fullerton moved: Mr. Touchton seconded: The Minutes of October 7, 1964 and October 13, 1964, be approved as presented. The motion carried unanimously. III. ENGLEWOOD INVESTMENT COMPANY Ray Shelton Mr. Fullerton moved: SUBDIVISION Lehigh Park Mr. Touchton seconded: The Public Hearing on Lehigh Park be opened. The motion carried unanimously. CASE #12-64D Mrs. Romans reported that the Public Hearing had been set for October 21, 1964. A quorum of the Commission was not present on that evening and no action could be taken. She stated she had checked with the City Attorney on the situation; it was his opinion the adjoining property owners would not need to be r e notified of the date of the Public Hearing. There were no ob- jections to the proposed subdivision. Mr. Parkinson entered and took his place on the Commission. Mr. Monson reviewed comments from the Utilities Departments and companies; no objections were noted. The Plat appears in order for referral to the City Council. Mr. Fullerton moved: Mr. Whitcomb seconded: The Public Hearing be closed. The motion carried unanimously. Mr. Fullerton moved: Mr. Whitcomb seconded: The Commission recommend the Final Plat of Lehigh Park Subdivision to the City Council for f~vor~ble consideration. The motion carried unanimously. Mr. Shelton stated he had been informed this parcel was a portion of a subdivision prior to being used as a dump. The streets in this previous subdivision had been vacated, but the easements had not. He asked what effect this would have on the acceptance by City Council. I I I I I I Page 807 Mr. Monson stated this has been checked by the City Engineer's Office and by the City Attorney. The easements are not presently in use,. but would need to be vacated by City Council prior to acceptance of the final plat of Lehigh Park. Discussion ensued. Mr. Fullerton moved: Mr. Parkinson seconded: The City Council .be advised that the Lehigh Park Subdivision does have easements existing that need to be vacated, and that such vacation be accomplished prior to acceptance of the Final Plat. The motion carried unanimou sly. IV. COUNTY ENGINEER -CITY MANAGER CORRESPONDENCE. Copies of a letter sent by Mr. Dial to County Engineer Burno in regard the needs of the City and State Highway were sent to Commission members . previously for their consideration and review. Considerable discussion ensued. V. PAR-:-MAC REALTY Mr. Parchen and Mr. Watson. USE NOT MENTIONED Stained Glass Studio CASE #24-64 Mr. Parchen was present, as was his client, Mr. Watson. Mr. Parchen stated at the present time, they needed to know the feeling of the Commission in regards to the Stained Glass Studio which Mr. Watson operates. This use is not specifically mentioned as a permitted use in any of the Business Districts, and they have been referred to the Planning Department by Chief Building Inspector Wallace, per Sections 22.4-11 b (16) and 22.5-19 of the 1963 Comprehensive Zoning Ordinance, which read: 22.4-11 b (16): Any similar lawful use which, in the opinion of the Commission, is not objectionable to nearby property by reason of odor, dust, smoke, fumes, gas, heat, glare, radiation, or vibration, or is not hazardous to the health and property of the surrounding area through danger of fire or explosion. 22.5 ~19: Uses not Mentioned. Upon recommendation of the Planning Commission, a Building Permit may be issued for any lawful use not provided for in this Ordinance, when, in the opinion of the Commission such use is compatible with and not objectionable to nearby property by reason of odor,dust, fumes, gas, noise, radiation, heat, glare or vibration or is not hazardous to the health and property of the surrounding areas through danger of fire or explosion. Mr. Watson discussed his studio; work is done for commercial b u ildings, churches, mortuaries, etc. There is no smoke, odor, dust, noise, or other offensive condition in connection with his business. He stated h e did no t plan to enlarge his business; ten employees would probably be the most he would consider. He stated they do have electric kilns in connection with his business, which uses either 220 or 440 voltage; the maximum heat would be 2000 °. He emphasized that his type of business needs a location where there would be plenty of natural light. Mr. Watson stated his glass is imported, and there would possibly be a semi- truck delivery once per month. Discussion followed. Mr. Touchton moved: Mr. Whitcomb seconded: The Commission recommend to the Chief Building