MEMORANDUM TO THE ENGLEWOOD CITY COUNCIL REGARDING ACTION OR RECOMMENDATION OF THE CITY
PLANNING AND ZONING COMMISSION.
DATE: December 8, 1965
SUBJECT: South Cherokee Circle Street Dedication
RECOMMENDATION: The Planning Commission recommend to City Council the dedication of the
roadway to the south of City Hall between South Elati and Cherokee Circle
be approved provided: (1) the access-ramp to Girard on the north end
of the Library be moved further north to provide additional parking for
the Library and City Hall; (2) A 50 ft. right-of-way for Cherokee Circle
extended be designated.

I. CALL TO ORDER.
CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION
December 15, 1965
Special Meeting
The Special Meeting of the City Planning and Zoning Commission was called to order at 8:05
P.M., Chairman Carlson presiding.
Members present: Woods, Touchton, Rice, Fullerton, Carlson
Romans, Ex-officio

II. NOTICE OF MEETING VERIFICATION.
Members in attendance verified notification of the Special Meeting by telephone call.
III. SUBDIVISION CASE #19-65B
Hampden Hills Baptist Church
Mr. Banta was in attendance on behalf of the Hampden Hills Baptist Church, requesting Com-
mission approval of a 12 foot utility easement between Block 1 and Block 2 of the proposed
subdivision. The Subdivision Regulations require a 16 foot easement.
Mr. Parkinson entered and took his seat with the Commission.
Mr. Banta stated he is suggesting the 12 foot easement to bring the subdivision into conformance
with other subdivisions in the immediate area. He stated he understood that water, sewer,
and gas service would be provided from the street. The only utilities using the easement
would be Public Service for electric lines, and the telephone company.
Discussion followed. Mr. Fullerton asked how much space would be required to maintain the
electric lines? Mr. Rice stated the easement must provide adequate access; he did not cite
an exact width required for the easement. He pointed out that an easement does not deny use
of the land, but the use cannot be of a permanent nature, such as a structure. Further dis-
cussion followed; Mrs. Romans cited Section 21.4-5(e) (1) of the Municipal Code, which section
sets forth the 16 foot easement requirement. It is the recommendation of the staff that the
easement be 16 feet.
Mr. Carlson asked Mr. Banta if consideration would be given to an easement of 16 feet, if 10
feet were given from Block 2, the site on which the Church is situated, and 6 feet from Block

1, the area to be platted for residential sites. This would enable the purchasers of the
proposed residential lots to utilize an additional portion of their land . Discussion
followed; Mr. Banta stated he would discuss the proposed 6 /10 easement with the Church
Board.
IV. NEW ENGLEWOOD CASE #9-64
Mr. Dial announced that a ceremony will be held December 16, 1965, in the Community Room of
City Hall for the closing of the City Park sale to New Englewood Company. The ceremony is
scheduled for 11 A.M.; all members of the Commission were invited to attend.
V. STREET DEDICATION CASE #16-65C
Cherokee Circle to South Elati
Mr. Carlson stated that it has been suggested by the Planning Director that the Commission
reconsider the recommendation to City Council made at the regular meeting on December 8,
1965.
Fullerton moved:
Touchton seconded: The Planning Commission reconsider the recommendation made to City
Council at the regular meeting of December 8, 1965, on the extension
of South Cherokee Circle to South Elati Street.
The motion carried unanimously.
Mrs. Romans stated the recommendation made on December 8, 1965, had been discussed with
New Englewood officials, and after this discussion, it would appear that tying the street
right-of-way for Girard Avenue into the recommendation might possibly be premature. The
right-of-way on Cherokee Circle extended has been proposed by New Englewood as 40 feet ,
an extension of the right-of-way width on Cherokee Circle. The staff and Commission,
anticipating the projected volume of traffic, recommended the right-of-way on Cherokee
Circle extended be increased to 50 feet. To compensate for City Hall parking which will
be lost as a result of the street extension, it is proposed the access-ramp into approximately
Girard Avenue to the north of the City Hall complex be moved further north to provide
additional parking on the north side of the City Hall and Library.
An overlay showing parking originally planned, and available parking following implementation
of three different plans, was studied by the Commission. Considerable discussion followed.
Fullerton moved :
Touchton seconded: Section 2 of the Commission recommendation to Council, dated December 8,
1965, be deleted.
The motion carried unanimously.
VI. ZONING ORDINANCE CLARIFICATION
Auto Repair Shops in B-2 District.
CASE #20-65
The Director stated that clarification of Section 22.4-11 b has been requested by the
Building Department. An auto repair shop is permitted in a B-1 District, but only as an
accessory to an auto sales use. The B-2 District will permit any use in B-1; however, an
auto repair shop is still permitted only as an accessory use.
Discussion ensued; it was pointed out that some gasoline service stations are doing ex-
tensive auto repair work. This would appear to be in conflict with the Zoning Ordinance.
Members felt these auto repair shops should be subject to Commission consideration.
Parkinson moved :
Woods seconded: The intent of the 1963 Comprehensive Zoning Ordinance was not to allow
auto repair shops in the B-2 Zone District as a permitted use. It is
felt by the Commission that it is unwise at this time to allow auto
repair shops except as currently provided in the 1963 Comprehensive
Zoning Ordinance.
The motion carried unanimously.
VII. MISCELLANEOUS.
Mrs. Romans showed slides taken at various points along the Platte River. These slides
point up the necessity .for water pollution control and the possibilities of developing
portions of the Platte River for recreational purposes.
Slides of the Englewood Business District were also shown . Some were taken while the angle
parking was in effect on South Broadway, and others were taken following the installation
of parallel parking. Both sets of slides were taken on a Friday shortly before noon.
Traffic congestion, which was very evident in the slides taken when angle parking was in
effect, was contrasted to the smooth traffic flow on Broadway after parallel parking became
effective.
VIII. FUTURE MEETINGS.
The next regular meeting of the Commission will be December 22, 1965.

