Owen, Deputy City Clerk FROM: Jack Olsen, City Attorney DATE: February 22, 1985 RE: Career Service Election 3400 S . Elat i Stree t Engl ew oo d , Co lo rado 80110 Phon e (303 ) 761 -1140 The City Charter is silent with regard to specific election procedures. On the other hand, E.M.C. 4-5-1 says certain procedures shall apply, and they include very clearly stated requirements for getting onto the ballot. Among the requirements is that nomination petitions be c i rculated during a certain period and that each petition be signed by at least 25 f ull-time permanent classified City employe es. When a petition process is required, wr i te-ins are not per- mitted, because that sidesteps the petition requirement. I do not see an y language in the Charter or ordinance that provides an exception to the petition requirement. Thus, I advise that write-ins are not permissible. If a write- in won the election, then the results could b e legally overturned. bb
