CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION January 9, 1964 Page 741 The regular meeting of the Englewood Planning and Zoning Commission was called to order at 7:15 P.M. by Vice-Chairman Touchton. Members present: Carlson; Fullerton; Hill; Rice; Touchton Romans, Ex-o f ficio Members absent: Starkloff Also present: Wayne Monson Members and staff were introduced ; Mr. Rice and Mr. Fullerton, City Council representatives, were welcomed to the meeting. II. APPROVAL OF MINUTES. Carlson moved: Fullerton seconded: The Minutes of December 19, 1963, be approved as presented. The motion carried unanimously. III. CHRYSLER CORPORATION ALLEY VACATION 5000 Block South Broadway/South Acoma Alley CASE #1-64 Mr. Carpenter, of Haskell, Helmick , Carpenter and Evans Law Firm, introduced Messrs. Hartman and Archer of the Chrysler Corporation from Detroit , and Mr. Dorman of Van Schaack and Company. The Chrysler Corporation has an option to purchase Lots 1 through 16 and Lots 37 through 48 of Block 8, Van Meters' Addition. The Corporation is requesting the vacation of that portion of the alley not now used as an alley. Mr. Carpenter pointed out that the alley is completely dedicated, but not entirely used, as there is an existing structure across the alley. A new alley would be dedicated from the existing alley west to South Acoma through portions of Lots 15 and 16.. The dedication, as proposed, would be 31 feet wide; a 15 foot turning radius would be required by the City for the newly dedicated portion of the alley. Mr. Carpenter presented petitions signed by all owners of property in the 5000 block but one --owner of Lots 19 thru 22 --favoring the vacation as proposed. Mr. Rice asked what the objection was given by the property owner who refused to sign. Mr. Carpenter stated the objection has been given as opposing the vacation of only a portion of the alley ; that if the vacation was for the entire alley, there would be no objection. Mr. Carpenter stated a petition had been signed by the Skelly Oil Company in favor of the vacation as proposed; however, the petition has not yet been returned. A letter from the Skelly Company to Mr. Carpenter was filed with the Commission. It was stated the building will front on Broadway, extending back across the presently dedicated alley. The rest of the property will be used as a new and used car lot. Mr. Carpenter further stated there were no water or sewer lines in the alley. There are existing Telephone Company poles with the telephone lines and public service lines. These poles will need to be relocated ; Mr . Carpenter indicated letters would be obtained from the two utility companies when an agreement has been reached on the relocation. The paving of the proposed alley dedication west to Acoma was discussed. Mr. Rice stated he felt it would be to the benefit of everyone if the proposed alley were paved. Mr. Touchton asked if a recent traffic study had been made of the area. Mrs. Romans stated there had not; however, the congesting existing in that block and the Belleview-Broadway intersection is known. It was noted by Mrs. Romans that on previous alley vacations and re-dedications , letters have been sent to adjoining and adjacent property owners notifying them of such proposal and asking for comments or objections. It was suggested that a letter might be sent to the property owner who had not signed the petition. Discussion ensued. Rice moved: Fullerton seconded: The Commission take the proposed alley vacation and re-dedication under advisement . The motion carried unanimously. IV. FOUT SUBDIVISION Quincy and Jason CASE #10-63E Mr. Monson has reported that the Preliminary Plat of the Fout Subdivision is in order. The matter of the Bond required by the Subdivision Regulations to be posted before the approval of the Final Plat by the Council in lieu of the installation of improvements was discussed. A Bond of approximately $15,000 will be necessary to insure the proper improvements. Mr. Carlson stated if a Bond was required by the Subdivision Regulations ," the rule should be followed . Further brief discussion ensued. Mr. Touchton reviewed Mr. Eitel's presentation at the last meeting concerning the Subdivision Regulations. It was the feeling of the Commission the procedure of requiring a Performance Bond of Sub- dividers should be upheld. Page 742 V. NEW BUSINESS. A thank-you note from Mr. Rice to the Commission for the plant sent him during his illness was read by the Commission. Mr. Rice moved: Mr. Hill seconded: The meeting be adjourned. CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION January 23, 1964 The regular meeting of the Planning and Zoning Commission was called to order by Vice- Chairman Touchton at 8:30 p.m. Members present: Members absent: Carlson; Fullerton; Hill; Rice; Starklof f; Touchton Romans, Ex-officio None Also present: Wayne Monson, Planning Aide Mr. J. L. Parkinson II. APPROVAL OF MINUTES. Fullerton moved: Rice seconded: The Minutes of January 9, 1964 , be approved as presented. The motion carried unanimously. III. CHRYSLER CORPORATION ALLEY VACATION 5000 Block South Acoma /Broadway CASE #l-64A Mr. Carpenter was present on behalf of the Chrysler Corporation. He reviewed the request for the alley vacation and the proposed dedication of an alley west to Acoma. There are Mountain States Telephone Company poles existing in the present alley, used by both the Telephone Company and Public Service Company. No water or sewer mains are in existance in the alley. Mr. Carpenter stated he had met with engineers from both Companies and they had agreed to the vacation subject to the granting of easements to the Mountain States Telephone Company and Public Service Company. At such time as the vacation is approved by Council, and Chrysler Corporation purchases the property, said existing easements would then be deeded to Chrysler Corporation by the Telephone Company and Public Service Company. The following memorandum from Mr. Davies was read regarding the paving of the alley: "TO: Dorothy Romans, Planning Director FROM: W. 0. Davies, City Engineer DATE: January 17, 1964 SUBJECT: Alley Vacation In reference to the alley vacation, 5000 block between Broadway and So. Acoma, the Engineering Department sees no forseen difficulty with the vacation of approximately one-half the alley, the Northerly portion, and a re-dedication of 31 feet in Lots 15 or 16 with the condition that this alley be paved with concrete for a 20 foot width. It would not be necessary to dedicate additional area for a 15 foot radius as this alley could hug the Northerly side and give us a 15 fo ot radius within the 31 fo ot area. As the records show there is no water or sewer in the alley, I see no forseen problem. There is no problem in drainage in this 31 foot area to be dedicated as the drainage would be west to Acoma with sufficient fall. W.O.
