The motion carried unanimously. V. FUTURE MEETINGS. Mrs. Romans discussed a meeting to be held August 31, 1965, at 7:00 p.m, at the Inter-County Regional Planning Commission offices, 2475 West 26th Avenue. This meeting is to review the redevelopment of the Platte River Flood Plain area. She urged all members of the Commission who could to attend this meeting. Discussion ensued. It was moved and seconded to adjourn the meeting. The motion carried unanimously, and the meeting was declared adjourned at 12 midnight. Gertrude G. CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION EXECUTIVE SESSION September 8, 1965 The Special Meeting of the City Planning and Zoning Commission was called to order at 8:05 P.M. by Chairman Carlson. Members present: Woods , Touchton, Rice, Fullerton, Carlson, Romans, Ex-officio Members absent: Parkinson Also present: City Attorney Criswell II. BEAU MONDE, INC. KLZ Site REZONING R-1-A to R-3-B CASE #12-65B August 25, 1965 July 28, 1965 Mrs. Romans stated that notice of postponement of the regular meeting from September 8 , 1965 , to September 15, 1965, had been given twice in the Englewood Herald. Mrs. Romans said she had talked to Mr. Davis of Von Frellick Associates about the meeting between Mr. Von Frellick's Company and representatives from the Northeast Englewood Citizens' Committee and the Committee to Preserve Zoning Integrity, which was discussed by those per- sons the night of the Public Hearing on the requested rezoning of the KLZ Site. Mr. Davis told her that Mr. Dittemore and Mr. Hiester would discuss the agreement further on September 9, 1965, following which they would meet with Messrs. Feder, Deuth, and other residents and property owners in the area, and that any agreement which is reached by the interested parties will be presented to the Planning Commission. Mrs. Romans stated she has told Mr. Davis that the Commission and the Council would not be bound by any agreement that might be reached; however, they would certainly take such an agreement into consideration. She stated she had discussed the City's request to consider the possiblity of making Highway 70 and Floyd Avenue a one-way cuplet with Mr. Merten of the State Highway Department. Mr. Merten has indicated it could be as much as another month before a recommendation is made by the Highway Department. Mr. Parkinson entered and took his place on the Commission. Mrs. Romans stated the tape recording of the Public Hearing was available if members wished to hear any portion of the Hearing. The Director reported she had been reviewing information on the subject site, which has been in the City files since 1961. The land was used semi-agriculturally prior to its use for the radio transmitting towers. This radio tower use would be permitted as a "special exception" use in the present Arapahoe County "Open Zone District", and therefore, could be presumed to have been non-conforming under a residential district zoning. Development of the surrounding area was reviewed; Hampden Avenue is now State Highway #70, and projected as a freeway. This six-lane highway has been developed on the south boundary of the subject Page 868 site· Kent School has been constructed on the east boundary; a rest home and mortuary are on ' ' the west boundary of the site; the area to the north has been developed residentially. The area to t h e west between Highway 70 and Girard from Lafayette to the Core Area has been zoned for two -fa mil y and multi-family use. Commercial zoning has been imposed on a parcel of land to the southwest, and zoning to permit a motel complex is to the south and east. It was pointed out that consideration should be given to the use of the land at the time of annexation to the City, which use was as a radio transmitting tower site. The site has been considered for commercial zoning on three previous occasions: at the time of annexation in 1961, again in September of 1962 , and when the 1963 Comprehensive Zoning Ordinance was adopted. It was the opinion of the majority of the Commission members on each of these three occasions, that the best use of the site was for a shopping center. Since then, however, the location of the shopping center has been moved to the Englewood City Park site. This action was approved by a vote of the people, and has been upheld by a lower Court decision and by the Colorado Supreme Court. In view of this development, it would not be feasible to consider continuing commercial development of this site, and it would seem that another use should be considered for the land. Studies by Inter-County Regional Planning Commission, DMATS , the Denver Planning Office, and the Englewood Planning Office were briefly reviewed; the studies have projected multi-family usage south to Quincy Avenue by 1980. Comparative zone analysis studies indicate that the City of Englewood is presently under-zoned in multi-family classification. Mr. Rice asked if the Commission were to fin d a change of zone were justified on the site, would the findings have to be based only on information presented at the Public Hearing, or could the Commission also base their findings on general information on the area over a period of time? Mr. Criswell stated the Commission has the authorization and privilege to use information other than that presented at a Public Hearing; he further stated he felt the Commission has an obligation to consider all information. Mrs. Romans further reviewed the Land Use Study. Mr. Fullerton stated he felt the developed surrounding areas should be given more consideration than a comparative study of the entire City. He did not feel the study would give a sound basis for zoning a particular site. Discussion of zoning justification followed. Mr. Parkinson discussed the slow development of the R-3 districts in Englewood, and asked if additional R-3 zoning would compound the problem? Mr. Rice stated the problem, he felt, was the varied ownerships in the presently zoned R-3 districts; the subject site is in one owner- ship. He felt this factor would be important in encouraging development of the site. Mr. Rice also pointed out that there is presently much activity in assembling building sites in the present R-3 areas. Mr. Criswell pointed out the Statutes stipulate that zoning must be in accord with a master plan. The Comprehensive Plan for the City was discussed; Mrs. Romans explained the concept of the plan and the various city activities it encompasses. Further discussion of the requested zoning ensued. It was pointed out that the Commission must consider the zoning of this s i te objectively; the uses of the surrounding area were again reviewed. Mr. Criswell stated the Commission should attempt to set forth all changes in the area which justify a change of zoning; and, secondly, zoning must not be accomplished for the interest of one person, but for the benefit of the public welfare. Mr. Criswell reviewed changes in city zoning from the 1955 Zoning Map and the 1963 Comprehensive Zoning Map. The area between Hampden and Girard, Lafayette west to the Clarkson-Emerson alley was zoned R-3-B in the 1963 Comprehensive Zoning Ordinance. The area south of Hampden between the Marion-Lafayette alley and Emerson was zoned R-2-B by the 1963 Comprehensive Zoning Ordinance. These rezonings in- dicate changes in the surrounding area in very recent years. Discussion followed. The possibility of restrictive covenants being written into an agreement was discussed. It was emphasized this would have no bearing on the granting of a rezoning request by the City. Mr. Criswell again requested that any decision reached by the Commission be based on the history of the site, the changes in the neighborhood and the benefit of the public welfare. III. REGULAR MEETING DATE. The next regular meeting of the Commission will be September 15, 1965. Rice moved: Woods seconded: The meeting be adjourned.
