Present: Absent: Kollath, Wilson, Crow Bull (NOTE: ONE VACANCY EXISTS) Also present: Freeman, Finance Director DeWitt, City Attorney Ellis, Deputy City Clerk * * * * * City Clerk Crow provided the Commission with information on the matters which led to Mr. Haidon's protest regarding residency requirements for council membership. She stated Mr. Haidon is protesting the residency requirement change from three years as stated in the Charter to one year. This protest was discussed by Council on November 20, 1989 and a decision was made to request a declaratory judgment from District Court concerning this matter. Ms. Crow assured the Commission that the decision to change residency requirements from three years to one year was made prior to anyone expressing interest in running for Council and was not done to accommodate any one candidate over another. City Clerk Crow advised the Commission that the City Council will consider a resolution Monday, December 4, 1989 setting January 30, 1989 as the date of the Special Election. She noted both associations had agreed to the date, but she did not know if there had been a determination as to the wording of the EPBA question on the ballot. City Clerk Crow questioned the Commission on the number of polling places they would like to use. Chairman Kollath asked how many voters we anticipate. Ms. Crow stated she would prepare for a 40% voter turnout, but it would probably be about 10%. The Commission reviewed previous elections for voter turnout percentages. Ms. Crow advised the Commission that she would need a decision by December 15, 1989 on the number of polling places and type of ballot. It was confirmed that it is within the Commission's authority to establish polling places. Discussion ensued regarding projected voter turnout. Chairman Kollath stated they would take it under further advisement with Member Bull . City Attorney DeWitt responded to questions from the Commission regarding the residency requirement issue. Chairman Kollath stated that she had received a call from Mr. Haidon and she was very concerned as to how to respond to him. Mr. Haidon felt his protest should have been handled by the Election Commission and that "they were not doing their job". The Commission requested that Mr. DeWitt define the authority of the Election Commission and whether they have the power to resolve a dispute. ,• After lengthy discussion over this matter, the Commission did not feel that anything had been resolved and they still did not have clear direction. Member Wilson left the meeting at 5:35 p.m. City Attorney DeWitt stated he would prepare something in writing to answer the Commission's question with regard to Haidon's protest.
