Also present: Board of Adjustment and Appeals members Lone , Cartwright, Clayton, and
McGee; Chief Building Inspector Wallace, and Board Secretary Mrs. Schneider.
Mr. Carlson stated that this was to be an informal meeting of the Planning Commission and
Board of Adjustment and Appeals in order that the members could become better acquainted and
to exchange ideas and discuss problems in common t o both groups.
A general discussion of various sections of the 1963 Comprehensive Zoning Ordinance followed.
Severai questions were raised concerning interpretation of provisions for Non-conforming
Uses, the keeping of animals and pets, fences, radio antennae and off-street parking in
residential areas.
Mr. Parkinson was seated with the Commission at 9:00 P.M.
It was the concensus of those present that a pro g rammed meeting of the two groups should be
held at least quarterly throughout the year and more often if it were warranted.
The meeting adjourned at 10:00 P .M.

CITY OF ENGLEWOOD PLANNING AND ZONING COMMISSION

Regular Meeting
Members present: Touchton, Fullerton, Carlson
Romans, Ex-officio
Members absent: Rice, Parkinson
Inasmuch as a quorum of the Commission was not present, informal discussions were held on
several subject s presently before the Commission. The proposed plans of the Englewood
State Bank to be relocated on the present City Hall site were studied and discussed.
Mr. Parkinson entered and took his place on the Commission.
I. CALL TO ORDER.
The regular meeting of the City Planning and Zoning Commission was called to order at
8 :50 P.M. by Chairman Carlson.
Members present: Touchton, Parkinson, Fullerton, Carlson
Romans, Ex-officio
Members absent: Rice
II. APPROVAL OF MINUTES.
Mr. Carlson stated the Minutes of February 17, 1965, and February 24, 1965, were to be con-
sidered for approval.
Fullerton moved:

written.
The motion carried unanimously.

The Planning Director stated that it was the opinion of Assistant City Attorney Criswell
this area could not be considered for zoning in view of the recent Supreme Court decision on
the Brookridge annexation, and a lawsuit filed against the annexation of this subject property
by the City of Littleton, He advised that the Commission should adopt a resolution vacating
the date set for Public Hearing on zoning of this property and continuing the matter in-
definitely until the outcome of these aforementioned lawsuits is known.
Brief d iscussion followed.
Fullerton moved:
Touchton seconded: The Commission adopt the following resolution vacating the Public
Hearing date previously set for zoning of the recently annexed property
owned by Mr. DeMoulin.
WHEREAS, the following described land , situate in the County of Arapahoe, State
of Colorado, to wit:

Parcel 1
Commencing at a point 587 feet West from the Northeast corner of the SE 1 /4 of
Section 15; thence South parallel with East line of said quarter Section 633 feet; thence
West parallel with North line of said q u arter Section 273.2 feet; thence in a Northwesterly
direction to point on North line 373.3 feet West from place of beginning; thence East 373,3
feet to place of beginning ;

Commencing at a point 633 feet South of a point 660 feet West from the Northeast
corner of the SE 1 /4 of said Section 15 ; thence South 14,5 feet; thence West 200.2 feet;
thence North 14.5 feet; thence East 200.2 feet to place of beginning;
was annexed to the City of Englewood on November 14, 1965, and;
WHEREAS, proceedings to consider the zoning of this land have been initiated in
compliance with Section 22.1-5 of the 1963 Co mprehensive Zoning Ordinance; and;
WHEREAS, on February 17, 1965, the City Planning and Zoning Commission set a date
for a Public Hearing on March 17, 1965, at 8:00 P.M., to consider the zoning of the aforesaid
land to R-3-B, a multi-family zone classification, and;
WHEREAS, subsequent to the action of the City Planning and Zoning Commission, the
Colorado Supreme Court has issued an order which involves the area to the north of this land ,
and;
WHEREAS, a court case has also been filed in District Court by the City of Littleton
which attacks the validity of the annexation of the subject area, and ;
WHEREAS, the validity o f this annexation of this land to the City of Englewood
depends upon the o utcome of the aforementioned lawsuits,
THEREFORE, BE IT RESOLVED: that upon the advice of legal counsel to the City
Planning and Zoning Commission, t h e Pu blic Hearing sche du led for March 17, 1965, at 8:00
P.M. on the zoning of the aforedescribed land to R-3-B, multi-family zone classification,
be vacated and the matter continued indefinitely, until the ou tcome of the aforementioned
lawsuits is known.
The motion carried unanimously.

The Planning Director explained that due to a misunderstanding, the legal notice for this re -
zoning had not been published in time for the date of March 17, 1965, previously set by the
Commission.
Touchton moved:
Fullerton seconded: The date of Public Hearing for the rezoning request made by Mr. Garrett
be changed to March 31, 1965, the property to be posted and proper
publication given in the official City newspaper.
The motion carried unanimously.
V, LETTER OF COMMENDATION.
Mr. Fullerton stated that Mr. Whitcomb had submitted his resignation from the Planning Commission
to Mayor Love. The resignation was accepted with regret. Discussion followed.
Fullerton moved:
Touchton seconded: A letter be written to Mr. Whitcomb commending him for his sincere
participation on the Planning Commission from the date of August 3, 1964,
to March 1, 1965.
The motion carried unanimously.
VI. RULES AND PROCEDURE MANUAL.
New copies of the Rules and Procedure Manual were given Commission members. These copies in-
clude the revisions in the policies o f the Commission.
It was moved and seconded to adjourn the meeting.
The motion carried unanimously, and the meeting was d eclared adjourned at 9:15 P.M.
