CLERK'S ELECTION GUIDE -REGULAR ELECTION ONLY GENERAL INFORMATION Explanation of References The Colorado Municipal Election Code is contained in C.R.S. 31-10-1340, as amended. Change of address may be made for the 31 days before and on election day. Elector must appear before the County Clerk and Recorder and state that he has moved prior to the 32nd day before election, and that he has lived at the new address in the precinct for at least 32 days. Upon verification of registration by the clerk, the county clerk shall issue a Certificate of Registration which the elector takes to new precinct. The judges shall use this form as a substitute registration sheet and return it with registration books. Registration Nominations GENERAL INFORMATION Registration with the County Clerk shall constitute registration for municipal elections. In addition the Municipal Clerk shall serve as Deputy County Clerk for purposes of registration only, in the county in which his municipality is located. The Municipal Clerk shall register any qualified elector residing in any precinct in such county who shall appear in person in his office. Registration requirements are the same for municipal elections as they are for general election except for 32 days residence in municipal election precinct. Nomination petitions may be circulated not more than 50 days before the election and must be filed no later than the 30th day before the election. Petitions are to contain at least 25 signatures. See also 31-10-103. Residence Requirements of signers: For a candidate in a city, at least 2'5 50 registered electors residing within the city; 5o For a candidate from a ward within a City, at least ~ registered electors residing in the candidate's ward. Change of Address 31 days before and on Election Day Change of Address may be made in person at the County Clerk's office or by using a form furnished by the County Clerk at any time during which registration is permitted, up to and including the day of election. Sec. 1-2-214, C.R.S. 1973. Any registered Elector moving from precinct where registered to another precinct within the municipality within 32 days prior to Election may cast his ballot where registered Absent Voters Applications Received From This Date 90 days before Election thru close of business on Friday before Election When Registered Elector shall be absent, or by reason o f his work or nature of his employment is likely to be absent or fears that he will be absent, or because of serious illness or physical disability or for reasons based upon the doctrines of established religions, shall be unable to attend the polls, he may cast an absentee ballot. Application is to be filed not earlier than ninety days before and not later than the close of business on the Friday immediately preceding the election. The application may be in the form of a letter. Upon receipt of application the Municipal Clerk shall examine the records of the County Clerk to ascertain if applicant is lawfully entitled to vote. If applicant is entitled to vote, the Clerk shall deliver personally to the applicant in the Clerk's office or mail to mailing address given, ballot, instruction card and return envelope with affidavit filled in, as to precinct and residence address. Clerk shall keep a record of Absent Voter's application when received, when mailed, etc. This information shall be recorded on the registration sheet or registration list before the registration book or list is delivered to the judges of election. A separate list of the electors who have received absent voter's ballots shall be delivered to the judges of election in the precincts designated for counting absentee ballots. First Day for Circulating Nomination Petitions Not more than 50 days or less than 30 days before Election Nomination Petition required to be filed with the Clerk not less than 30, nor circulated and signed more than 50 days before Election Day. Acceptance of Nomination must be attached to Nomination Petition when filed with the Clerk. Last Day an Elector can Register to Vote in This Election 32 days before Election Elector must have resided in the State for thirty-two days immediately preceding the election in which he offers to vote. Last Day for Filing Absentee Registration (due to serious illness or physical disability.) 32 days before Election Absentee Elector may make application to register by filing verified application with County Clerk up to and including 32 days before election. Change of Address 32 Days before Election Any registered elector who moves from precinct where registered to another precinct in same municipality with 32 days prior to election may vote in the precinct where registered. Last Registration Day 32 days before Election Last day for registration at Mun i c i pal Clerk's office before Election. Municipal Clerk to Deliver Registration Sheets to County Clerk 31 Days Deliver in person or by certified mail. before Election CRS 1-2-202(2) makes it mandatory that Municipal Clerks serve as Deputy County Clerks for purposes of registration. Last Day for Filing Nomination Petitions 32 Days before Election 30 days before