The motion carried unanimously. V. BOARD OF ADJUSTMENT AND APPEALS The Planning Director stated that in a recent conversation with Mr. Dick Lone, Chairman of the Board of Adjustment and Appeals, he had suggested a meeting with the Board of Adjustment and Appeals and the Planning Commission to enable these two City bodies to better understand their respective functions and duties. After brief discussion, the Commission set a tentative date of February 24, 1965, for the joint meeting. VI. ARAPAHOE COUNTY SUBDIVISION REGULATIONS. Mrs. Romans reported on the Public Hearing which she attended on the adoption of revised Sub- division Regulations for Arapahoe County on February 16, 1965. VII. HOUSING CODE. A progress report on the Housing Code Committee of the Inter-County Regional Planning Commission was given. Mrs. Romans stated that Mr. Eitel is now working on the administrative section of the Code as it will be a p plicable to the City of Englewood. VIII. ASPO CONVENTION. The Planning Director stated the annual ASPO Convention will be held the last week of April. There have been funds budgeted for the attendance of the Director and one Commission member. She suggested the Commission consider designating a representative as soon as is feasible. No action was taken. IX. OBSERVATION TOUR. At the meeting of February 3, 1965, it was decided that "observation tours" by the Commission would be conducted. In view of the upcoming public hearings, Mrs. Romans asked the Commission to set a date for this tour. Discussion followed; it was agreed to make the tour on February 27, 1965. The Commission members would meet at Harold's Pancake House at 7:00 A.M. for breakfast and commence the tour at 8:00 A.M. X. REACTIVATION OF ILLEGAL USE. Mr. Rice cited an article in the Englewood Herald of February 15, 1965, which article concerned the reactivation of a real estate office in an R-1-C Zone. This use, according to the Herald article, was abandoned for the past six years. Mr. Rice felt this should be called to the atten t ion of the City Manager for further action. Discussion ensued; it was asked if the use were "non-co nforming" or illegal? After c o nsulting the 1940 and 1955 Zoning maps, it was pointed out that this particular area has never been zoned commercial and it could be assumed that the use is illegal, not non-conforming. Further discussion followed; Mr. Rice stated he would contact the City Manager for further action on this and other cases. It was moved and seconded to adjourn the meeting. Members present: Touchton, Rice , Fullerton, Carlson Romans, Ex-officio Members absent: Whitcomb, Parkinson I I I I I I Page 829 Also present: Board of Adjustment and Appeals members Lone , Cartwright, Clayton, and McGee; Chief Building Inspector Wallace, and Board Secretary Mrs. Schneider. Mr. Carlson stated that this was to be an informal meeting of the Planning Commission and Board of Adjustment and Appeals in order that the members could become better acquainted and to exchange ideas and discuss problems in common t o both groups. A general discussion of various sections of the 1963 Comprehensive Zoning Ordinance followed. Severai questions were raised concerning interpretation of provisions for Non-conforming Uses, the keeping of animals and pets, fences, radio antennae and off-street parking in residential areas. Mr. Parkinson was seated with the Commission at 9:00 P.M. It was the concensus of those present that a pro g rammed meeting of the two groups should be held at least quarterly throughout the year and more often if it were warranted. ROMANS Recording Secretary Pro Tern * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION MARCH 3, 1965 Regular Meeting Members present: Touchton, Fullerton, Carlson Romans, Ex-officio Members absent: Rice, Parkinson Inasmuch as a quorum of the Commission was not present, informal discussions were held on several subject s presently before the Commission. The proposed plans of the Englewood State Bank to be relocated on the present City Hall site were studied and discussed. Mr. Parkinson entered and took his place on the Commission. I. CALL TO ORDER. The regular meeting of the City Planning and Zoning Commission was called to order at 8 :50 P.M. by Chairman Carlson. Members present: Touchton, Parkinson, Fullerton, Carlson Romans, Ex-officio Members absent: Rice II. APPROVAL OF MINUTES. Mr. Carlson stated the Minutes of February 17, 1965, and February 24, 1965, were to be con- sidered for approval. Fullerton moved: Touchton seconded: The Minutes of February 17, 1965, and February 24, 1965, be approved as written. The motion carried unanimously. III. CITY OF ENGLEWOOD 5500 South Pearl ZONING R-3-B CASE #B-19-64C February 17, 1965 February 10, 1965 February 3, 1965 The Planning Director stated that it was the opinion of Assistant City Attorney Criswell this area could not be considered for zoning in view of the recent Supreme Court decision on the Brookridge annexation, and a lawsuit filed against the annexation of this subject property by the City of Littleton, He advised that the Commission should adopt a resolution vacating the date set for Public Hearing on zoning of this property and continuing the matter in- definitely until the outcome of these aforementioned lawsuits is known. Brief d iscussion followed. Fullerton moved: Touchton seconded: The Commission adopt the following resolution vacating the Public Hearing date previously set for zoning of the recently annexed property owned by Mr. DeMoulin. WHEREAS, the following described land , situate in the County of Arapahoe, State of Colorado, to wit:
