Scott William Powers, Attorney for Ms. Scott Robert Wilson, Attorney for the Englewood Coalition Court Reporter Carol Patterson William James called the meeting to order at 1:30 p.m. on September 20, 1979, in the Englewood Community Room. Mr. James stated the purpose of the meeting was to hear the pro-. test to the petitions for the recall of Vern Mann, Council- man at large. Mr. James stated the City Clerk's office received the peti- tions for recall on August 31, 1979, containing 595 signatures. On September 14, 1979, a protest to the petitions for recall was filed in the City Clerk's office by Audrey Scott. On September 15, 1979, he (Mr. James) sent notice of the hear- ing to all the people who circulated the petitions as well as to Audrey Scott. Mr. James asked for identification of those people who repre- sented certain interested parties at the hearing. Mr. William Powers stated he was present representing Ms. Audrey Scott, the protester to the recall petitions. Mr. Robert G. Wilson, Jr., stated he was present representing the Englewood Coalition, the petitioners for the recall. Mr. Powers challenged the hearing stating that the commission was not properly constituted to preside on this matter accord- ing to the City Charter. Mr. Powers stated the charter states that the Election Commission is composed of the City Clerk and two qualified electors. Mr. Powers argued since the City Clerk and only one qualified elector was present to preside over the matter, the Commission was incomplete and could not have juris- diction to hear the case. ENGLEWOOD ELECTION COMMISSION Minutes September 20, 1979 Page 2 Mr. Wilson stated he was not prepared to debate Mr. Powers's argument and asked for a recess. Mr. Wilson stated the issue was ffiQOt because the protest addresses only the reasons for recall. Mr. Wilson stated the matter was not subject to review and had no basis for protest since the right to recall is a fundamental right. Mr. Wilson stated a protest can only ad- dress the technical requirements of a petition for recall. Mr. Wilson cited the case Berzen vs. Boulder wherein the court ruled recall power is policital in nature and can not be addressed. Mr. Powers's stated the commission can not act because it was an incomplete body under the charter. Mr. James declared a recess at 1:36 p.m. The Election Com- mission reconvened at 1:45 p.m. Mr. James stated the Election Commission decided that a quorum was present and the hearing should proceed. Mr. Powers's asked for clarification. Assistant City Attorney DeWitt stated under general municipal law a quorum is sufficient to conduct a meeting. Mr. Powers's stated there was no law allowing the commission to proceed and that the home rule charter governed in this case. Mr. Wilson stated there was no law to file a protest under the recall section of the charter and under the constitution of the State of Colorado a recall petition should be heard before the officer it was filed and in this case it was filed with the City Clerk who is.hearing officer in this matter. Mr. Powers's restated his position. Assistant City Attorney DeWitt stated it was lawful to make certain changes adaptable to circumstances as long as they were consistent with the charter, state statutes, and the constitution. Mr. Powers's requested a recess for the purpose of filing a civil procedure with the district court protesting to the rightful jurisdiction of the Election Commission to hear this case. ENGLEWOOD ELECTION COMMISSION Minutes September 20, 1979 Page 3 Mr. Wilson also asked the Commission to rule on the protest as not being subject to review on the grounds filed. Mr. James asked for an opinion from the Assistant City Attorney concerning Mr~ Powers's request. Assistant City Attorney DeWitt stated that if the hearing is closed without a decision on the protest, the Court would pro- bably remand that the Commission reconvene to hear the case. Mr. DeWitt stated if the recess is denied and the hearing is continued, Mr. Powers could still file a petition with the Court, ask for a record review and the Court would rule on the decision of hearing. The Election Commission ruled that the hearing should proceed. Mr. Powers's stated he did not choose to address the issue any further on the grounds that he felt the Commission did not have jurisdiction over the case and dismissed himself from the hearing at 2:00 p.m. Mr. Wilson asked that the Commission deny or strike the pro- test and rule that the petition meets all the requirements. Mr. James declared a recess at 2:05 p.m. The Commission reconvened at 3:00 p.m. COMMISSION MEMBER JAMES MOVED THAT THE ELECTION COMMISSION ADOPT THE FOLLOWING FINDINGS OF FACT, CONCLUSION AND DE- CISION ON THE PROTEST OF PETITION REGARDING THE RECALL OF VERN MANN, COUNCILMAN AT LARGE: FINDINGS OF FACT: a) that the petitions for recall of Vern Mann were filed on August 31, 1979; b) that a protest of said petitions was filed on September 4, 1979, by Audrey Scott; c) that a notice of hearing on the proest was sent by certified mail on September 15, 1979, by William James; d) that petitions have been reviewed by the members of the Commission; ENGLEWOOD ELECTION COMMISSION Minutes September 20, 1979 Page 4 e) that there are 595 signatures on said petitions; f) that the records of the Election Conunission show that 1,811 votes were cast for councilman at large at the last General Municipal Election on the 8th of November, 1977; g) that the reason set forth in the petition is: "because he had failed to exercise proper discretion in the performance of his duties, and has failed to adequately and properly represent the will and best interest of the citizens of Englewood."; h) that each signer has set forth his or her residence and date of signature; i) that each petition has attached an affidavit duly notarized. CONCLUSION: a) that 453 signatures of qualified electors are neces- sary for the recall of councilman at large; b) that the petitions for recall are in proper order and meet the requirements of Colorado law; c) that the reason and grounds for recall are acceptable and sufficient to meet the requirements of Colorado law to conunence a recall election; DECISION: 1) the petitions are sufficient; 2) the petitions are in order; 3) to deny the protest to Audrey Scott.