I . CALL TO ORDER .
The regular meeting of the City Planning and Zoning Commission was called to order at 8:15
P.M. by Chairman Carlson.

Members absent: Fullerton
Also present: Staff members Rod Strahm and Pat Hermann; Mr. Gass, Architect; and Herald
Report Scheiner.
II. APPROVAL OF MINUTES.
Mr. Carlson stated there were minutes from the Regular Meeting of December 8, 1965, and
from the Special Meeting of December 15, 1965, to be considered for approval.

written.

III. AMERICAN INSTITUTE OF ARCHITECTS.
"No Time for Ugliness"
Mrs. Romans introduced Mr. Gass, of Gass-Gay Associated Architects. Mr. Gass was present to
show the film "No Time for Ugliness", and to discuss the film with members.
Following the presentation of the film, Mr. Parkinson commented that he thought it was a
very interesting and informing film, and asked Mr. Gass what Governmental bodies could do to
encourage a more aesthetic development of the cities? Mr. Gass stated that the improvement
of a city was a responsibility of the people as a whole; but it is the hope of the Institute
of Architects that the various governmental bodies will encourage an interest on the part
of the people in their city to the extent that it will eventually bring about the necessary
and desirable improvements. Mr. Gass pointed out that ordinances controlling signs and bill-
boards, if enforced, would do much for the beautification of a city. He stated that all
citizens must be made aware, somehow, of the vitalness of beauty in their cities.
Mrs. Romans asked if the Institute was encouraging aesthetic considerations in the zoning
ordinances? Mr. Gass stated they could not give requirements on the type of construction,
the type of materials used, etc.; however, he stated that spot zoning should be eliminated,
and the separation of vehicular and pedestrian traffic should be accomplished, if only from
a safety viewpoint.
The possible development of the Platte River flood plain throughout the metropolitan area
was discussed. It was asked of Mr. Gass if he thought it could be developed similarly to
the San Antonio River in San Antonio, Texas? Mr. Gass stated it would be much more difficult,
in that the Platte River flows through several different municipalities; the various governing
bodies would have to be in agreement on the development to accomplish this. The San Antonio
River was subject to only one governing body, the City of San Antonio.
Mr. Carlson discussed the New Englewood shopping area which is to be built across the street
from the City Hall. Mr. Gass agreed that the present downtown merchants have a tremendous
opportunity if they will work together to beautify the existing commercial area, and to offer
a wider selection of merchandise. He also agreed that the new shopping area would very
probably be good for the downtown merchants, in that it will give them competition, which
in turn, will encourage them to improve their area.
Mrs. Romans asked if the American Institute of Architects would give aid to communities that
are attempting to draft regulations for condominium or planned unit developments? Mr. Gass
stated that he did not feel any ordinance drafted could be comprehensive enough to give an
actual "yardstick" to a community; each project must be evaluated on its own merit.
Mr. Carlson expressed the appreciation of the Commission to Mr. Gass for the opportunity to
see the film and his willingness to discuss it with the members.
