CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION January 6, 1965 Regular Meeting Page 819 The regular meeting of the City Planning and Zoning Commi s sion was called to order by Chairman Carlson at 8:00 P.M. Members present: Touchton; Rice; Parkinson; Fullerton; Carlson Romans, Ex-officio Members absent; Whitcomb Also present: Planning Assistant Monson, Chief Building Inspector Wallace, Mr. Joe Berenbaum and Mr. Francis Byrne. II. APPROVAL OF MINUTES. Chairman Carlson stated the Minutes of December 30, 1964, were to be considered for approval. The Minutes were reviewed; Mr. Touchton asked for explanation of several comments noted in the Minutes. Discussion ensued. Parkinson mov ed : Fullerton seconded: The Minutes of December 30, 1964 be approved as written. The motion carried unanimously. III. YAL E-TEJON SUBDIVISION Mr. J. Berenbaum Mr. F. Byrne CASE #22-64C Mr. Berenbaum and Mr. Byrne were present for discussion and consideration of the preliminary design plan of their proposed subdivision in Northwest Englewood. Mr. Monson stated the amended preliminary design plan had been submitted, and was sent to the various utility companies and departments for their approval. He pointed out that while all returns were marked "approved", there were several factors noted in an attached reply from the City Engineer's Office. These are: "l. The 1,318.83 feet noted on the east side of the subdivision does not correspond with the distance shown on the previously subdivided Englewood Industrial Park. 2. West Bates Avenue right-of-way should be 60 ft. and not 3 0 ft. as shown. This would align with W. Bates Avenue to the east, where the developer has already platted a 60 ft. right-of-way and where the City of Englewood plans to pave, in the 196~ paving district. 3. The city may have need for additional right-of-way from Lot 5, Block 3, to better align Tejon St. through the W. Bates Avenue intersection. There are no measurements south of Bates, therefore we can not tell just how much of Lot 5 we would need. 4. We can not tell from the plat whether Vallejo St. will line up north and south of Bates Avenue. These measurements shoulw be shown." Mr. Monson stated another point had been brought forth in conversation with the Engineering Department, that being that the over-all dimensions on the northern boundary of the sub- division shows some discrepancy. None of these points had been noted on the first preliminary design plan which was submitted to the Engineering Department. Mr. Monson noted that all interior easements have been deleted from the amended plan, as per agreement with the utilities companies. Mr. Berenbaum stated this property has been surveyed three or four times, and at least twice in the past six months. He suggested the engineer for the Englewood Industrial Park re- survey that parcel to determine why t he dimensions noted in #1 of the City Engineer's com- ments did not agree. He commented he believed the discrepancy noted on the northern boundary was a mathematical error, and stated he would have his engineer check it out. He stated in regard to #2 of the City Engineer's comments, that at the present time, he felt 30 ft. dedication on West Bates Avenue was sufficient. If,at a future time, he and his associates did need a full 60 ft. dedication, and the property owners to the south did not indicate any cooperation in the dedication, they would dedicate the additional 30 ft. right-of-way. He commented that as far as #3 of the City Engineer's comments was concerned, he could not answer the question; he did not know how much additional right-of-way the City would need and com- mented that the Engineering Department apparently did not know either. Mr. Monson stated that what would be required in this instance to determine the additional right-of-way needed, would be the dimension from the land line on Tejon to the lot line. He said from this dimension the Engineering Department could determine the additional right-of-way. Mr. Berenbaum strongly protested the fourth point indicated by the Engineer's office as to whether Vallejo Street would line up north and south of West Bates Avenue. He felt it was unreasonable to ask that a 60 ft. street be lined up with a 30 ft. street. Mr. Monson commented that what was desired was to have the center lines of the res p ective dedications in line. Further discuss i on followed. Mr. Rice commented that he felt it was a very wise suggestion that the streets line up by center line if possible. Mr. Parkinson concurred with Mr. Rice. Mr. Byrne stated he felt they had c o mplied with the Subdivision Regulations of the City in the preparation of this plan. Page 820 Rice moved: Touchton seconded: The preliminary design of the Yale-Tejon Subdivision be approved subject to the correction of the existing discrepancy on the northern boundary, and further information on the lining up of the center line of streets within the subdivision with existing streets on the perimeter. Discussion followed. Mrs. Romans commented t h at Tejon was the major street in this particular instance, and felt it would be to the advantage of all to have further study on this situation. Upon the call of the role, the motion carried unanimously. IV. BUILDING CODE CHIEF BUI LD ING INSPECTOR WALLACE Mrs. Romans stated she had invited Chief Building Inspector Wallace to the meeting to dis- cuss the Building Code, Plumbing Code, and Electrical Code of the City. She felt this in- formation would be of much interest to the Commission. Mr. Wallace stated the 1940 Building Code had been revised, with the exception of the first three chapters, in 1954. The City has a Code which has been used since 1956 and is now in the process of being revised. Mr. Wallace said a committee is working on the Metropoligan Code at the present time, and have Chapter #33 ready for printing. The technical phases of the Co d e will be studied next. Mr. Wallace pointed out that the Building Code will not affect buildings presently erected, but will cover new construction. On the existing buildings, he felt any problems that are of a health-hazard nature should be controled by the Housing Code. He pointed out they are working toward a metropolitan code, with the exception of the administrative provisions, as each municipality has its own method of administration. The Code would be based on the Un i form Building Co de. Mr. Parkinson asked if there were some flexibility in the Code as t o the use of new materials in construction. Mr. Wallace replied there was; however, all new materiald had to have the approval of a national testing program. He emphasized these new materials would be allowed after they have been approved only if they are installed in the method used while testing. Mr. Wallace explained the Chapters of the Building Code and touched on any changes made in these Chapters. Mrs. Romans suggested that possibly the location of easements existing on the property also be required on the plot plan when it is presented prior to moving a structure or constructing a new building. Mr. Wallace stated this particular phase of the Code has been published once; it would now be a matter of amending the Code to include this provision, but he did indicate it was a matter of importance. Mr. Wallace reviewed the different classifications of construction, and the occupancy classifications. Brief discussion followed. He then reviewed Chapter #33, Stairs and Exits. The requirements o n stairs and exits were discussed; Mr. Fullerton asked about the provisions for fire protection in addition to the exits provided? Mr. Wallace stated that periodic inspections are made by the Fire Department; he further stated that particular section of the Code is being rewritten to require fire extinguishers and outlets. Mr. Wa llace briefly discussed the installation of incinerators inside structures; signs and billboard erection; and the fence ordinance. He noted that is now permissible to erect a 6 ft. fence in the back yard an d for 25 ft. from the back lot line; then the height must be reduced to a maximum of 5 ft. This was briefly discussed. Mr. Wallace reported the City is currently using the National Electric Code and the State Plumbing Code. Mr. Carlson extended to Mr. Wallace the appreciation of the Commission for his presentation. V. MISCELLANEOUS The Planning Director gave copies of an opinion written by Attorney Fred Winner on the creation of an improvement dis~rict to finance off-street parking. Mrs. Romans reviewed the schedule f o r the Planning Commission meeting on January 13 , 1965, at which time Mr. Miles, State Planning Office, and Mr. Smith, ICRPC, will be present to discuss Urban Renewal. Mrs. Romans asked the members to keep in mind the forthcoming conference in Boulder on February 12 and 13. Any one wishing to attend was asked to notify the Planning Department staff.
