The bill is schduled for second and reading on July 16, 1990. If approved on second reading, the questions which appear on page 2 of the bill will be included on the November 1991 election ballot . BY AUTHORITY ORDINANCE NO. ___ _ COUNCIL BILL NO. 29.1 INTRODUCED BY COUNCIL 1'1EMBERS HABENICHT, HATHAWAY AND CLAYTON SERIES OF 1990--- A BILL FOR AN ORDINANCE SlIBMI'ITING TO A VOI'E OF .THE QUALIFIED ELECI'ORS OF THE CITY OF ENGLE.WX)[) AT THE NEXT SCHEDULED RffiULAR MUNICIPAL ELB:TION PROPOSED AMENIY.1ENT TO THE CHARTER OF THE CITY OF ENGLE\\WD RELATING TO AGE AND RESIDENCY REQUIREMENTS OF MEMBERS OF THE CITY COUNCIL. BE IT ORDAINED BY THE CITY COUNCIL OF TrlE CITY OF ENGLE.WCX)D, COLORAOO, TrlAT: Section _ l. There is hereby submitted to the qualified electors of the City of Englewood at the next scheduled regular municipal election proposed arrendrrent to the Charter of the City of Englewood, as follows: That the qualified electors of the City of Englewood shall choose one of the following provisions. If either question No.l or No.2 is approved by the qualified electors, upon certification thereof to the office of the Secretary of State of the State of Colorado, pursuant to Section 9, Article XX, of the Colorado Constitution and Section 31-2-210 Colorado Revised Statutes, Article III of the Home Rule Charter of the City of Englewood shall be amended. 23: QUESTION _No._l: ARTICLE III LffiISLATIVE BODY QU?>LIFICATIONS OF OOOtK!IllHi COUNCILPERSONS No person shall be eligible for the off ice of Counei:l:&aa COUNCILPERSON unless at the tirre of the election the person is a citizen of the United States, at least twenty-five (25) years of age, shall have been · for three ONE years-imnediately preceding such election a qualified elector of the City. Section 2. the voting machines and paper ballots for said election shall carry the following designation which shall be submission clause: QUESTIOtL No. _ l: Should the Charter of the City of Englewood relating to Article III, "Legislative Body,11 ·establishing the the residency requirement for City Council rrernbership be changed from three (3) years to one (1) year irrmediately preceding the election. (A three year residency requirement has been declared unconstitutional by the Supreme Court of Colorado and one (1) year residency requirement is constitutional. ) Yes ... _ No Question _ No. _ 2: Should the Charter of the City of Englewood relating to Article III, "Legislative Body,11 establishing the age requirement for City Council membership be changed from twenty-five (25) years of age to twenty-One (21) years of age. Yes No And each elector voting at said election and d=sirous of voting shall indicate his choice by depressing the appropriate oounter of the voting machine or by appropriate marking upon paper ballots where used. ... • -' Section _3. The proper officials of the City of Englewood shall give notice of said regular municipal election, which notice shall be published in the manner and for the length of tirre required by law, and the ballots cast at such election shall be canvassed and the result ascertained, determined, and certified as required by law.