Inspector that a stained glass studio be considered in accord and harmonious to the B-2 Zone District, in accordance with Sections 22.4-11 b (16) and 22.5-19 of the Comprehensive Zoning Ordinance. Further discussion ensued. The question was called. The motion carried unanimously. VI. I.C.R.P.C. J~ K. Smith John Robson REPORTS Commercial Area Planning Major Thoroughfares Mrs. Romans stated Mr. Smith and Mr. Robson had been asked to attend the Commission meeting to discuss two recent reports completed by ICRPC, Commercial Area Planning and Major Thoroughfares, and to give the newer members of the Commission some background information on the function of the ICRPC. Mr. Smith, Executive Director, stated the membership of ICRPC is composed of representatives of the counties of Adams, Arapahoe, Denver, Douglas, and Jefferson. These counties have two members each; municipalities within the counties have one member to serve on the commission, plus an alternate. Cost t o the municipalities is $25.00 per year. The cost to the counties is 8¢ per capita. Mr. Smith briefly outlined some of the studies the ICRPC is currently conducting: a water survey; flood plain survey; refuse disposal study; industrial study; open and regional parks study; thoroughfare study; population study; air pollution study; codes and ordinances study, which encompasses subdivision regulations, housing codes, etc. Mr. Smith commended the Englewood Planning Department for the technical assistance they are providing on these last t . I s ud1es. Page 808 Mr. Smith stated that some of these studies are done by contract, such as the Flood Plain study, which is under contract to the U.S. Corps of Engineers. Mr. Touchton asked a bo ut the progress of the Housing Code? Mr. Smith stated that at the present time they are working toward a uniform Code for the metroplitan area. A questionnaire is being reviewed and answered on the type of Housing Code that is being enforced, how it is being enforced, and whether or not it is a model code. Mr. Smith stated they had gotten copies of Codes from all over the United States for study. Further discussion ensued. It was explained by Mr. Smith that a Code could not be compiled by ICRPC which could be readily adopted by any one municipality; it will be available as a guide, and portions applicable to any municipality may be adopted by that mun i cipality. The Flood Plain study was discussed. In several areas in the City of Englewood, building permits have been refused as the area is in an existing Flood Plain or drainage area. Mr. Smith stated the use of property could not be deprived the owner; however, control measures could be adopted to permit specific uses, provided the construction meets specifications aimed at eliminating damage to the property in the Flood Plain as well as properties adjoining. Mr. Smith stated the Flood Pla i n study would be on a much broader basis than the e xamples cited, but should be applicable to the smaller areas. A recess was called at 9:40 P.M. Mr. Smith stated that "corridors" of traffic are indicated , not specific streets; and that the ICRPC will not issue a Final Draft of such report. T he ICRPC has no authority, by Statute, to designate highways; this authority is vested in the State Highway Department, and any final report will have to be issued by that Department. Mr. Carlson extended the appreciation of the Commission to Mr. Smith and Mr. Robson. The Dinner meeting to be held November 17, 1964 was discussed. Mr. Smith advised that all registrations should be made as early as possible. VII. NEXT REGULAR MEETING. Mr. Carlson stated the next regular meeting of the Commission is scheduled for November 18, 1964; however, he will be out of town until the 21st of November. He asked the Commission's pleasure on the next definite date for a regular meeting. November 25, 1964, was scheduled as the next regular meeting date for the Commission. VIII. Mr. Fullerton discussed the Public Hearing before the City Council on the zoning of the recently annexed area to the south of Belleview, east and west of Broadway. Considerable discussion ensued. Campbell, in regard to property at the southwest corner of South Fox Street and Highway #70. It is presently zoned I-1, Light Industrial, in which a motel or mo t o r court is a Conditional Use, which must be approved by the Commission. Mr. Parchen stated his client is interested in a parcel which is 125' x 250' or possibly 300'. The 125' frontage is on Highway #70, and the 250' or 300'
