ENGLEWOOD ELECTION COMMISSION
JULY 16, 1987

The Englewood Election Commission met in special session on July 16, 1987.
Chairman Nilsen called the meeting to order at 4:45 p.m.

The Chairman declared a quorum present .
Also attending: Deputy City Clerk Ellis

City Clerk Crow reviewed the proposed packet of materials for City Council
candidates to include: Brochure entitled "Candidate Information", Election
Calendar, Oistrict/Precinct Map, Candidate Profile for Englewood Citizen,
Campaign Reform Act, and City Charter . An updated Campaign Reform Act
brochure should be received from the Secretary of State's Office by August 1,
19~7 . All candidates are subject to the Campaign Reform Act and must comply
with its filing requirements. Ms. Crow stated that the City Attorney has
determined that the election procedures be in accordance with the Colorado
Municipal Election code. She announced that Dorothy Dalquist, Public
Relations Specialist, will handle publication of the precinct map and articles
concerning election information. The ca ndidate packets may be ready by July
31, 1987 if the updated Campaign Reform Act is received . Ms . Crow asked for
suggestions from the Commission as to the contents of the packets.
Member Kollath stated she felt we needed to provide a definition of a
"qualified elector". It was decided to i nclude that information on both the
petition and the "Candidate Information" Brochure. (Clerk's Note: Acting
City Attorney Reid has determined that "qualified elector" is defined as one
who is eligible to register to vote.)
Chairman Nilsen discussed the procedure for certifying the nomination
petitions. Discussion ensued. Ms. Crow asked for direction from the
Commission on the procedure the Clerk's office should follow in distribut i ng
nomination petitions, stating the State statutes specify that petitions may
not be circulated or signed prior to the 50th day preceding the election, but
do not specify when the petitions may be distributed. Discussion ensued . Ms .
Crow advised the Commission that one peti t ion had been given out to an unknown
prospective candidate before a procedure had been established . Ms . Kollath
stated she did not want to set a precedent by extending the dates established
for this election. Member Bull stated he felt the petitions could be included
in the candidate's packet when they pick them up, as he did not see the need
to have them make a second trip in to our office. The Commission agreed that
the Clerk's office could mail the petitio n to a candidate if requested .

FROM THE ELECTION CALENDAR AND LEAVE SEPTEMBER 14 AS IS. IF A CANDIDATE
DEMANDS A PETITION WE WILL SUPPLY ONE.

Chairman Nilsen declared the motion carried.

Member Kollath questioned the reasoning behind the restriction on banners of
paper or cloth. Ms. Kollath pointed out that the information on candidate
signs does not provide for direction on who is responsible for removing the
signs after the election. Ms. Kollath stated that she felt we needed to
specify the actual date signs may be posted and the actual date they must be
removed as opposed to 45 calendar days prior to the election and 15 calendar
days following the election.

Deputy City Clerk Ellis advised the Commission on the status of the election
judges list.

There was considerable discussion on whether a citizen could sign more than
one petition for one vacancy. City Clerk Crow read CRS 31-10-302(5) which
states "No registered elector shall sign more than one nomination petition for
each separate office to be filled in his municipality or municipality and
ward, as the case may be. Each office of the governing body that is to be
filled by the electorate shall be considered a separate office for the purpose
of nomination. In municipalities in which offices of the governing body are
filled both by election from wards and election at large, an elector may sign
a nomination petition for each office to be filled from his ward and also for
each office to be filled by election at large." Member Kollath requested that
the statement be included on the petition, but in language that is easier to
understand.

Member Kollath questioned the confidentiality of the absentee ballots. She
requested that the Clerk's office check out the procedure.

MEMORANDUM
TO: Members of the Election Commission
FROM: Patricia H. Crow, City Clerk
DATE: September 21, 1987
SUBJECT: Election Judges/Other Matters
Attached is a list of the proposed judges for the November 3, 1987, election.
Please review the list and advise us as soon as possible if you are aware of
any problems with our selections. All of the attached responded in the
affirmative to our inquiry as to their availability and willingness to serve
in this election.
In precincts where we had several respond, we have named two alternate judges.
We have also tried to use those with more experience as head judges, and have
tried to use a few new individuals in an effort to add "new blood" to the
group.
We plan to send out notices of appointment on October 5 and are asking those
who are appointed to confirm their acceptance by October 16. The last day to
appoint elect i on judges is October 19.
An updated distribution list of City Council Candidate Packets is enclosed
Charter amendments to be included on the ballot are:
CHARTER AMENDMENT NO. 1 FOR AGAINST
Shall the Home Rule Charter be amended to increase from $2,500 to $10,000 the
requirement for competitive bidding for purchase of supplies, materials, or
equipment, amending Section 113 of Article X?
CHARTER AMENDMENT NO. 2 FOR AGAINST
Shall the Home Rule Charter be amended to increase from $5,000 to $20,000 the
requirement for competitive bidding on capital improvement projects and
require negotiated contracts to be approved by Council Resolution amending
Section 116 of Article X?

CHARTER AMENDMENT NO. 3 FOR AGAINST
Shall the Home Rule Charter be amended to add the following wording to Section
9 of Article I: IF ANY PROVISION IN THIS CHARTER IS IN CONFLICT WITH THE
STATE STATUTES OR STATE CONSTITUTION, THE PROVISIONS OF THE STATE STATUTES OR
STATE CONSTITUTION SHALL SUPERSEDE THIS CHARTER IF THE MATTER HAS BEEN
DETERMINED TO BE OF STATEWIDE CONCERN. THIS SHALL NOT CONSTITUTE A WAIVER OF
THE CITY'S RIGHTS UNDER ITS HOME RULE CHARTER, AND, IN ANY OTHER MATTER, THE
CHARTER SHALL RULE?
At this point, it seems doubtful the United Cable Franchise question will be
included on the ballot, as time is running out and negotiations are still not
completed.
Hazel feels we should meet on October 15 to certify the list of candidates and
ballot questions -please let us know if this date is okay -5:00 p.m. in
Room 115 (Community Room/Pre-trial Waiting Room). Lou will be calling in a
day or two to check on the proposed election judges and will confirm this
meeting with you then.
If any of you would like to assist us in checking the nomination petitions for
required sufficiency, we will be working on that Saturday and possibly Sunday,
October 3 and 4. We could a 1 so use some he 1 p putting 1abe1 s onto postcards
which we are mailing to registered voters of those precincts which were
affected by the redistricting process -about 6,700 cards. Volunteers,
anyone????