election falls on Sunday, Sec. 31-10-103 requires such act to be done the preceding day which is not a Sat., Sun., or legal holiday. Withdrawal From Nominations May be Made Prior to 23 Days Before Election Prior to 23 days before Election Last day withdrawals can be made. Clerk shall notify Candidate's Vacancy Committee if none, then the three top names on the Petition of Nomination. Vacancy in Nominations Not later than 20 days before Election Vacancy in Nominations shall be filled not later than the 20th day before election. Objections to Nominations No later than the 18th day before Election Petitions shall be deemed valid, as determined by Clerk, unless written objection is filed within 3 days after petition is filed. Defects, if any, must be cured no later than the 18th day before election. Amendment to Petitions Prior to 15 days before election Petition that does not contain the requisite number of names of electors qualified to sign, may be amended in this respect any time prior to 15 days before election. Judges of Election At least 15 days before election At least 15 days before each municipal election the governing body shall appoint the Judges, who shall be registered electors of the precinct in which they are appointed and shall be at least eighteen years of age. A list of all persons so appointed shall be Number of Judges filed in Clerk's office subject to public inspection . At least 3 and such additional judges as the governing body deems necessary. Clerk shall make and file in his off ice a list of all such appointments, their names, address and precincts and wards. Immediately after appointment of Judges, Clerk shall send Certificate of Appointment to each appointee. With the above certificates, a Form of Acceptance shall be endorsed which shall be returned to the Clerk within 7 days. Voting Machine or Electronic Voting System 12 days before election May be provided for Absent Voter to vote in Municipal Clerk's Office from 12 days before election to close of business Friday before election . Statements of Expenses 11 days before election Candidates for off ice for which the monthly compensation is one hundred dollars or less shall file a statement of contributions and expenditures with the Municipal Clerk eleven days prior to election. All candidates for Municipal Offices with annual compensation of $1200 or more, file with the COUNTY CLERKS. Ballots -Form of Ballot 10 days before election 10 days before election Clerk to have Official and Sample Ballots in his possession 10 days before election. Voting Machine sample ballots to be arranged in the form of a diagram of the front of the Voting Machine. Note: MAIL ABSENT VOTERS BALLOTS as early as possible, after printed, as Absent Voter Ballots must be returned to Clerk by 5:00 p.m. Election Day. Clerk shall enter on Registration Sheet or Registration List number of ballot and date delivered or mailed. Enter dates Absent Voters' Ballots sent to Voters, and returned, in Record of Absent Voters' Book. Clerk to Post Polling Place Sign in Each Precinct Ten Days Before Election Clerk to Publish and Post Notice of Election At least 10 days before election stating: When election will be held Hours polls will be open Location of polling place in each precinct Qualifications of persons to vote in the Election Officers to be elected Questions to be voted upon Names of Candidates whose nominations have been certified Publish notice in not less than one or more than two newspapers within the municipality, such notice shall be as nearly as possible in the form in which the nominations shall appear on the official ballot. A copy to be posted at the clerk's office. Ballot Boxes, Voting Booths A separate ballot box is required for Absent Voter Ballots. One Manner of Absentee Voting by Paper Ballot 10 days before election thru Friday before election It is possible for an Absent Voter to make application between the time the absente e ballots are available and the close of business on Friday before election, at the Clerk's office in person, receive Absent Voter's Ballot, vote it in presence of the Clerk or Deputy and deliver it to the Clerk or Deputy. Stamp or write date and hour Absent Voters' Ballots are received by Clerk FROM Voter, on envelope containing such ballot. And if delivered in person, the name and residence of person delivering same. Registration Lists 5th day before election On or before the fifth day preceding the election the County Clerk shall certify and deliver to the Municipal Clerk the registration lists or books. Municipal Clerk shall attach his certificate stating such book or list contains the registration sheets or names of all registered electors in each precinct and total number of sheets or names. Last Day to Apply for Absent Voter Ballot Friday preceding election Before the closing of business on Friday before election, last day to apply for Absent Voter Ballot. Delivery of Ballots, Ballot Boxes and Supplies At least 1 day before election ELECTION DAY Nov Watchers Clerk delivers ballots in one or more Sealed Packages to one of the Judges of Election between the close of business Friday and Monday 8:00 p.m. before Election Day. Receipts shall be given by the Judge for same. May also be delivered earlier at Judges' school of instruction. Clerk shall case Ballot Boxes to be delivered to the Judges of Election within 1 day before election. All regular Election supplies, booths, etc. should be delivered at that time. At least one day prior to election one of the Judges may call in person to receive registration book or list, or Clerk may deliver same to one of the Judges. Book or list to be delivered in sealed envelope or container. Judge shall give his receipt. ELECTION DAY Each candidate, or interested party in case of an issue, may name a watcher, who must be a registered elector of the municipality, in any precinct in which he is a candidate or in which an issue is on the ballot. The candidate or interested party is to certify the names of the watchers to the Clerk on forms provided by the Clerk. Watcher may appoint a substitute for himself, such substitute to be made known to the Judges of Election by Affidavit of the first person so selected. Voting Machines and Electronic Voting System Voting machines used in casting of Absentee Ballots shall remain locked and the tabulation of the votes cast shall remain unknown until the day of election. Deliver Absent Voter Ballots Election Day All Absent Voter envelopes received by 8:30 A.M. on election day are to be delivered to the Judges of one of the precincts (which precinct shall be selected by the Clerk) in a sealed package> Or in his descretion the clerk may elect to deliver the absent voters' envelopes received from electors of each precinct and the list of absent voters for each precinct to the judges of such precinct. The package shall have a statement written or printed on it stating number of ballots contained therein. Also list of Absentee Voters. Also all such books, records and supplies as shall be needed for tabulating, recording and certifying said absent voters ballots. Clerk to take a receipt therefor. Clerk shall continue to deliver additional Absent Voters envelopes received throughout Election Day until 5 p.m. in the same manner as above. A separate ballot box is required for Absent Voters Ballots, as they must be certified separately. Compensation of Judges of Election Judges of any municipal election using paper ballots, voting machines or electronic voting system, shall be paid not less than $5.00 nor more than the maximum amount allowed by statute for payment to the judges of a general election as determined by the governing body of the Municipality. The Judge who returns registration book or list and Election Returns, etc., shall receive an additional amount not to exceed $4.00 for this service, whether paper ballots or voting machines are used. Abstract of Votes to be Posted The Judges of Election are to make out an abstract of the count of votes and post it outside the polling place as soon as the count is taken. Return of Registration Book, Ballot Boxes and Election Returns Paper Ballot and Voting Machine Precincts. The Judge of Election shall deliver the certificate and statement together with the registration book or list, Ballot Boxes and all other election supplies and papers, and Clerk shall give his receipt for same. Canvassing of Election Returns Before 7 days after election The Clerk shall call to his assistance the Mayor if he shall not have been a Candidate, or, if he was, then a Municipal Judge, no later than the seventh day after election, and proceed to open the returns and make Abstract of Votes for each office. Publish copy of Statement of Certificate of Determination in a newspaper of general circulation in the Municipality. The Clerk shall post same when no newspaper is published in the Munici~ality. Also file a copy of such Statement of Certificate of Determination with the Secretary of State. Filing of Expense Statements Within 30 days after election All candidates must file sworn statement of contributions and expenditures within 30 days after election. See page 6 for details for filing. Records to be Kept Ballots are to be kept for six months, or until time of expiration of Contest proceedings. See new law for methods of destruction. Other official election records and forms are to be kept for six months. The Book for recording Statement of Certificate of Determination of Election should be kept as a permanent record. POLICY ADOPTED BY THE ENGLEWOOD ELECTION COMMISSION -OCTOBER 7, 1981 Absentee Voter Request Procedure 1. All requests for absentee voter ballots must be received in writing: A. Form provided by the City Clerk B. A letter or postcard stating: -Name of requester -Residence address -Reason for absence -Address where ballot should mailed 2. The City Clerk's office will receive written requests fro m one family member for another family member. This will be li mited to parents requesting for children, children requesting for parents, and a spouse requesting for the othe r spou se . 3. Oral or telephone requests will not be honored. Persons wil 1 be informed of the written requirements. A form will b e sent to a ny person upon oral or telephone request.
